for Taxation,for Howard A.Cohen,Secretary of Revenue,who avers:
1.That Samuel Wheeler,deceased,(hereinafter referred to as
"the Decedent")died on August 12,1961.
2.That A Petition for Probate of the Last Will and Testament
and for Granting of Letters Testamentary was made by Pittsburgh National
Bank and Novella Henderson,Co-Executors,(hereinafter referred to as
"the Co-Executors"),on August 22,1961.That Letters Testamentary were
granted to the Co-Executors 9n August 22,1961,as evidenced by the
Register of Wills'Volume 35,Page 91,Line 10.
3.That the Inheritance Tax due in the estate of the

That on November 9,1961,the Co-Executors made a payment on
account of Inheritance Tax due in the Decedent's estate,in the
amount of $8,000.00.An official Tax Receipt was issued to the
Co-Executors by the Register of Wills.
5.That as of the date of this Petition,the balance
of Pennsylvania Inheritance Tax remaining due and unpaid is
$13,981.59,plus interest at the rate of six percent per annum
from August 12,1962,until the date of payment.
6.That on September 22,1980,certified demand letters were
mailed to the Co-Executors outlining the nature and amount of
tax due and consequences if not paid.Receipts were signed and
returned to the County Inheritance Tax Office.Attached hereto
and made a part hereof are copies of said~letters and receipts
marked Exhibit "A."
7.That under Section 821 of the Act of June 15,1961,
P.L.373,Article VIII,(72 P.s.2485-821),the Secretary of Revenue
is authorized to request the Court to issue a Citation directed to
those subject to any duty imposed by the aforesaid Act,commanding
such persons to appear and show cause why the requirements of this
Act should not be met.

WHEREFORE,your Petitioner prays your Honorable Court to
issue a Citation upon the Co-Executors,directing the Co-Executors
to appear and show cause why said Inheritance Tax in the estate of
the Decedent should not be paid as required by law;and to further
direct that the costs of this action shall be borne by the Co-Executors.

Section 701 of the Inheritance and Estate Tax Act of 1961 requires the personal
representative of an estate and/or a transferee to make an inheritance tax return.In addition,
Section 711 states that inheritance tax is due at the date of the decedent's death and shall
become delinquent at the expiration of nine (9)months.
Section 791 of this Act provides that any person who wilfully fails to file a return

PETITION SUR AUDIT
To the Honorable,the President Judge of said Court:
The petition of Pittsburgh National Bank,formerly
Peoples First National Bank and Trust Company,and Novella Hender-
son,executors,respectfully represents:
The testator died August 12,1961.Letters testamen-
tary were granted on his estate on August 23,1961.This is the
Fifth and Final Account filed in this estate.
At the audit of the fourth account and by decree
entered therein on March 27,1969,at term No.114 of 1969,
there was awarded back for further administration certain un-
converted parcels of real estate.
The heirs and legatees and their relationship to the
testator are those contained in item 3,paragraph D,subparagraph
10 of the last will and testament,a copy of which is attached
hereto and marked Exhibit "A."They are Novella Henderson,a
stepdaughter;Sarah Jane Mosley,a sister;Rufus Wheeler,a
nephew;Nannie Anderson,a niece;Lena Williams,a niece;Carrie
Hull,a niece;Maggie Haston,a niece;and the Nazareth Baptist
Church of Washington,Pennsylvania.
Novella Henderson is living and resides at 209 Linn
Avenue in the city of Washington.Sarah Jane Mosley survived the
testator but died on September 26,1972.The heirs of her estate,
to wit,Carrie Hull,Lena Williams,and Rufus Wheeler,assigned
their interests to Nannie W.Anderson.Rufus Wheeler is living
and resides at 256 Linn Avenue,city of Washington;Nannie W.
Anderson is living and resides at 238 Burton Avenue in the city
of Washington;Lena Williams is living and resides at 246 Linn
Avenue in the city of Washington;Carrie Hull survived the de-
cedent but died on November 11,1977.Her estate is represented
by the firm of McCreight,Marriner &Crumrine in the city of
Washington.Maggie Haston survived the decedent but has since
died and Francis Carrie Ross has qualified as administratrix of
her estate and resides at 904 East Summit Street in the city of
Alliance,Ohio.The Nazareth Baptist Church of Washington is in
existence.None of the parties listed are in the military ser-
vice of the United States.
PaYment of any federal estate or Pennsylvania inheritanc
tax was made and fully settled at the audits of the preceding
accounts.There are at this time no unpaid creditors.
During the term of administration as encompassed by this
account the parcels of real estate have been sold and the balance
for distribution is personalty.Additional receipts and disburse-
ments since the filing of the Fifth and Final Account are shown
in a supplemental accounting,which is attached hereto and made

a part hereof.The balance for distribution is shown on page 2
of the supplemental accounting.
In the sale of the real estate items,it is necessary
for your petitioners to take back purchase money mortgages,a
fractional interest in which will pass to each of the named
legatees.Since it will be cumbersome and to a degree a hard-
ship,both to the mortgagors and the mortgagees,to directly
service the mortgage to eight separate individuals or entities,
your petitioners respectfully suggest that responsibility for
the collection and disbursement of the interest and principal be
placed in the hands of the co-executor Pittsburgh National Bank
and that the mortgages be reawarded by decree of this court to
Pittsburgh National Bank,to be serviced and disbursed without
further accounting to this court.
Your petitioners pray that the administration and
audit of this estate be closed and that distribution in accord-
ance with the foregoing be made to the parties entitled thereto.
