Act 1949,this Court at the above number decreed on l@ay 26th,1969,that the interest of Charles
Musial,specific devisee of real estate,was forfeited b.Y his failure to pay the charge imposed on
said real estate during his lifetime,and approved a private sale of real estate by the Executor.

PETITION FOR PRIVATE SALE OF REAL ESTATE UNDER
SEC/rION 2.!t.LOF THE FIDUCIARIE~ACT OF 1949
The Petition of Joseph Musial respectfully represents that:
1.Agatha Musial,also known as Aggie Musa,died testate March 31st,
1954.Letters Testamentary were granted to Petitioner and the Will was pro-
bated by the Register of Wills of 'Washington County in Will Book 107,page
;7/'1 ,on February 27th,1969.A copy of said Will is attached hereto,
marked Exhibit A.
2.Your Petitioner files this Petition for Private Sale of Real
Estate because decedent's Will specificallY devises a parcel of real estate to
a son,Charles Musial,subject to his payment of charges of $100.00 to each of
his six brothers and sisters.'This parcel is the sole asset of the estate.
The said Charles Musial died intestate September 27th,1959,without having
taken title,and without having paid the charges.No action was taken to
settle decedent's estate immediately after her death because of an agreement
among the heirs of the decedent that members of the family might live in the
house located on the said parcel of real estate.The probate of the V{ill
described in paragraph 1 above,some 15 years after the death of the decedent,
is the first action taken to settle the estate.
Your Petitioner deems it advisable that the sale proposed in this
Petition have the effect of a judicial sale because the specific devisee has
forfeited his right to the property by reason of non payment of the charge on
the real estate and because of the length of time ensuing since decedent's
death in which some of decedent's children have died leaving issue.Another
reason for the sale is that the decedent's Will contains no residuary clause,
and the real estate,which is the subject of this Petition to Sell,descends
as intestate property,after forfeiture by the named devisee for non payment
of the charge against it.
3.Assuming the forfeit.ure for failure to pay the charges against
the property,and the descent of this property as intestate property because
of no residuary clause in the Will,the names of the parties in interest and
their respective interests at the time of death"and the devolution of those
interests since decedent's death are as follows:

4.Decedent owned only the follovnng parcel of real estate at the time
of her death:
ALL that certain parcel of land situate in the Borough of Donora,
Washington County,Pennsylvania,being Part of Lot No.65,in
Block No.24,lying between Allen Avenue and Wood Street,fronting
on Sixth Street 40.23 feet,and running back 93.39 feet on the
Easterly side,and 97.71 feet on the Westerly side,and having a
rear of 40 feet.
BEUrJ the same premises conveyed to Aggie Musa by Deed of Jacob
Kszezak,et ux.,dated December 19th,1908,and recorded in Wash-
ington County Deed Book,Vol.357,at page 229.
There is erected thereon a two story frame dwelling house of 5
rooms,known as No.471 5ixth Street,Donora,Pa.
5.There is attached hereto,marked Exhibit B,an official certificate
of assessed valuation of the property proposed to be sold.Also attached is
a.copy of the Inventory as officially filed,marked Exhibit C.
6.Petitioner knows of no outstanding debts of decedent,and the only
lien of record is that of the charge mentioned in the Will and descnbed in
paragraph 2 hereof.
7.Petitioner has entered into an:Agreement of Sale with John P.
Marconyak and Vivian K.Marconyak,his wife,of Hillcrest Manor,R.D.#1,
Monongahela,Pennsylvania,for the private sale of the real estate hereinbefore
described,for the sum of $5,500.00 in cash,subject to the approval of your
Honorable Court;the original of said Agreement of Sale containing the detailed
terms is attached hereto,marked Exhibit D.
8.Petitioner believes that $5,500.00 is a full and fair price for
sa.id premises,and a better price than can be obtained at a public sale.The
affidavits by two competent persons required by law and Rules of Court are
attached hereto as Exhibits E and F.
WHEREFORE,your Petitioner prays your Honorable Court,under Section
543 of the Fiduciaries Act of 1949,for authority to make private sale of the
aforesaid premises.

with at the expense of the Seller.

1.That under date of April 28th,1969,he presented to your
Honorable Court at the above number a Petition for Private Sale of Real Estate,
the said real estate being part of Lot No.65,in Block No.24,in the Borough
of Donora,Washington County,Pennsylvania.
2.Your Honorable Court,on said date,fixed Monday,May 26th,1969,
at 11:00 0 'clock,A.M.,E.D.S.T.,in the Orphans I Court Room at the Washington
County Court House as the time and place for hearing on the Petition and the
consideration of the confirmation of the proposed sale of real estate,and
directed that notice of the said hearing be given by publication in accordance
with the requirements of the Rules of Court.
3.Your Petitioner caused notice,in accordance with the Rules of
Court,to be pUblished in The Daily RepUblican,a newspaper of genera.l circula-
tion,and in the Washington County Reports,the first of said publications
appearing more than twenty-one days prior to the date fixed for hearing.The
proofs of publication are attached hereto and made a part hereof,marked

4.In accordance with the Rules of Court,your Petitioner caused
written notice to be given by posting five handbills,one of which was posted
in a conspicuous place on the real estate proposed to be sold,and the others
