V. MARINO,PRESIDENT JUDGE: The Petition of the Western Pennsylvania National Bank, Guardian of the Estate of Wendel Jurovcik, an alleged weak-minded person, respectfully represents: 1. That the Petitioner was appointed Guardian of Wendel Jurovcik by Decree of the Court of Common Pleas of Washingtm County, Pennsylvania, at No. 4442 in Equity on November 8, 1945. That on or about January ~0, 1969, a Petition was filed whereby jurisdiction was transferred to this Court by the Orphans' Court Act of 1951. 2. Subsequently, the Western Pennsylvania National Bank filed an Account and contemplated asking the Court's permissic n to pay all of the funds over to the Commonwealth of Pennsylvania, Torrance State Hospital. 3. One of the assets of this estate is an insurance policy of the Prudential Life Insurance Company of America, whereb~ the Guardian is receiving $10.00 per month disability payment. I -----------------~-------------..-------- 4. The Prudentiallife Insurance Company informed the Guardian that these payments will be made to the Guardian only and that therefore it will be impossible to close this account. 5. The incompetent has been a patient of the Torrance State Hospital from April 17, 1945 to the present; and, as of July 31, 1968, $26,345.95 was the total amount due the Commonweal for his care. A copy of said bill is hereto·attached and marked Exhibit "A". 6. Western Pennsylvania National Bank requests per- mission to pay to the Torrance State Hospital $3,000.00 on this account. WHEREFORE, Petitioner prays the Court for leave to pay to the Torrance State Hospital the sum of $3,000.00 out o·f the incom and principal. And your Petitioner will ever pray. However, after we filed our account, the guardian was informed by Prudential that they would not pay this $10.00 a month to anybody else except the guardian.
