TERM 19 PETITION FOR CITATION TO THE HONORABLE THE JUDGES OF SAID COURT: AND NOW, this ?'tt day of~, 19 71 comes the Commonwealth of Pennsylvania, by Marco S. Sonnenschein, Deputy Secretary for Taxation, for Milt Lopus, Secretary of Revenue, who avers: 1. That Mary Bober, deceased, (hereinafter referred to as "the Decedent"), died on November 22, 1966. 2. That a Petition for Letters of Administration was made by Wanda V. Casper, Administratrix, (hereinafter referred to as "the Administratrix"), on November 14, 1968·. That Letters of Administration were granted to the Administratrix on November 14, 1968, as evidenced by the Register of Wills' Bond Book 63-24-2302. 3. That on August 22, 1977·, a certified demand letter was sent to the Administratrix, advis~ng that the Inheritance Tax Return for theDecedent had not been filed. A receipt was signed and returned to the County Inheritance Tax Office. Attached hereto and made a part hereof is a copy of said letter and receipt marked Exhibit "A." '. ' . 4. That as of the date of this Petition no Inheritance Tax Return has been filed by the Administratrix of this estate as required by Section 701 of the Act of June .15, 1961, P.L~ -373"," Article VII (72 P.S. 2485-701), and Section 703 of the Act of Jtm.e 15, 1961, P.L. 373·, Article VII, as amended ·(72' P.S. 2485-703)". 5. That under Section 821 of the Act of June 15, 1961, P.L. ·373·, Article VIII, ·(72·P.S. ·2485-821), the Secretary of Revenue is authorized to request;: the Court to issue a Citation directed to those subject to any duty imposed by the aforesaid Act, commanding such persons to appear and show cause why· the requirements of this Act should not be met. This is the estate of Mary Bober, and the citation is for failure to file an inheritance tax return. Mary Bober died on November 22, 1966. Letters of Administration were issued on Novem- ber 14, 1968, to Wanda B. Casper. On August 22, 1977, the Depart- ment of Revenue sent a certified letter to Wanda Casper, requesting that the inheritance tax return be filed. At this point in time, no return has been filed, so we are requesting the Court's assistance in securing the filing of the inheritance tax return. MR. SOLOMON: Your Honor please, J·ohn Solomon, attorney for the estate of Mary Bober. If your Honor please, we . acknowledge the statement as set forth by counsel, and acknowledge receipt of request of payment. I was in this estate at one point, and the Department of Public Welfare intervened, and I believe, if Ire- member correctly, there is something on the record that would show that Peacock, Keller, Yohe and Days office had something to do with it, by virtue of them being counsel for the Department of Public Welfare. After that, I had no contact in the estate with either the administratrix or the other office. SOLDMON: It's either insolvent or very close to it, your Honor, because, as I remember, and it's been quite a while ago, the only asset in the estate was a house and a piece of real estate, and the house was being rented. I filed an ejectment action against the people that were renting it, for the estate, to get them out, but the Department of Public Welfare was collecting the rent on it at that time, and they were at that time involved in the estate, and might well be. I don't know, but I would like to in- quire into that, and file the necessary papers to close out the estate. THE COURT: Would thirty days be sufficient time? MR. SOLDMON: Thirty days would be fine, your Honor. THE COURT: Is thirty days all right? MR. MENGEL: Yes, Your Honor.
