HERTIG I Deceased PETITION FOR SETTLEMENT OF SMALL ESTATE UNDER PROVISION OF SECTION 202 OF THE FIDUCIARIES ACT OF 1949, AS AMENDED TO THE HONORABLE, THE JUDGES OF THE SAID COURT: The petition of Martha Elizabeth Huggins respectfully represents: 1 .. That she is the Executrix of the Estate of Anna E. Hertig, deceased, who died on the 4th day of January, 1969, a resident of the Borough of West Alexander, Washington County, Pennsylvania. 2. That, by the terms of her will, a true and correct copy of which is attached hereto as Exhibit "A", the testatrix devised all of her estate, in equal shares, to her grandchildren, Martha Elizabeth Huggins and Charles Donald Hertig. 3. That, on the 16th day of January, 1969, the Register of Wills of Washington County admitted to probate the Will of Anna E. Hertig, and granted Letters Testamentary to Martha Elizabeth Huggins as Executrix of said Estate. The Letters Testamentary are attached herewith as Petitioner's Exhibit "B". 4. The Testatrix was not survived by her spouse and no one is entitled to the benefit of a family exemption. 5. The said testatrix's estate consisted of no personalty and a 1/2 interest in certain real estate situate in the Borough of West Alexander, LAWRENCE R. ZEWE ATTORNEY AT LAW 27 S. COLLEGE STREET WASHINGTON, PENNA. 18301 ~ ~~ Washington County, Pennsylvania, which deed is of record in the Office of the Recorder of Deeds of Washington County, Pennsylvania in Deed Book Volume 562, page 556, and which has been conveyed by the Executrix and other owners for the sum of $2250.00, less expenses of sale. 6. By deed of the Executrix and other owners as tenants in common, the net consideration payable to the Estate is $1018.75, which sale was approved by the Court of Common Pleas, Orphans' Court Division on the 18th day of May, 1970, and filed in the Office of the Register of Wills of Washington County at No. 63-69-69. 7. Other than the debts and expenses listed above, no claims have been made against the estate, and any and all creditors have had the opportunity to so notify the Executrix of the estate since publication of the issuance of letters. The proofs of publication are attached hereto as Petitioner's Exhibit 11 C 11 • 9. There is no inheritance tax owing to the Commonwealth of Pennsylvania. A copy of the RCC-103 (Insolvent Estates Form) is attached hereto as Exhibit "D 11 , the original of the same being recorded with the Register of Wills at No. 63-69-59. 10. The testatrix was not employed at the time of her death, and no wages, salary or accrued pension payments were due to her or have been received by petitioner, or anyone else, since her death. 11. Administration has been raised by petitioner at No. 63-69-59, as recited in paragraph 3 hereof. 12. The Executrix of the estate of Anna E. Hertig, as set forth in the copy of Will, attached, as sums responsibility for payment of all debts listed in paragraph 7 hereinabove, even though the estate of Anna E. Hertig, deceased, is without sufficient assets. WHEREFORE, the petitioner prays that the Court direct distribution of the assets of the within Estate to Martha Elizabeth Huggins, your petitioner, for the purpose of paying the last debts and expenses of Anna E.
