LAST WILL AND TESTAMENT
I,GUS PASTOR,of Jefferson Township,Washington County,Pennsy-
lvania,do hereby make my Last Will and Testament,and revoke all
Wills by me at any time heretofore made.
FIRST:I direct that a3;l my just debts and funeral expenses
shall be paid from the assets of my estate as soon as practicable after
my decease.
SECOND:All the rest,residue and remainder of my estate,real
and personal,I give,devise and bequeath to Pittsburgh National Bank,
IN TRUST,nevertheless,for the following uses and purposes:
To pay to my wife,Sophia Pastor,for the benefit of
herself and our daughter,Agnes Ann Pastor,the income
therefrom and so much of the principal thereof as is necessary
for their maintenance,not to exceed in the aggregate $1,200.00
per year,until such time as my daughter,Agnes Ann Pastor,
reaches the age of 18 years,at which time any principal re-
maining shall be payable to my wife,Sophia Pastor,if living,
and if not to my two daughters,Agnes Ann Pastor and Josephine
P.Stacko,share and share alike.
THIRD:I hereby authorize,direct and empower my Executor,
hereinafter named,to sell,either at private or public sale and without
leave of Court,any real estate of which I may die seized.
FOURTH:I appoint Pittsburgh National Bank Executor of this
my last Will.
IN WITNESS WHEREOF,I have hereunto set my hand this 16 day
of March,1962.

Esquire,objects to the account filed by August W.Pastor and
Robert E.Anderson,Administrators c.t.a.of said Estate for the
following reasons:
1.Accountants have failed to account for rents
received from Frank Dale Pastor for the rental of the farm,
cattle and machinery at the rate of $100.00 per month from May~
1966 to the date when said farm was purchased by the said Frank
Dale Pastor.
2.The Accountants have failed to account for milk
checks and other income from the farm received from the day of
decedent's death on December 12,1965 until the farm,cattle and
machinery were rented to Frank Dale Pastor in May,1966.
3.The Exceptant objects to the payment by the
Accountants on June 18,1968 of the sum of $350.00 to Emilie
Pastor on account of an alleged Note when the said Emilie Pastor
was indebted to the Estate by reason of her failure to account
for the income from the farm from the date of decedent's death
to the date of sale of the farm,etc.to Frank Dale Pastor in
May,1966.

AND NOW,comes GOLDIE PASTOR,by her attorneys,PATRONO,
CEISLER AND EDWARDS,Esquires,and makes claim in the Estate of
Gus Pastor,above captioned,as follows:
1.For many years Goldie Pastor was a partner with
the decedent,Gus Pastor,in the operation of a farm located at
R.D.#2,Avella,Pennsylvania,in Jefferson Township,Washington
County,Pennsylvania.The decedent,Gus Pastor,managed personally
all the finances of the partnership.

would be responsible for the funds being restored to the partner-
ship's account.Pursuant to this arrangement $6,000.00 of partner
ship money was advanced to t,he 'said',William Stacko.The deceased
did not cause the said $6,000.00 to be restored to the partnership
funds.Goldie Pastor therefore makes claim for $3,000.00 against
the Estate of Gus ,Pastor ••
4.During the continuation of the partnership payment
were made from partnership funds by the deceased,Gus Pastor,to
the Farm Credit Administration on behalf of the said William Stack •
The said Gus Pastor,as manager of the partnership,promised that
he would be personally responsible for the restoration of the said
funds to the partnership account.The claimant does not have a
record of the amount so advanced because the information on which
to make a calculation is in the possession of the attorney for the
personal representatives of the Estate of Gus Pastor.

5.Gus Pastor was manager of the partnership and kept
all of its accounts.During all the years of the existence of the
partnership the claimant received $20.00 every two weeks and no
more.The claimant does not have a record of the partnership

accounts and believes that they are in the hands either of the

deceased.She had reason to believe and therefore does believe
that the par~ne~s~ipJhad earnings in excess of $1,020.00 a year.,.;

PATRONO,CEISLER AND BDWARDS,Esquires,and takes exceptions to
the account of ,the personal representatives in this estate,as
follows:
1.The said personal representatives did not show in
their account the amounts due to Goldie Pastor as a result of the
failure of William Stacko to reimburse to the partnership composed
of Goldie Pastor and the deceased,Gus Pastor,the sum of $6,000.00
advanced by the partnership to the said William Stacko and the sums
the amount of which is unknown to the claimant,advanced to the
said William Stacko in order to make payments to the Farm Credit
Administration,which the deceased,Gus Pastor,promised to recover
and to restore to the pattnership account.
2.The account does not payor make provision for the
payment of the claim of Goldie Pastor hereinabove set forth.
3.The accountants have,although the information with
which to do so is in their hands,made no accounting of the affairs
of the partnership consisting of Gus Pastor and Goldie Pastor sub-
sisting on the day of the decedent's death and of the deceased's
obligations to the said partnership and to Goldie Pastor surviving
partner therein for the amount by which the partnership earnings
exceeded the amount paid to her.

WHEREAS,August W.Pastor and Robert E.Anderson,Adminis-
trators C.T.A.of the Estate of Gus Pastor,deceased,filed a
First &Final Account at the above number;and
WHEREAS,certain exceptions thereto ,were taken on behalf of ,
Sophie Pastor,widow of the decedent;and
WHEREAS,a claim was filed on behalf of Goldie Pastor,

alleging a partnership between her and the decedent in the opera-I

tion of a farm located at R.D.#2,Avella,Pa.;and
WHEREAS,after testimony having been taken in the proceedings
on the claim of Goldie Pastor,the Court,with the consent of
counsel,indicated that no additional testimony would be taken,
but that since it was admitted that a partnership did exist be-
tween Goldie Pastor and Gus Pastor,the decedent,the claimant
should seek whatever remedies available to her in the Equity
Division of the civil side of the Court of Common Pleas of Wash-
ington County,and that the Audit in the estate of the decedent
should be continued until such time as this action be instituted
and decided;and
WHEREAS,shortly thereafter an action was instituted by
Goldie Pastor against August W.Pastor and Robert E.Anderson,
Administrators C.T.A.of the Estate of Gus Pastor,deceased,at
No.6564 In Equity;and
WHEREAS,a hearing was scheduled to be held in said action

on April 15,1971,at which time,all interested parties being
present,an agreement was reached relative not only to the claim
of Goldie Pastor,but also to certain claims which the Estate of
Gus Pastor had against Frank Dale Pastor,a son of said Goldie
Pastor;it being stipulated and agreed,as follows:
1.That the claim of Goldie Pastor against the Estate of
Gus Pastor would be admitted in the amount of Four Thousand One
Hundred Dollars ($4,100.00),and this amount would be paid to
said Goldie Pastor,or her attorney,in full settlement and re-
lease of any and all claims she may have against said Estate.
2.That the claim of the Estate of Gus Pastor against
Frank Dale Pastor in the amount of $1,997.50 would be compro-
mised by agreement of the parties in the amount of One Thousand
Dollars ($1,000.00),which amount would be deducted from the
above payment to be made to Goldie Pastor,making a net payment
to her of $3,100.00.
3.That Sophie Pastor,the widow of Gus Pastor,being
present during the negotiations and agreements,would consent to
the aforesaid stipulations and agreements,and would agree to be
bound by Same and to receive whatever proceeds remain in the
Estate of Gus Pastor,deceased,according to his Will.
4.That the proceedings at No.6564 In Equity,would be
settled and discontinued on the record,and the Administrators
C.T.A.of the Estate of Gus Pastor,deceased,would proceed
promptly to complete the filing of the Audit Petition,and make
distribution as soon as the Adjudication and Decree of the Court
is handed down.

DETERMINATION OF CLAIMS AFTER AUDIT
TO THE HONORABLE,THE JUDGES OF SAID COURT:
On March 18,1969,the Audit in the Estate of Gus Pastor,
deceased,was held,and,subject to determination of certain un-
known claims,the Audit was closed.
Since the aforesaid date of the Audit,certain testimony has
been taken in this Court,and in a proceedings filed by Goldie
Pastor at No.6564 In Equity.
By Stipulation filed,the said equity case was settled and
discontinued,a copy of said Stipulation being attached hereto
and made a part hereof.The net effect of this Stipulation is
to dismiss the claim of Frank Dale Pastor,and to request Your
Honorable Court to award to Goldie Pastor the sum of $3,100.00.
The claim of Emilie Pastor in the amount of $1,250.00 is
admitted;$350.00 has been paid on account of said claim,leaving II
a balance of $900.00 due said Emilie Pastor,and Your Honorable I
Court is requested to award to Emilie Pastor said balance due her.i
.At the time of the Audit,it was agreed that Sophie Pastor,
widow of the decedent,should receive the Family Exemption of
$1,000.00,and same has been paid.

1945,and was,therefor~"mor~than 18 years of age at time of testator's death
on Dec.12,1965,thus,obviating the necessity for Pittsburgh National Bank to
serve as Trustee,as provided under paragraph "SECOND"of decedent ',s Will;
and the entire estate of decedent became vested in Sophia Pas~or,wife,who
survived testator,and is still living.
Further,Pittsburgh National Bank renounced its right to act as Executor,
and August W.Pastor and Robert E.Anderson were appointed Administrators C.T.A.
of decedent's estate.'

He was supposed to get a manager's fee to be fixed by the parties.
But so far as I know,it was never fixed.They just had to struggle

Gus,stayed on the farm clear up until his death,worked there with
them,and my impression is that she was to get $1250,OOt.,from:
each partner.
From the time ,~hat Frank P~.stor died until the
day tOlt'"Gus Pastor's death,they worked like slaves.Gus raised
two daughters,Goldie two sons.And there was never any extra
money.The partnership lasted for 21 years.Gus's older daughter

Josephine,,married a William Stacko,and he began to borrow mone

"from them'and that worried Gus;at the 'time o'fhi~death he was so
upset that he was afraid that it was going to pull them under.They,..,
weren't making payments'''on their-~ortgage,which he had guaran-
teed.He was making payment tp keep {rom foreclosure of his
interest in the farm.
Fortunately,he t<;>ok out insurance,and when he
died that relieved his estate from any problems.But it didn't relie e
the partnership from certain obligations.Of course,William
Stacko being married to Josephine,the daughter of Sophie Pastor,
Gus's widow,she has never seen fit to press this claim against the

Stackos.But there is the possibility of that claim.'Now Goldie
Pastor feels that some of the payments were made fro'm partnership
property;that therefore,she is entitled to recover one-half of
the money owed by William Stacko and his wife.And it is possible
that Goldie Pastor,as surviving pa~tner,has a right of action again t
William Stacko and Josephine Stacko and I understand that she may be
representedby Robert L.Ceisler,Esquire,who called me concerni g
the claim.And nothing that I know of has be~n done.
Sophie Pastor has made various concessions
to Frank.Dale Pastor.He is the son of Golqie"aritl.:is the after-borr
child of Frank.Pastor.And he bought her half interest .in the prop el ty .
w:ithout me knowiIl;g it,she reduced the sale price of her one-half
interest in the farm from $10,000 to $7,500 because he could not
get a loan from some Government administration and she had to rna e
certain concessions..,'.
