:l 8 MR. POSA: If the Court please, about two weeks ago, my par ner,

Pat Derrico, presented an Audit Petition in the estate of Mary
Lozosky, and in that estate there was one fifth interest that was
to be distributed to the estate of Edward Lozosky, her son; and
the amount involved there, together with the remaining portion of
his estate, is less than $2500. 00. And I now have a Petition
asking that that be settled as a small estate. The heirs involved
in the Edward Lozosky estate are the same as in the Mary Lozosky

estate, so that is no problem. The only question I have here is a
matter of the petitioner. We had originally intended to have
Barrett G. Greenlee take out Letters of Administration in this
estate and had received renunciations from the various heirs. And
when we learned that the estate was less than $2500, we thought tha
it would be acceptable to the Court if Barrett Greenlee presented
Petition on behalf of the heirs who have renounced the right to
administer.
THE COURT: Mr. Posa, is one of the dis tributees a minor?
MR. POSA: That is correct, yes, Your Honor, John Lozosky,
his mother and natural guardian had signed a Renunciation in his
behalf.
THE COURT: 'fo whom would his distribution be made?
MR. POSA: We would ask that,! think we did this in the Mary
Lozosky estate, I m not sure whether we did it in the Edward,
but we asked that it be .:distributed to his mother as natural guard n
and be held for hirri until he arrives at the age of 2 1.
THE COURT: To be held in any specific manner?
MR. POSA: The amount involved in tbe lil.dward Lozosky
estate is rather small. However, taken along with the amount he
will receive in the Mary J;.;ozosky estate, the amount probably woul
be in e:xcess of $1,000 but less than $2, 500. I would assume that i
could be held in a bank account in' his behalf_. We haven't asked
for any specific way that that be held.

THE COURT: We would prefer that that be done. We don't favor
paying it to his mother as the natural guardian unrestricted.
MR. POSA: I wouldn't want it unrestricted, Your Honor. I'd
expect it to be held in trust in some manner for him, p~eferably
in a bank account.
~ THE COURT: Could our Decree be made to incorporate that idee: ? z o( :; ~ MR. POSA: Yes, indeed.

4. Your petitioner, Barrett G. Greenlee, has acted
as Administrator in the Estate of Mary Rose Lozosky following
renunciation of the heirs of Mary Rose Lozoskywho are the same
heirs as those named above in the estate. of Edward T. Lozosky.
He presents this petition by virtue of a renunciation in the
Estate of Edward T. Lozosky, which is attached hereto and marked
Exhibit "A"•
5. All of the above named heirs are sui juris with
the exception of John Lozosky wh6 is a minor sixteen years of
-· age and who is represented by his mother and natural guardian,
Helen Lozosky.

6. Distribution of the net balance should be made
subject to the payment ~f the following creditor from the afore-
said st.im of $2,404.11:
a. Greenlee Funeral Home,
balance due on funeral bill $ 254.60
In addition to the above creditor, it will be
necessary to pay the Pennsylvania transfer inheritance tax, the
cost of filing this petition and counsel fees from the aforesaid
balance.
WHEREFORE, your petitioner prays that your Honorable
Court award and set aside the net balance of cash in the estate,
after payment· of the aforesaid creditor, filing costs, Pennsyl-
vania transfer inheritance tax and counsel fees, to.the above
-named heirs in the shares herein stated,~ in accordance with the
Intestate Law, without notice and without_ issuance of Letters of
Administration and pursuant to the provisions of Section 202 of
the Fiduciaries Act of April 18, 1949, P. L. 512, as amended,
and the rules of your Honorable Court. ·

IT IS HEREBY ORDERED AND DECREED that the net balance
of cash in the ~Estate, after payment of the creditor set forth

transfer inheritance tax and counsel fees, it being decedent's
entire estate for administration purposes, be and is hereby
