The Petition of Virginia Miller, by her attorney, OLIVER N. HORlVIELL,
Esquire, respectfully. represents:
l 1. Virginia Miller, of 212 Garland Drive, Carlisle, Pennsylvania, ,,
/Cumberland County), qualified as the executrix of the estate of Elizabeth
Booker, deceased, and letters testamentary were issued to her by the Register
.,
' of Wills of Washington County, on February 3, 1969.
2. Elizabeth Booker, formerly of 119 Third Street, California,
Washington County, Pennsylvania, was an adjudged incompetent, at No. 46 of
} 967, o. C., and died testate on December 24, 1968~ while a patient at
I
!Torrance State HospitaL Her will was dated April 21, 1960, and was proba.ted
~ ; ~ \
on February 3, 1969.
3. At No. 434 of 1967, 0. C., your Honorable Court appointed a
:guardian for the Estate of Thomas Cecil Booker, as a result of a hearing held
,, .
:'on December 28, 1967, by Decree dated January 3, 1968. On May 1, 1968,
:your Honorable Court conducted a hearing on a Petition for instructions by the
:I
:guardian of the Estate of Thomas Cecil Booker, then adjudicated an inc~mpetent,
in order to determine title or ownership to certain bank accounts and other items

cALIFORNIA, PENNA. in the estate of Thomas Cecil Booker and to determine whether they were the
66-162-C • property of Thomas Cecil Booker, or Elizabeth Booker, or both.

4. OnMarch27, 1969, at No. 671 of1967, apetitiontobtervene
in the hearing at No. 434 of 196 7, recited aforesaid, was filed by Fred Killius
and argument held by the Court on April15, 1969, and on June 3, 1969, per-
mission was given to Fred Killius to intervene. As yet, no determination has
been made of the issues raised at No. 434 of 1967, or No. 671 of 1967.
5. The will of Elizabeth Booker deceased, named Virginia Miller,
daughter, of 212 Garland Drive, Carlisle, Pennsylvania, and Thomas C.
Booker, Torrance State Hospital, Torrance, Pennsylvania, as her sole heirs,
and nominated Virginia Miller of 212 Garland Drive, Carlisle, Pennsylvania,
as her executrix.
6. The Western Pennsylvania National Bank was nam~d guardian
of the Estate of Elizabeth Booker, an incompetent, on June 16, 1967, at No.
46 of 1967, and at N o. 320 of 1968, filed an account to make said accounting
a court record.
7. On February 4, 1969, at No. 93 of 1969, 0. C., vVestern
Pennsylvania National Bank, Guardian of the Estate of Elizabeth Booker, an
incompetent, filed a first and final account for the purpose of transferring
assets from the Estate of Elizabeth Booker·, an incompetent, to the Estate of
I
Elizabeth Booker, deceased. The account of the guardian showed a net
balance for distribution of $55, 85 6. 96.
I 8. Upon the decease of Elizabeth Booker, an incompetent, the

and determined, and the authority of the bank to act and invest funds in their
possession owned or alleged to be owned by her ceased and determined. There
is therefore the sum of $55, 856. 96 in the possession of Western Pennsylvania
National Bank which presently is not invested, and which, pending determination

of all of the cases cited aforesaid, may be owned by the Estate of Elizabeth
Booker, deceased, or Thomas C. Booker, either or both.
9. It is to the benefit of all parties involved that the ·money in the

securities for the benefit of the estate of all parties concerned.
WHEREFORE, your petitioner respectfully prays your Honorable
Court to enter a Decree directing the We;stern Pennsylvania National Bank,
guardian of the Estate of Elizabeth Booker, an incompetent, to transfer the
assets of $55,856. 96 as set forth in the account of Western Pennsylvania
National Bank at No. 93 of 1969, to Virginia Miller, executrix of the Estate of

AND PERMIT EXECUTRIX TO PROCEED IN THE ADMINISTRATION
OF DECEDENT'S ESTATE
The Petition of Virginia Miller, by her attorney, OLIVER N.
HORMELL, Esquire, respectfully represents:
l. Virginia Miller, of 212 Garland Drive, Carlisle,
Pennsylvania, (Cumberland County), qualified as the Executrix of
the Estate of Elizabeth Booker, deceased, and letters testamen-
tary were issued to her by the Register of Wills o~ashington
County, 6n Febiuary 3, 1969.
2. Elizabeth Booker, formerly of 119 Third Street, Califor-
n1a, Washington County, Pennsylvania, was an adjudged incompetent,
at No. 46 of 1967, O.C., and died testate on D~ember 24, 1968,
while a patient at Torrance State Hospital. Her will was dated
April 21, 1960, and was probated on February 3, 1969. Attached
hereto, made a part hereof, and marked Exhibit '1A n is a photo-
static copy of her Last Will and Testament.
3. At No. 434 of 1967, O.C., your Honorable Court appointed

a guardian for the Estate of Thomas Cecil Booker, as a result of a
hearing held on December 28, 1967, by Decree dated January 3,
1968. On May l, 1968, your Honorable Court conducted a hearing

on a Petition for instructions by the guardian of the Estate of
Thomas Cecil Booker, then adjudicated an incompetent in order to
determine title or ownership to certain bank accounis and other
items in the Estate of Thomas Cecil Booker and to determine
whether they were the property of Thomas Cecil Booker, or
Elizabeth Booker, or both.
4. At No. 671 of 1967, your Honorable Court permitted Fred
Killius to intervene in the hearing at No. 434 of 1967, recited
aforesaid.

5. On October 22, 1970, your Honorable Court handed/an
adjudication wherein the title to the assets herein above men-
tioned was determined and no party to the Estate has taken
exception to said adjudication.
6. On December 1, 1969, at No. 93 of 1969, and No. 46 of
1967, your Petitioner presented a petition to your Honorable
Court· to transfer funds into the Estate of a CUeceased incompe-
tent. Pursuant to said Court Order, the funds in the possession
of Western Pennsylvania National Bank, guardian of the Estate of
Elizabeth Booker, were transferred to Virginia Miller in the
amount of $55,856. 96 and the said Virginia Miller was directed
to invest said amount in legal investments but that she was to
make no expenditures from said funds without authorization from
the Court.
7. The adjudication as to the assets having been made by
your Honorable Court has aforesaid on October 22, 1970; and
title. to the assets having been adjudicated, your Petitioner
now desires to pay over to the guardian of the Estate of Thomas
Cecil Booker those assets to which said guardian is entitled by
virtue of said adjudication, and further desires to proceed with

the administration of the Estate by the filing of the necessary
inventories, payment of bills, filing of accounts, and Petition
for Audit in the Estate of Elizabeth Booker.
8. At No.93 of 1969, the Western Pennsylvania National Bank
guardian of the Estate of Elizabeth Booker, filed an account
and presented a petition for Audit of the same indicating the
aforesaid balance in the ~.amount of $55,856.96 ~ Attached hereto
made a part hereof, and marked Exhibit TTB" is a photostatic
copy of the petition for audit referred to.
9. Under the terms of the Order and Decree of your Honorabl
Court of December 1, 1~69, your Petitioner has no power to pay
to the guardian of Thomas Cecil Booker the funds due him, pur-
suant to the adjudication of your Honorable Court on October 22,
1970, nor does your Petitioner have power to proceed with the
administration of the Estate of Elizabeth Booker, deceased,
to a final conclusion.
WHEREFORE, your Petitioner respectfully prays your Honorabl
Court to make an Order and Decree permitting your petitioner to
pay to the Pittsburgh National Bank those assets in your Peti-·
tioners possession which belong to Thomas Cecil Booker, an in-
competent, pursuant to the adjudication of your Honorable Court,
and that your petitioner be released from the restriction that
she shall make no expenditures from the funds of Elizabeth
Booker, deceased.

THE COURT: The Court will proceed with the consideration of t e
audit of accounts filed for the first quarter of 1969. We will today
consider those listed for audit on Monday, March 17, 1969, at 1:30
o'clock P.M. The first audit is in the estate of Elizabeth Booker,
an incompetent,. at 93 of 1969. The Accountant is the Western
Pennsylvania National Bank and the attorney is Oliver N. Hormell.
Mr. Hormell?
MR. HOR MELL: May it please the Court, I have all the necessary
papers in this estate. The incompetent is now deceased. And I

am requesting that distribution will be made to the Executrix of the
incompetent's estate. The exact amount of money which will ulti-
·' mately be administered by the estate, Your Honor will recall, will
depend upon the adjudication by this Court which is presently still
being considered. I think Mr. Azorsky has a statement he wants
to make on this matter also.
MR . A ZORSKY: Your Honor, as Your Honor knows, I represent
the guardian for Thomas C. Booker, an incompetent. And I wish
to sta:e for the record that any claims we had against the estate of
Elizabeth Booker, an incompetent, we will now pursue against the
personal representative.
THE COURT: Yes. Now concerning the matter of the claims that
we ha:l heard prior to the death of the incompetent in this instance,
I understood that there might be additional counsel coming in with
respect to that matter that there might be a possibility that we woul<
open up the testimony that was taken in that to pursue that matter
further. Do you have any knowledge of that?
MR. AZORSKY: I know that I was called by the additional counsel,
but other than that, I don't know what papers he's signed or what
there is involved.
THE COURT: Nothing has been done of record in that respect?
MR. AZORSKY: Not as of yet, Your Honor.
THE COURT: Do you know anything of that, Mr. Hormell?
MR. HORMELL: May it please .the Court, this all comes as a

surprise to myself. I know nothing about it. What additional counsel
and for whom?
MR. AZORSKY: Representing Fred Killius.
MR. HORMELL: He's not a party to the litigation, is he?
MR. AZORSKY: He was in the case. He was served. He's some sprt
of a party; I'm not sure what kind.
THE COURT: The Court will await any matters that are brought
to its attention of record and unless that is done, we will proceed
to determine the matter of title on the testimony that was adduced
thus far. And we will make a determination of that and distribution
can be made. Is there anyone else in Court interested in this
incompetent's estate?

THE COURT: The audit of this account will be ordered closed
by the Court .
