J: ~ TIME: N lfi a: Ill 1-a: 0 Monday, January 13, 1969, at 10:00 o'clock A.M., EST. :!i MR. POSA: If the Court please, I have one other petition in a: 1-a: ::> 0 u ..J <( u ii: 1.1. 0 the estate of Rebecca Rut~ Long. This again is an estate, a small estate under the amount of $2500. The Petitioner here is the only one of five children of the decedent, who is sui juris . The other four are all minors. The decedent was a woman; her husband has released his interest to the children. In this estate there is six hundred some dollars, it's $681.38 in cash, and an automobile that is evalulated at $200. And we have asked that the cash be distributed to four of the children, and the automobile be distributEd • < z < :i )o CD z z Ill Q. i. 0 ~ C) z J: CD < ~ ...: u 0: ~ CD 0 ..J < ~ 0 :;) ., :r ... 2 to one of the children. However, as I pointed out, only one of thesE five children is over 21. But we have asked that the shares of the o her be distributed to the minors, that is to guardians appointed by the Court on behalf of the minors. In our Decree,a form of Decree, we have asked that the Pet'itioner be named guardian for the benefit of two of the minors and that a brother-in-law be named as guardian for the two of the other minors. Now because of the small amount involved, we ha \ e also asked that these amounts be placed in a bank account on behalf of the minors; and the instances where cash is involved and in the case of the automobile, we ask that the title of the automobile be placed in the name of the guardian in trust for the minor, with a further restriction that if the automobile is transferred or sold :; that the replacement automobile or cash from the sale be held for ui II: Ill ~ II: 0 Q. POSA: That's a good suggestion. In fact, that is what I 1&. 0 asked, but they want to retain it and it's the only way I could figure out we could do it under these circumstances without taking out Letters and having an Administrator. THE COURT: We wouldn't favor placing the title to the car in the guardian's name unless we knew that proper insurance was goirg to be available. • MR. POSA: The car is already insured. We have seen to that However, if the Court would like to have an opportunity to look at ·the policy and so on, we could have that brought in. Of course, it would not now be in the name of the guardian. But we can have the insurance placed in the name of the guardian.:. ~ THE COURT: We would prefer to see that adequate insurance z o( > .J >-UI z z is carried. You will make the policy available to the Court. ~ MR. POSA: Are you referring to liability insurance on behalf z 0 1-~ of--- :r Ul ~ THE COURT: Correct . ..: ~ MR. The automobile is such that .I don't think it will last that long. The boy is 1 7 . THE COURT: Do you have a decree? MR. POSA: I do, but do you want the insurance first? THE COURT: No, you can make that available to the Court and we can check it. Mr. Posa, is there any specific need for this mirpr 3 :5 z < > 4 to have this car that you know of? MR.
