Decedent, aresident of Donora, died January 6,1969.He had been twice married.Seven children by his first marriage survived,as well as his widow,Anna Sewak, who was named administratrix of the estate. ,. His personalty was appraised at $1032 and his real property at $1425 or a total of $2457.The real estate consisted of a one-half inte:-est in the ho:ne residence of decedent and his wife in Donora. The remaininlJ one- half interest was awned by the wife 2.S the result of a conveyance from decede t a few years prior to death. Exceptions have been filed by the said children to several matters. It is claimed that Helen Vagnoni is entitled to the death benefit of the Greek Catholic Unbn of the U.S.A.,payable to decedent's naoed benefi·::;iary.Both the original Benefit Certificate and the document titled IIDesignation of Death Benefitll indicate conclusively that the death ben3fit of $1000 was to be paid IIFor Funeral Expensell with the added stipulation that ·'Mrs.Helen Wagnoni (Daughter)to arrange the funeraill •The check in paym nt .~ cf the death benefit wss made payable to "Macik Funem 1 Home and Helen Wagnoli -daughterII .There was some dispute about the type of funersl crderec.,as well as the cost,it being indicated that the widow preferred a more costly funeral. But nobody protested the use of the Mscik Funersl Home ·)r the cost of the type of funeral ordered.(See Accountant's Extibits t;,5 and 6).The court feels that the ccst was reasonable and within proper bounds for a person of decedent's means.}.lIrs.Vagnoni was not the n3.med beneficiary at any time;she was entitled only to make the arrangemecs for the fur..eral.She went with the others to the funeral home to make the selectio of the items involved. When asked by'counsel if she did not:..mke the sElection she answered (T.-p.12):IIWe all selected.NO~only myself;we all se~ectet II All the children and tte widow were present at the tiDe.We can see n.J legitimate reason for complaint. Exception is taken to the payrr:..ent of a bill for flowers or·jered by the widow and sent with a card bearing the inscription IIFrom wife,Anna Sewakll •Although aceountant cites cases where an a~lowance for flOWErS -Jilas rr:..ade,none appr'Jach the facts cited here.We feel that this expelLse was a perEonal one to be charged to the widow. This exception is therefore ,:iUstained. Excepticn is taken to the cost of the funeral dinner held in the ~hurch hall at a cost of $125.82 for about 70 guests. The dinner included table liquors, but the amount spent for liquo~is not given or estimated a:1d w;:::;. assume that it was probably very small when the per capita cost of the entire dinLer was less than $2.00 and we are not cer:ain who furnished the liiquor. It seems that a funeral dinner is common among the menbers of this religious 9TOUP,but it is generally held in decedent's home. However the heme here was very small and cou~d not accommodate the many gll::ests -2- com:o:,tably. The only alternative was to hcld it in the church hall.We feel that this was a proper function under the circumstances in this case. The cost was reasonable, and should be allowed. The exception is dismissed.j The final objection is to the manner in which tte administratrix II has -.a~{en her family exemption of $1000 out of the decedent's one-half interes In the real estate. There is no dispute about her entitlement to this sum; only the manner in which it was taken is under attack. The widow simply used be official appraisement for inheritan·:::e tax purposes as the measureme t of the true value of the real estate. The relevant provision of the Fiduciaries Act does not sanction this proeedure, except perhaps where all interested parties are in agreement. The Act requires the appointment of appraisers by> the coart even where a fractional interest is involved,as it is here. This objection must be sustair:.ed.The administratrix is ordered to proceed in accordance with the provisions of the Fiduciaries Act, petition for the appointment of appraisers and, after appraisement, the court may determine whether this reai estate may be set aside to her as her famiiy I allowance, and the terms upon which she m3.Y acquire it.Ij ~~ Ii II :'1 ----:~~~~+-M"L..#__.lE::::~~'-"C.4---.....:'l 1] .~ 1'IlIlII I -3- IN THE COURT OF COMMON PLEAS OF Wl\SHINGTON COUNTY,.r''c;NNA.
