the estate of Rebecca Rut~ Long. This again is an estate, a small
estate under the amount of $2500. The Petitioner here is the only
one of five children of the decedent, who is sui juris . The other
four are all minors. The decedent was a woman; her husband has
released his interest to the children. In this estate there is six
hundred some dollars, it's $681.38 in cash, and an automobile
that is evalulated at $200. And we have asked that the cash be
distributed to four of the children, and the automobile be distributEd

to one of the children. However, as I pointed out, only one of thesE
five children is over 21. But we have asked that the shares of the o her
be distributed to the minors, that is to guardians appointed by the
Court on behalf of the minors. In our Decree,a form of Decree,
we have asked that the Pet'itioner be named guardian for the benefit
of two of the minors and that a brother-in-law be named as guardian
for the two of the other minors.
Now because of the small amount involved, we ha \ e
also asked that these amounts be placed in a bank account on behalf
of the minors; and the instances where cash is involved and in the
case of the automobile, we ask that the title of the automobile be
placed in the name of the guardian in trust for the minor, with a
further restriction that if the automobile is transferred or sold

the minor until he arrives at the age of 21. The minor is 17 involv d

8 THE COURT: Why is it not expedient to sell the car now?

~ MR. POSA: That's a good suggestion. In fact, that is what I

asked, but they want to retain it and it's the only way I could figure
out we could do it under these circumstances without taking out
Letters and having an Administrator.
THE COURT: We wouldn't favor placing the title to the car in
the guardian's name unless we knew that proper insurance was goirg
to be available.

MR. POSA: The car is already insured. We have seen to that
However, if the Court would like to have an opportunity to look
at ·the policy and so on, we could have that brought in. Of course,
it would not now be in the name of the guardian. But we can have
the insurance placed in the name of the guardian.:.
~ THE COURT: We would prefer to see that adequate insurance

The Petition of Faye Manon respectfully represents:
1. The decedent, Rebecca Ruth Long, died intestate
on July 5, 1968, a re~ident of the City of Washington, Washington
County, Pennsylvania.

6. Distribution of the net balance of the estate
should be made subject to the payment of the creditors of the
decedent, of which the following are known to your petitioner,
which she verily believes .to b~ all of the creditors:

7. Decedent's funeral bill in the amount of $1,106.00
was paid to the Hummell .Funeral Home by decedent's mother, Mrs·.
Helen Horner, for which she is making no claim.
8. In addition to the above named creditors it will
be necessary to pay the .cost of filing this petition and counsel
fees from the aforesaid balance •
. 9. Harold H. Long, Jr., one of the aforesaid minor
children, has requested that decedent's automob;i.le b~ distributed
to him in full satisfaction of his distributive share of the
estate. Your petitioner and the other heirs have no objection
to distribution being made in this manner, but would request

that title be transferred to Frederick W. Deyell, as guardian
for Harold H. Long, Jr. until such time as he shall arrive. at
the age of twenty-one years.
WHEREFORE, your petitioner prays that your Honorable
Court. award and set aside the net balance of cash in the estate
after payment of the aforesaid creditors, filing costs and
counsel fees, to the following named heirs in the following
proportions:
(1) Faye Manon, one-fourth thereof;
(2) Fred~rick w. Deyell, guardian of Audrey Deyell,
a minor, one-fourth thereof;
(3) Faye Manon, guardian of Betty Roe, a minor,
·one-fourth thereof;
(4) Faye Manon, guardian ·of Donna Long, a minor,
one-fourth thereof;
(5) Frederick W·. Deyell, guardian of Harold H.
Long, Jr., a minor, all that certain Oldsmobile convertible
automobile, Manufacturers No. 626M09551, Title No. El4978326;
that distribution to the guardians, aforesaid, be made with the
stipulation that each minor's distributive share shall be placed
in a savings account in a bank or savings and loan association
in the names of the guardian and of the minor; that the said
savings account be held by the guardian until the minor arrives
at the age of twenty-one years·at which time distribution of the
principal of the account and any accumulated interest be made
to the minor; that the said Frederick w. Deyell as guardian of
Harold H. Long, Jr. shall hold the title to the said motor

vehicle or any replacement vehicle o~ the cash if the vehicle
is sold' in trust for Harold H. Long, Jr., until such time as
he arrives at the age of twenty-one years; and that said
distribution be made in accordance with this petition without
notice and without issuance of Letters of Administration and
pursuant to the ppovisions of Section 202 of the Fiduciaries
Act of April 18, 1949, P. L. 512, as amended, and the rules of yo r
Honorable Court.

RELEASE
KNOW ALL MEN BY THESE PRESENTS, THAT I, HAROLD H. LONG,
of Addison Street, Washington, Washington County, Pennsylvania,
surviving husband of Rebecca Ruth Long, deceased, desiring to
release and waive any claim which I may have in the estate of my
wife, Rebecca Ruth Long, deceased, do hereby remise, release,
quit claim, and forever discharge my children, namely, Faye
Manon, Audry Deyell,Betty Roe, Donna Long and Harold H. Long, Jr.,
from any and all obligations to distribute to me any portion of
the estate of Rebecca Ruth Long, deceased, and, further, I do
hereby waive any claim which I may have in and to any of the
assets in the estate of Rebecca Ruth Long, deceased, and do
hereby consent to distribut~on of the net proceeds of her estate
to my above named children.
FURTHER, I do hereby join in any petition to the
Orphans' Court of washington County, Pennsylvania, and ask that
the assets of the estate, after payment of all obligations, be
distributed in equal shares to my above named children.

the age of twenty-one years at which time the guardian shall
make distribution of the principa.l of the savings account and
any accumulated interest to the minor;
IT IS FURTHER HEREBY ORDERED AND DECREED that all
that certain Oldsmobile convertible automobile, Manufacturers
No. 626M09551,. Title No. El4978326, be and is hereby awarded
and set aside to Frederick W. Deyell, guardian of Harold H. Long,
Jr., a minor, and said guardian shall hold the title to said
motor vehicle or any replacement vehicle or the cash if the

vehicle is sold, in trust for Harold H. Long, Jr., until such
time as he shall arrive at the age of twenty-one years at which
time the guardian shall make distribution and transfer thereof
to the said minor.
IT IS FURTHER ORDERED AND DECREED that for purposes of
distribution·to the above entitled heirs, in accordance with this
order, Pittsburgh National Bank, Washington, Pennsylvania, and
Brockway Glass Company, Washington, Pennsylvania, are authorized
to disburse to Faye Manon, the petitioner herein, the funds, set
out above.
IT IS FURTHER ORDERED AND DECREED that distribution
shall be made. in accordance with this Petition without notice
and without issuance of Letters of Administration and pursuant
to the provisions of Section 202 of the Fiduciaries Act of April
18, 1949, P. L. 512, as amended, and the rules of this Court.
