PETITION FOR PERMISSION TO COMPROMISE CLAIM
TO THE HONORABLE,P.V.MARINO,JUDGE OF SAID COURT:
The petition of LILLIAN BEBOUT respectfully represents:
1.!hat Letters Testamentary were granted to your petitioner by the
Register of Wills for Washington County,Pennsylvania on March 7,1969.
2.That your petitioner sold the real estate of the deceased,situate in
the Borough of Midway,Washington County,Pennsylvania.
3.That at the time of closing it was brought to the attention of your
petitioner that Weirton General Hospital had a default judgment against Jennie Thomas,
at No.204 september Term,1964 A.D.in an assumpsit action in the amount of $714.87.
4.Investigation by your petitioner disclosed that the hospital had received
payment from the Department of Public Welfare and that at the time of payment the hos-
pital signed an invoice certifying that "no amount in addition to the amounts listed
have been or will be charged or accepted on account of any inpatient hospital care
rendered to the patient for the period listed."
5.As a result of negotiations with Attorneys for the Weirton General Hospi-
tal,it has been agreed,subject to the Court's approval,to pay $100.00 and the costs
in return for a satisfaction of the judgment.
6.Your petitioner believes such settlement to be for the best interests of
the estate,since the expense of other proceedings to dispose of the hospital's claim
would exceed this amount.
WHEREFORE,your petitioner respectfully prays your Honorable Court for per-
mission to payout of the funds in her hands the sum of $100.00,plus the record costs,
for the satisfaction of the judgment of Weirton General Hospital at No.204 September
Term,1964 A.D.
And she will ever pray,etc.

tract,two pieces had been conveyed',So that the description as
offered to them was with two exceptions.And they do not want that
type of description.They want it just around the perimeter.
THE COURT:Suppose we continue this matter indefinitely
and counsel should keep in touch with the Court so that when it is
ready we can set a date for the hearing.
MR.DONALDSON:I'll come in and ask the Court to set a time,
I think that might be advantageous in view of their inability to give
us any date whatsoever.We could be a month away yet.

we could complete the sale of the real estate and the purchaser
was having problems getting a mortgage.I have all the necessary
papers here.No spouse survived.Rosaline Hannan,one of the
heirs,a daughter,is deceased.I have receipts signed by Lillian
Bebout,Rosaline Hannan and William Haley each for $1,000 apiec e

back in September 2nd of 1970 when there was a partial distributi n.
As I mentioned,the real estate has been sold.There are no unpa'd
creditors as far as I know.And I have a list of additional debits
and credits which perhaps it wou ld be better that I go over at th is
time,since some time has elapsed since we had the original
call for l?udit.On the sale of the real estate,we had the $400.O(
gross gain,with nine months of rental that ~mounted to $360.00.
And there was a return on insurance premium of $4U.oO.There
were additional credits,$4.10 for costs;$1.00 for an Order;
$50 ..00 for survey;$5.00 for filing the petition;the Prothonotary's
costs on the judgment,which was compromised,$26.30;$100.00
went to the Weirton General Hospital;Notary fee of $2.00;I'm
asking fora;hadditional $75.00 to cover my fees in connection wiU
settling that miserable claim and sale of the real estate,which
the Court will recall we had many difficulties in connection with U e
sale.
Then in the original account as filed,I had
claimed credit for $159.69,which vnad been advanced by the
heirs to pay the debts because at that time we thought we were
going to have to take the real estate in kind.So I have included
that in here to balance things.Half the Transfer Stamps on the
sale of the property,$44.00;pro-rata share of the Ib70 real esta e
tax of $58.U4;insurance premium,$10.UO;and $15.l.JO claim
that we received from the cemetary association.

I mIght explain to the Court that the delay in
connection with this audit was due to the difficulties we had in sec ring
from the Farmers Home Administration the $1100.UO which they
,
had withheld pending satisfaction of the judgmnEfut.Even after

ffied on Apru;30,1969,in the estate of the above named decedent.".,"'"tv ''-.
(......A careful review of the matter presented,as well as consideration
of the infomation given to us by a member of your staff by telephone
on July 16,1969,we find that the appraisement of this account was
proper.There is no question that the balance in the account at the
time of Jennie 'fhcnas·death was the figure shown in your appraisement
of $1,180.13.
It appears that what )la8 occurred is that the Social Security
Administration had overpaid the social security benefits to the decedent
and that the administration is J.'equesting of.the estate the return of
the sum overpaid.
This 1s not a case whElre we would correct the amount in the
account at the time 01 the decedentfs death,but would,in our opinion,
be a proper item for consideration on the Statement of Debts and Deductions
to be filed in this estate.AC(~ordiDgly;we can not approve the requested
change to the appraisement although we concede that the amount of overpayment
which was returned to the Social Security Administration l'lould be a proper
deduction..
