taries,Attorneys-in-Fact,and Agents to act for and on behalf of the Company and may give any such appointee such authority as his certificate of authority

The petition of Pittsburgh National Bank respectfull
represents:
1.That your petitioner was appointed guardaan of
the Estate of J.D.lams,Jr.,an incompetent,by Decree of Your
Honorable Court dated November 15,1968,at No.1288 of 1968.
2.That among the assets of the incompetent's estat
which came into the possession of your petitioner was a Judgment
entered by the incompetent against Velma Clutter in the Court of
Common Pleas of Washington County,Pennsylvania,at No.223
September Term,1964 D.S.B.in the amount of $704.021'the balance
due thereon as of October 25,1969 amounted to $926.27.
3.The decedent,Velma Clutter,died subsequent to
the appointment of your petitioner as guardian and notice of the
guardian's claim was.given to the Administrator of the estate of
Velma Clutter,copies of said notices being attached hereto and
made a part hereof.
5.That your petitioner,after the audit of said
Account,discovered the fact that said Account had been filed and
in examining said Account ascertained that the Administrator of
said Estate had paid general creditors a total amount of $259.87
and that the estate is insolvent and unable to pay petitioner's
claim in full.
6.Petitioner avers that the payment of said
general claims by the Administrator was improper and petitioner
desires to file Exceptions to payrnentof said claims which are as
follows:

If the Court please,in the estat e of Velma

Clutter,deceased,I represent Pittsbuggh National Bank,Guardian 0
theestate of J.D.lams,an incompetent who has since passed away.
We have a claim against the estate of Velma .Clutter represented by
judgment note,which amounts to,with interest as of October 1,to
$926.27.There is I}o provision made for payment to the guardian.

~Mlthe account shows that the Accountant in th is case paid other
general creditors in full.And we filed a Petition for leave to open,.
the audit and allow <?ur claim to be presented and proven.I believe
Mr.Hart admits our claim.I will let him speak for himself.
THE COURT:Mr.SiegeH is tha t the claim that is set forth
in the Audit Petition at Number 223 September Term,1964D.S.B.in

puted.Isn't that correct?

MR.SIEGEL:

That is correct.

That's what the Audit Petition says,the claim
is not disputed.So what complaint dlo you have then?
MR.SIEGEL:Our complaint,Your Honor,is that there is
only $74.00 for distribution,whereas,several hundred dollars
in claim s has been paid,general claims,which is on the same footi g
as our claim have been paid.Therefore,we feel that the accountant
should be surcharged by the amount necessary to pay us the prorata
share of our claim.

MR.HART:
Mr.Hart,how do you feel about this matter?
If the'CauH please,I have prepared and I am g)ing
to submit to you a calculation.To start it out with the amount of
Inventory and Appraisement then I added up the preferred claims in

the"estate,like burial and Orphans'Court and soforth,totalling
$1219.10,leaves a balance in the estate of $424.90.Then I had
at the end,general claims,.sr.Badiali,$184.00,and this lams
claim that Mr.Siegel is talking am ut,I put it in at his figures at
$926.27.And I figured for thise unpaid claims,the balance in the
account,there's a balance after the payment of preferred claims,w<uld.,.-
mean that each claim would receive 38%of its amount.And I figured
those down there,listed them and Badiali would be $29.92 and this
lam's would be~$351.98.I submitted this to Mr.Siegel and he told
me he showed it to th.e bank and they agreed on the amounts.What WE
want is an Audit De'cree directing~the Administrator to pay the costs
of audit and the $29.92 and $351.98 to thos e claims so that we can pay
them and getthe thing satisfied.

Do you have the money?
Well,we'll get it.We'll get some of it in the
bank and we'1l-5~-the Administrator paid these general claims before
lje knewl about this claim that Mr.Siegel represents.And we will ha'e

to dig up the money.He's got some in the bank but I-he'll have to dig
up some more.He's under bond,of COUrse.

account you find that there were about 12 or 14 general claims paid?

Mr.Hart,in his paper that he handed up to th
Court,has eliminated the general claims from the;estate.
MR.HART:You see,the reason those store claims were
paid,we thought that,Mrs.lrlutter,thedecedent,operated a little
meat shop in her home.and we figured that on the Petition we prese ted
for Audit that they were charges on what she paid for the store.Now
that's why he paid them in full.This Administrator sort of handled tllis
thing himself.He jjl:st k~pt paying claims and I didn't know about wha
he paid until it came time to file the account and he brought me a lisl
of it.But the point is,the only two claims that are not settled are
these two that we have in that paper I gave you there with the figures on'
