PETITIOO TO SELL REAL ESTATE
TO THE HONORABLE JUDGE OF SAID COURT:
The Petition of Joseph J.Rrye,Administrator c.t.a.
of the Estate of Arthur W.Frye,deceased,respectfully sets
forth:
1.That Arthur W.Frye died testate and a resident of
the City of Monongahela,Washington County,Pennsylvania,on or
about February 14,1969.
2.That the decedent became seized of an undivided
one-third (1/3)interest in and to --
A~li that certain piece or parcel of iand situate in th
Third Ward of the City of Monongahela,Washington County,Penn-
sylvania,being a part of Lot Number Ninety-one (91)in J.W.
Lockhart and Company's Addition to the City of Monongahela and
recorded in Plan Book Vall,page 42,bounded and described as
follows:
BEGINNING at the Southwest corner of Ninth and,Chess
Streets;thence extending Southwardly,along the Western side of
said Ninth Street,One Hundred Fourteen and Seventy-five Hundredt s
(114.75)feet to land formerly of Cora E.Anton (now of Emil A.
Grodecour);thence North 68°30'West,along the Northern side of
said land formerly of Cora E.Anton (now of Emil A.Grodecour),
Sixty-five and Fifty-eight hundredths (65.58)feet to the Eastern
side of Spri~9 Alley;thence Northwardly,along the Easte~n side
of said Spring Alley,One Hundred Eight and Nine Tenths'(108.9)
feet to the Southern side of Chess Street aforesaid;and thence
Eastwardly,along the Southern side of said Chess Street,-Fifty
(50)feet to the Southwest corner of Chess and.Ninth Streets,at
d ''"the place of beginning.
BEING the same premises conveyed to Joseph Frye and
Isabella Frye,his wife,by deed of peoples-Pittsburgh Trust
Company,and John S.C.Herron,substituted Trustee under'the
Last Will and Testament of J.B.Fmnley,deceased,dated May 24,
1943,and of record in the Office of the Recorder of Deeds in
and for Washington County,pennsylvania,in Deed Book 666,page
452.The said Joseph Frye died on or about November 17,1966,
whereby title to the same became vested in Isabella Frye.The
said Isabella Frye died on or about June 11,1967,and in and
under paragraph ."Third"of her Last Will and Testament dated
February 2,1957,and of record in the Office of the Register of
Wills in and for Washington County,Pennsylvania,in will Book
Volume ,page ,devised the foregoing real estate to her
daughters,Isabelle Marie Frye and Marjorie Lucille Frye,and
her son,Arthur William Frye,their heirs and assigns,in equal
shares,as tenants in common.
See also Satisfaction and Release of Legacy and Charge
on Real Estate dated March 29,1968,from Margaret Monahan,et al.,
to Isabelle M~.Frye,Marjorie R.Frye,and Arthur William Frye,
and which said Satisfaction and Release of Legacy and Charge on
Real Estate is of record in the Office of the Recorder of Deeds
in andffor Washington County,Pennsylvania,in Deed Book Volume
1279,page 305.
3.That the decedent was also seized of the following
real estate as set forth in the inventory:
Lots Numbered 35, 36,and 37 in the Corrin Plan of
the Second Ward of the City of Monongahela,washington County,
Pennsylvania.See Deed Book Volume 1005,page 636.$1,000.00
Two story frame building with brick front used as
storeroom and ~partment,and a three stall tile garage,fronting
25 feet on the Southerly line of West Main Street in the City of
Monongahela,Washington County,pennsylvania,and known as 420
west Main street.See Deed dated January 3,1955,in Deed
Book Volume 919,page 257.$12,000.00
Neither of these parcels has been sold.
4.That the said Arthur W.Frye died testate on or
about February 14,1969,and in and under his Last Will and Testa-
~ent dated August 29,1961,and of record in the Office of the
Register of Wills in and for Washington County,Pennsylvania,in
Will Book 107,page 394,bequeathed and devised all his property,
real,personal and mixed,wheresoever situate,to his brothers,
Joseph Frye and "Uames Frye,and to his ;sisters,Mary C.Frye,
Marjorie R.Frye,and Isabelle M.Frye,all of the City of
Monongahela,Washington County,Pennsylvania,and Ann C.Barker
and Margaret Monahan,both of Pittsburgh,Allegheny County,
Pennsylvania,their heirs andaassigns,in equal shares.The said
Mary C.Frye died on or about January 17,1966,whereby her

interest lapsed.A copy of said will is hereto attached and
marked Exhibit "A".
5.That the said Joseph J.Frye,Administrator c.t.a.,
desires to sell,and has entered into an Agreement for the Sale
of Real Estate described in paragl!aph "Two"herein with Marjorie
R.Frye and Isabelle M.Frye,as tenants in common,both of the
City of Monongahela,Washington County,Pennsylvania,in considera
tion of the sum of Four Thousand and No/IOO ($4,000.00)Dollars
for the undivided one-third (1/3)interest therein.
6.Attached hereto and made a part hereof and marked
Exhibit "B"and Exhibit ,'C"are affidavits of two responsible
persons familiar with real estate values as to the fair market
value of the property to be sold.
7.The personal property in said estate carried an
inventory va~ue of $41,206.34,which consisted of Series E Bonds,
postal Savings Bond,Corporate Shares,and cash.
8.The Administrator c.t.a.at the ~time that letters
were granted on March 3~1969,filed a bond in the amount of
___________Five Thousand and no/IOO ($5,000.00)Dollars ---------
and the United States Fidelity and Guaranty Company of Baltimore,
Maryland,is the surety on said bond.
9.Attached hereto and made a part hereof and marked
Exhibit "D"is a Certificate from the County Commissioners of
Washington County,Pennsylvania,showing the assessed value of
the above described premises to be Four Thousand Thirty and No/IO
($4,030.00)Dollars.
10.All the interested parties have approved of such
sale and further have executed a special warranty deed to
Marjorie R.Frye and Isabelle M.Frye,as tenants in common.
WHEREFORE,Your Petitioner prays your Honorable Court
that he be authorized to sell the said premises as provided for
by §541 of the Fiduciaries Act of 1949,P.L.512,and a bond
be set.

TO THE HONORABLE JUDGE OF SAID COURT:
The Petition of Joseph J.Frye,Administrator c.t.a.
of the Estate of Arthur W.Frye,deceased,respectfully sets
forth:
1.That Arthur W.Frye died testate and a resident of
the City of Monongahela,Washington County,pennsylvania,on or
about February 14,1969.
2.That the decedent became seized of certain lots in
the Second Ward of the City of Monongahela,Washington County,
Pennsylvania,during his lifetime,a full description appears as
follows:
ALL those three (3)certain lots or parcels of land
situate in the Second Ward of the City of Monongahela,Washington
County,Pennsylvania,known and designated as Lots Numbered 35,
"36,and 37 in the Corrin Plan of Lots,which said Plan is of
record in the Recorder's Office of Washington County,Pennsy1vani~,
in pian Book 5,pages 190 and 191,and which said Lots Numbered
35,36,and 37 in said Corrin Plan are together bounded and
described as follows,to-wit:
BEGINNING at a point on the Westerly side of Corrin Av
in said Plan at the Northeast corner of Lot Numbered 34 in said
Plan;thence North 42°04'East along the Westerly line of Corri
Avenue,a distance of one hundred thirty-five (135)feet to the
Southeast corner of Lot Numbered 38 in said Plan;thence North
47°56'West along the Southerly line of said Lot Numbered 38,a
distance of one hundred five (105)feet to the Southeast corner
of Lot Numbered 20 in said Plan;thence South 420 04'west along
the Easterly line of Lots Numbered 21,22,and 23,a distance of
one hundred thirty-five (135)feet to the Northeast corner of Lot
Numbered 24 in said Plan;thence South 470 56'East along the
Northerly line of Lot Numbered 34 in said Plcn,a distance of
one hundred five (105)feet to the Westerly line of Corrin Avenue
at the point or place of beginning.
THE property hereinabove described is hereby conveyed
under and subject to the oil and gas lease held by the Citizens
Gas Company,dated July 7,1919.
EXCEPTING AND RESERVING herefrom and hereout such coal
and mining rights as 'have heretofore been sold and conveyed away.
BEING the same premises conveyed to Arthur W.Frye
by deed of Harry F.Stev.enson,also known as Harry Frank Steven-
son,and Julia Stevenson,his wife,dated September 26,1957,and
of r~cord in the Recorder's Office in and for Washington County,
Pennsylvania,in Deed Book Volume 1005,page 636.
3.That the decedent was also seized of the following
real estate as set forth in the inventory:
Two story frame building with brick front used as
storeroom and apartment,and a three stall tile garage,fronting
25 feet on the Southerly line of West Main Street in the city of
Monongahela,Washington County,Pennsylvania,and known as 420
West Main Street.See Deed dated January 3,1955,in Deed Book
Volume 919,page 257.$12,000.00
One-third (1/3)of property located a~900 Chess Street
in the City of Monongahela,Washington County,Pennsylvania.
See Deed Book Volume 666,page 452.$4,000.00
This parcel was sold for the sum of $4,000.00.
4.That the said Arthur {O\}.Frye died testate on or
about February 14,1969,and in and under his Last Will and Testa
ment dated August 29,1961,and of record in the Office of the
Register of Wills in and for Washington County,Pennsylvania,in
Will Book 107,page 394,bequeathed and devised all his property,
real,personal and mixed,wheresoever situate,to his brothers,
Joseph Frye and James Frye,and to his sisters,Mary C.Frye,
Marjorie R.Frye and Isabelle M.Frye,all of the City of
Monongahela,Washington County,Pennsylvania,and Ann C.Barker
and Margaret Monahan,both of Pittsburgh,Allegheny County,
Pennsylvania,their heirs and assigns,in equal shares.The said
Mary C.Frye died on or about January 17,1966,whereby her
interest lapsed.A copy of said will is hereto attached and
marked Exhibi t "A".
5.That the said Joseph J.Frye,Administrator c.t.a.,
desires to sell,and has entered into an Agreement for the Sale
of Real Estate described in Paragraph "Two"herein,a copy of
which is hereto attached and marked Exhibit "B",with Frye Con-
struction Inc.,Monongahela,Washington County,pennsylvania,in
consideration of the sum of ~hree Thousand and No/IOO ($3,000.00)
Dollars.
6.Attached hereto and made a part hereof and marked
Exhibit "c"and Exhibit "D"are affidavits of two responsible
persons familiar with real estate values as to the fair market
value of the property to be sold.
7.The personal property in said estate carried an
inventory value of $41,206.34,which consisted of Series E Bonds,
Postal Savings Bond,Corporate Shares,and cash.
8.The Administrator c.t.a.at the time that letters
were granted on March 3,1969,filed a bond in the amount of
Five Thousand and no/IOO ($5,000.00)Dollars and the United State
Fidelity and Guaranty Company of Baltimore,Maryland,is the
surety on said bond.An additional bondf in the amount of
Five Thousand and no/IOO ($5,000.00)Dollars with the same Compa
was filed at the time of the sale of the interest in the house
and lot inTthe Third Ward of the City of Monongahela.
9.Attached hereto and made a part hereof and marked
Exhibit "E"is a Certificate from the County Commissioners of

Washington County,Pennsylvania,showing the assessed value of
the above described premises to be Two Hundred Seventy ($270.00
Dollars.
WHEREFORE,Your Petitioner prays your Honorable Court
that he be authorized to sell the said premises as provided for
by §541 of the Fiduciaries Act of 1949,P.L.512,arid a 'bond
be set.

The Petition of Joseph J.Frye,Administrator c.t.a.
of the Estate of Arthur W.Frye,deceased,respectfully sets
forth:
1.That Arthur m.Frye died testate and a resident of
the City of Monongahela,Washington County,Pennsylvania,on or
about February 14,1969..,.
2.That the decedent became seized of certain lots or
parcels of land situate in the Third Ward of the CitY,of Mononga
hela,Washington County,pennsylvania,during his lifetime,a
full description appears as follows:
FIRST:ALL that certain lot or parcel of land
situate in the Third Ward of the City of Monongahela,Washington
County,Pennsylvania,and bounded and described as follows,to-
wit:
BEGINNING on the Southern side of Main Street,at a
point Forty-six (46)feet Eastwardly from the Southeast corner
of Main Street and Short Alley (said point of beginning being
also the Northeast corner of land now or formerly of W.B.White
thence extending,from the point of beginning aforesaid,East-
wardly,along the Southern side of said Main Street,Twenty-five
(25)feet.to land of the heirs of S.C.Markell,deceased;thenc
Southwardly,between said land now of the heirs of S.C.Markell
deceased,on the East and land aforesaid of W.B.t~ite,on the
West,Fifty (50)feet to land hereinafter described at "Second".
Also the free use of ingress and regress through an Alley Three
(3)feet wide to back of above described lot,the grantees hereof
to keep a gate hung at the mouth of this Alley.
SECOND:ALL that certain lot or parcel of land
situate in the Third Ward of the City of Monongahela,Washington
County,Pennsylvania,being a part of Lot Number One Hundred
Forty-four (1~4)in Wickerham's Plan of Lots,and bounded and
described as follows,to-wit:
BEGINNING at the Southwest corner of land hereinabove
described at "First";thence extending along the Southern side
of said land hereinabove described at "First",South 57_1/4°
East,Twenty-six and one-half (26-1/2)feet,more or less,to
land of the heirs of S.C.Markell,deceased;thence along the
Western side of said land of the heirs of S.C.Markell,deceased
South 32_3/4°West,Fifty (50)feet,more or less,to land now
or formerly of R.E.Byers;thence along the Northern side of
said land now or formerly of R.E.Byers,North 57_1/4°West,
Twenty-six and one-half (26-1/2)feet,more or less,to land now
or formerly of H.D.Gamble;thence along the Eastern side of
said land now or formerly of H.D.Gamble,North 32_3/4°East,
Fifty (50)feet,more or less,to the place of beginning.
THE lot or parcel of land hereinabove described at
"Second"is hereby conveyed under and subject to the Ten (10)
foot private alley,and all the rights and privileges connected
therewith,as excepted and reserved in the deed of T~lliam J.
Markell to Hiram Gamble dated August 27th,1883,and recorded in
the Recorder's Office of said Washington County,in Deed Book
Volume 5 "Y",page 561.
UPON which two pieces or parcels of land hereinabove
described is erected a two (2)story frame building with brick
front,used as storeroom and apartment;also a three (3)stall
tile garage..
BEING the same premises conveyed to Arthur ~ij.Frye
and Mary C.Frye,as joint tenants with the right of survivor-
ship,by deed of Scudder Hart Darragh,et ux.,dated January
3,1955,and of record in the Office of the Recorder of Deeds
in and for Washington County,pennsylvania,in Deed Book Volume
919,page 257.The said Mary C.Frye died on or about January
17,1966,whereby title vested in the survivor,Arthur W.Frye.
3.That the decedent was also seized of the following
real estate as set forth in the inventory:
Lots Numbered 35,36,and 37 in the Corrin Plan of the
Second Ward of the City of Monongahela,Washington County,Penn-
sylvania.See Deed Book Volume 1005,page 636.
This parcel was sold for the sum of $3,000.00.

One-third (1/3)of property located at 900 Chess Street
in the City of Monongahela,Washington County,Pennsylvania.
See Deed Book Volume 666,page 452.This parcel was sold for
the sum of $4,000.00.
4.That the said Arthur lip.Frye died testate on or
about February 14,1969,and in and under his Last Will and Testa
ment dated August 29,1961,and of record in the Office of the
Register of Wills in and for Washington County,pennsylvania,in
Will Book 107,page 394,bequeathed and devised all his property,
real,personal and mixed,wheresoever situate,to his b~others,
Joseph Frye and James Frye,and to his sisters,Mary C.Frye,
Marjorie R.Frye and Isabelle M.Frye,all of the City of
Monongahela,Washington County,Pennsylvania,and Ann C.Barker
and Margaret Monahan,both of Pittsburgh,Allegheny County,
Pennsylvania,their heirs and assigns,in equal shares.The
said Mary C.Frye died on or about January 17,1966,whereby her
interest lapsed.A copy of said will is hereto attached and
marked Exhibit "A".
5.That the said Joseph J.Frye,Administrator c.t.a ,
desires to sell,and has entered into an Agreement for the Sale
of Real Estate.described in Paragraph "Two"herein,a copy of
which is hereto attached and marked Exhibit "B",with Clayton E.
Culbertson,Monongahela,Washington County,Pennsylvania,in
consideration of the sum of Twelve Thousand Seven Hundred Fifty
($12,750.00)Dollars.
6.Attached hereto and made a part hereof and marked
Exhibit "C"and Exhibit "0"are affidavits of two responsible
persons familiar with real estate values as to the fair market
value of the property to be sold.
7.The personal property in said estate carried an
inventory~lue of $41,206.34,which consisted of Series E Bonds,
postal Savings Bond,Corporate Shares,and cash.
8.The Administrator c.t.a.at the time that letters
were granted on March 3,1969,filed a bond in the amount of
Five Thousand and no/IOO ($5,000.00)Dollars and the United State
Fidelity and Guaranty Company of Baltimore,Maryland,is the
surety on said bond.Additional bonds have been filed in the
amount of Ten Thousand and No/IOO ($10,000.00)Dollars.
9.Attached hereto and made a part hereof and marked
EXhibit "E"is a Certificate from the County Commissioners of
Washington County,Pennsylvania,showing the assessed value of
the above described premises to be Six Thousand and No/IOO
($6,000.00)Dollars.
WHEREFORE,Your Petitioner prays your Honorable Court
that he be authorized to sell the said premises as provided for
by §541 of the Fiduciaries Act of 1949,P.L.512,and a bond
be set.
