SECOND:All the rest,residue and remainder of my estate,real and personal,I give,devise and bequeath to Pittsburgh National Bank, IN TRUST,nevertheless,for the following uses and purposes: To pay to my wife,Sophia Pastor,for the benefit of herself and our daughter,Agnes Ann Pastor,the income therefrom and so much of the principal thereof as is necessary for their maintenance,not to exceed in the aggregate $1,200.00 per year,until such time as my daughter,Agnes Ann Pastor, reaches the age of 18 years,at which time any principal re- maining shall be payable to my wife,Sophia Pastor,if living, and if not to my two daughters,Agnes Ann Pastor and Josephine P.Stacko,share and share alike. THIRD:I hereby authorize,direct and empower my Executor, hereinafter named,to sell,either at private or public sale and without leave of Court,any real estate of which I may die seized. The partners shared the 2.During the operation of the said farm the partner- ship accumulated certain sums of money which were on deposit in the " Mellon'National Bank and Trust Company,Burgettstown office~ 3~During the period of ,the partnership the deceased, Gus Pastor,loaned partnership funds to his son-in~law,William Stacko,with ~he promise that he,as manager of the partnership, would be responsible for the funds being restored to the partner- ship's account.Pursuant to this arrangement $6,000.00 of partner ship money was advanced to t,he 'said',William Stacko.The deceased did not cause the said $6,000.00 to be restored to the partnership funds.Goldie Pastor therefore makes claim for $3,000.00 against the Estate of Gus ,Pastor •• 4.During the continuation of the partnership payment were made from partnership funds by the deceased,Gus Pastor,to the Farm Credit Administration on behalf of the said William Stack • The said Gus Pastor,as manager of the partnership,promised that he would be personally responsible for the restoration of the said funds to the partnership account.The claimant does not have a record of the amount so advanced because the information on which to make a calculation is in the possession of the attorney for the personal representatives of the Estate of Gus Pastor. that the sum involved is in the vicinity of $2,000.00. :She believe She makes claim,therefore,for an accounting by the personal representative of the money spent by Gus Pastor on behalf of the said William Stacko as advanced to the Farm Credit Administration and makes cIa m for one-half thereof of the amount not restored to the partnership account by the decedent in accordance with his promise set forth above.
