PETITION FOR SETTLEMENT OF
AN ESTATE OF LESS THAN $22 50-0.00
TO THE HONORABLE P.V.MARINO,PRESIDENT JUDGE OF SAID COURT:
The petition of CHRISTINE A.JANTOSIK respectfully
represents:
1.The decedent,Sophie Misko,died on January 30,
1968,a resident of the Borough of Bentleyville,Washington
County,Pennsylvania.
2.The decedent left as her entire estate for admin-
istration purposes cash in the·amount of One Thousand Seven
Hundred Fifty-nine and 91/100 ($1,759.91)Dollars.
3.The decedent left a Last Will and Testament dated
August 25,1954,which has not been probated,but which is
attached to this petition as an exhibit.By virtue of this Will,
the residuary legatees would be entitled to equal shares of the
aforesaid amount,after payment of the estate creditors,herein-
after set iorth,subject,however,to the charge placed on the
share of Mary J.Marcoux in the amount of Two Thousand Three
Hundred and No/IOO ($2,300.00)Dollars which she owed to the
decedent at the time of her death.
4.Those named in the Will as the residuary legatees
who are also all of the heirs and next-of-kin of the decedent are:

5.Inasmuch as the share of Mary J.Marcoux in and
to the residue of the estate would be less than the amount which
she owed to the decedent at the time of decedent's death,the
said Mary J.Marcoux 'has waived any claim in the residue on
account of said debt.
6.Distribution of the net balance of the estate
should be made subject to the payment of the following creditors
from the aforesaid sum of $1,759.91:

In addition the cost of filing this petition,
Pennsylvania inheritance tax and counsel fees for the estate
will have to be paid from said amount.
WHEREFORE,your petitioner prays that your Hono~-
able Court award and set aside the net balance of cash in
the estate,after payment of the aforesaid creditors,filing
.~osts,Pennsylvania inheritance tax and counsel fees,in
equal shares to the following of the above named residuary
legatees,r~&~ely,Fred F.'Misko,Victor J.Misko,Sophie R.
Piatt and.Christine A.Jantosik,in accordance with the Will of

I,MARY J.MARCOUX,one of the residuary legatees named
in.the Will of Sophie Misko,deceased,dated August 25,1954,do
hereby join in this Petition and consent to the provisions thereof
and the request for distribution,and,I do further waive any
claim whatsoever in and to the residue of said estate.

I,SOPHIE MISKO,a resident ot Bentleyville,Washington
County,Pennsylvania,do hereby make my last will and testament,
and revoke all wills by me at any time heretotore made~
FIRST:I direot that all my just debts and tuneral
expenses be paid.
SEOOND:All;the rest,~residue,and remainder of my estate,
real,personal or miXed,whatsoever and wheresoever situate at
the time of my deoease,I give,devise and bequeath to my chil-
dren,FRED F.MISKO,MARY J.MARCOUX,VICTOR J.MIS~O,SOPHIE H.
PIATT and CHRISTINE A.JANTOSIK,in equal proportions,ahare and
share alike;provided,however,that there be ~ithheld from the
share ot Mary J.Marcoux the sum of Twenty-three Hundred ($2300.0D)
Dollars wh1eh she has borrowed from me and whioh she owes me at
this time.No interest shall be oharged against her on this debt
but ~he d.ebt shall be deducted from her share of my estate.
THIRD:I nominate,constitute and appoint CHRISTINE A.
