1.Ora I.Ferrell is an individual who is a resi-
dent of Donegal Township,Washington County,Pennsylvania,who is
hereinafter c~lled the alleged incompetent•
.2.You~petitioner is a first cousin,once removed
of the said Ora I.Ferrell.
3.The .alleged incompetent was born in the year

1892 and is now 76 years of age.
4.The.alleged incompetent is presently a patient
at the Eckhart Rest Home,The Meadows,Donegal Township,
Washington County,Pennsylvania.
5.The names and addresses of the next of kin of
the alleged incompetent who would be entitled to share in her
estate should she now died intestate are:

6.The :alleged incompetent is the owner of real
estate located in Donegal Township,Washington County,Pennsylvan a
which hasan'estimated-gross value of $5,000.00.

7.The alleged incompetent has a monthly income

of approximately $70'.00,from Social Security ($51.00),a pension
paid by the church where her deceased husband served as a
minister ($15.00),and income from a gas lease ($13.25 per
quarter).
8.Theall~ged incompetent was not a member of the
Armed Services of th~United States and is not receiving benefits
from the Unites States Veterans Administration.
9.The alleged incompetent is,because of the
mental infirmities of old age,unable to manage her property and
is liable to dissipate it and become the victim of designing
persons.
10.Your petitioner is willing to aetas guardian
of the Estate of the alleged incompetent if none of the heirs
at law of the alleged incompetent mentioned above wish to do so.
Your petitioner has asked some of them who are locally resident
if they wish to serve iIi such a capacity and has received a
-negative response.
11.The proposed guardian has no interest adverse
to the alleged incompetent.
12.No other Court has 'ever assumed jurisdiction
in any proceeding to determine the competency of the alleged
incompetent.
13.No other,guardian has been appointed for the
Estate of the alleged incompetent.
WHEREFORE,your petitioner prays your Honorable Court
that your Honorable Court award,pursuant to Section 301 of·the
Incompetents'Estates Act of 1955,P.L.ll54,as amended,50 P.S.
3301,a citation directed to the alleged incompetent,with notice
by registered mail to the next of kin mentioned in the foregoing
petition,to show cause why she should not adjudged an incompetent
and a guardian of her Estate appointed.

~nd respectfully represents and sets forth as follows:
1.Your petitioner is guardian of the estate of
bra 1.Ferrell,an incompetent,having been appo;;i;:n·.ted to that
~osition by your Honorable Court on March 20,1969.
2.As required by your Honorable Court,your
i)etitioner has filed a bond in the amount of'$500.00.:
3.Your petitioner has file<i ,an inventory of
he property in the estate of Ora.I.Ferrell.A true and correct
t-opy of the said inventory is attached hereto,marked Exhibit
'A",and made a part hereof.
4.Your petitioner believes it desirable to
~ell the real estate owned by the incompetent for these reasons:
(a)The incompetent is in poor health and
s a patient in a nursing home.Her physical and mental condition
s such that she is unable to take care of herself.
(b)The incompetent has no personal property
)f any significant value with which to pay the proprietors of the
lursing home in which she is presently located or in any other
~ursing home.
(c)The incompetent is presently being main-
ained by an emergency grant from the Department of Public Welfare
but the grant is subject to the stipulation by the Department of
Public Welfare that the decedent's real estate shall be sold as
soon as possible at a reasonable price.
5.Your petitioner has made an agreement to sell
the said real estate at private sale to Matthew J.Turk,Sr.,(but
understands that the said Matthew J.Turk,Sr.intends to assign
his rights to his sons,Matthew J.Turk,Jr.and James F.Turk,
as joint tenants with right of survivorship).He has entered into
a written agreement in this connection,a copy of which is hereto
attached,marked Exhibit "B",and made a part hereof.
6.Your petitioner and the realtor engaged by
him exposed the said real estate to sale for a period of approximately
two months prior to entering into the said agreement of sale.You

petition~r is satisfied,on the basis of his experience in making

this attempt to sell that the price of $8500.00 is the best price
which he will be able to secure for the said property and a greate
price than can be obtained at a public sale.
7.Your petitioner believes and therefore alleges
that it is in the best interests of the incompetent that the
prbposed private sale take place.
8.There is attached herto,marked Exhibit,"C"/.
and made a part hereof,an official certificate of the assessed
valuation of the'property which it is proposed be sold.
9.There is attached hereto,marked Exhibit liD",
and made a part hereof,the aff~davit of two competent persons
setting forth that they have inspected the real estate proposed
to be sold and that the price to be paid at the proposed private

sale is greater than can be obtained at a public sale.
WHEREFORE,your petitioner prays your Honorable Court

WHEREAS,the Assignor desires to transfer and assign his
rights under the said agreement to the Assignees,who are his sons,
as joint tenants with right of survivorship I and~not as tenants in
common,without any consideration being paid for the transfer,
NOW,THEREFORE,it is hereby mutually covenanted and agreed,
as follows:
1.That all rights,titles,estates,and interests in
real estate which accrue to the Assignors by reason of the agreemen
of May 13,1969 attached hereto are hereby transferred,set over,
conveyed,and assigned to the Assignees,
2.This assignment is made without consideration but
the Assignor agrees to be legally bound hereby.
3.The Assignees shall and hereby do undertake all
liabilities to the seller set forth and defined by the said agree~
ment of May 13,1969.
4.,The rights of the Assignees shall be the rights of
joint tenants with right of survivorship and not of tenants in comm n.
