on the 20th. day of A. D. 19 69 , before me,
Russell Marino , Register for the Probate of Wills and Granting
Letters of Administration in and for the County of Washington, in the Commonwealth of Pennsylvania,

The trustee shall have the following power and
(a) To accept in kind from the Executor of my
Last Will and Testament any· of my investments or property, real,
personal or mixed;
(b) To invest and reinvest the principal of th
trust or any part thereof in any kind of property, real, personal

or mixed, including, Without limitation, mortgages, or mortgage
participations, common trust funds, common stocks, preferred stockj,
bonds, notes, and other securities, regardless of whether the same
are legal investments for trust funds as now or hereafter defined
by law, whether by statutory enactment, judicial decision, or
otherwise;
(c) To manage and operate all real estate at
any time held in this trust; to sell and convey, or make agreements
or options to sell such realty; to lease all of any part of the sa~e
for such terms and.re~tals and upon such conditions as the trusteej
sha!l deem advisable,notwithstanding the terms of such lease may
extend beyond the life of any trust hereunder; to release, partitio ,
vacate, or abandon the same; to grant and acquire licenses and
easements with respect thereto; to make improvements to or upon
the same; to construct, demolish, alter, repair, insure, maintain,
and rebuild buildings and other improvements; and to use other
assets of the trust for any of such purposes;
(d) To prosecute, defend, compro~ise, arbitratq,
or otherwise adjust or settle claims in favor of or against the
trustee or the trust estate;
(e) To hold the trust in such manner that the
principal and income therefrom shall not be subject to assignment,
.alienation, pledge, attachment, or claims of creditors of my said
grandsono

SHUTTLEWORTH, Executrix of this my Last Will and Testament, but
the event my wife should predecease me, then I name, constitute

and Testament, in our presence, who, in his presence, at his
request, and in the presence of each other, have hereunto subscrib d
our names as attesting witnesses.
I, THOMAS L. SHUTTLEWORTH, of Coal Center· Borough,
Washington County, Pennsylvania, ·do make this, my Last Will and
Testament, hereby revoking in full any and all Wills heretofore
rna de by me :
I direct my Executor, hereinafter named, to pay
by debts and funeral expenses.
SECOND: All the rest, residue and remainder of my
property, whether real, personal or mixed, of whatsoever nature or
description, and wheresoever situate, including any personal or
real property that may be payable to me from my motherts estate,
I give, devise and bequeath unto my wife, NELLIE SHUTTLEWORTH,
but in the event my wife should predecease me, then I direct that
my estate be distributed in accordance with paragraphs THIRD and
FOURTH of this my Last Will and Testament.
THIRD: In the event that my wife shall predecease me,
or shall not survive me in a common accident, or shall die within
six months after my death, I give, devise and bequeath all of my
property, whether real, personal or mixed, and of whatsoever natur
or description, and wheresoever situate, including any personal
or real property that may be payable to me from my rnotherts estate
as follows: to my daughter, ELEANOR ROOK, one-half thereof to be
hers solely and absolutely; to the WESTERN PENNSYLVANIA ~ATIONAL
BANK, in trust however, an undivided one-half thereof, for the
following uses and purposes:
1. To pay or use the net income therefrom,
after paying any expense~properly chargeable to income in the
administration of the trust, for the benefit of my grandson, HARRY
ROOK, provided however, that the trustee may retain any ~et income
which, in its opinion, is not required for the proper welfare,
maintenance, support or education of the said Harry Rook.
2. In the event that the payments of income
hereinabove authorized to be paid to my grandson shall, in the sol
discretion of the trustee, be insufficient to provide fo~ the
welfare, maintenance, support or education of my said grandson in
the style to which he has become accustomed, it may use from time
to time so much of the principal to which the said grandson shall
be entitled as may be, in the opinion of the trustee, advisable
for the 'said purposes.
3. To pay the principal and accrued and
undistributed income to my said grandson, Harry Rook, when he has
attained the age of twenty-one years, to be his solely and
absolutely, provided however, that in the event the said Harry
Rook dies before he attains the age of twenty-one years, then the
said preincipal and accrued and undistributed income shall be paid
to the legal heirs of the said Harry Rook.
