As to such tax that is paid within three months from date of death, a five {5%)
percent discount is allowable. As to any tax that remains unpaid after nine (9) months
(fifteen months when death occurred from December 22, 1965 to June 16, 1971, inclusive;
and twelve months when death occurred prior to December 22, 1965) from date of death,
interest at the rate of six (6%) percent per annum is charged.
Any party in interest who is aggrieved by this notice may object thereto within
sixty days after receipt of said notice as provided by Section 1001 of the Inheritance and

having been designated to make a fair and conscionable appraisement of the said estate, and to assess and fix
the cash value of all annuities and life estates growing out of said estate, hereby file the following appraisement:
In the event that any future interest in this estate is transferred in possession or enjoyment to collateral heirs of the decedent after

I, EARL D. JACKSON, of Amwell Township, washington
County, Pennsylvania, being of sound and disposing mind, memory and
understanding, do hereby make, publish and declare this as and for
my Last Will and Testament, hereby revoking and making void all
other wills, codicils or t~stamentary writings by me at any tfme
heretofore made.
FIRST: I direct that all my just debts and funeral ex-
penses be paid and discharged as soon as conveniently miy be done
after my decease.
SECOND: I give and bequeath all the farm machinery,
equipment, etc., which I own or in which I have any interest what-
soever, to my grandson, James W. Jackson.
THIRD: I give, devise and bequeath my interest in a
parcel of land situate in Austin, Potter County, Pennsylvania, used
as a hunting camp to my grandson, Gary Jackson.
FOURTH: I give, devise and bequeath an undivided one-
third (1/3) interest in and to my farm situate in Amwell Township,
Washington County, Pennsylvania, to my daughter, Jessie Irene Mar-
tin, an undivided one-third (1/3) interest to my daughter, Dorothy
Jackson Reeves, and the remaining one-third (1/3) interest in equal
shares to the children of my deceased son, James C. Jackson, living
at the time of my decease; provided, however, that my grandson,
James w. Jackson, shall have the right and privilege to operate and
manage the said farm for and during the term of his natural life
or so long as he elects to operate the same, which said right shall
include any and all profits and/or inco~e derived th~refrom, pro-
vided furthert that he maintains the same as a farm and keeps the
buildings in reasonable repair and pays any and all annual taxes
levied thereon.

FIFTH: I give, devise and bequeath all thu rest, resi-
due and remainder of my estate, real, personal and mixed, of whatso-
ever kind and anture and wheresoever situate as follows: one-third
(l/3) thereof to my daughter, Jessie Irene Martin, one-third (1/3)
thereof to my daughter, Dorothy Jackson Reeves, and the rem~ning
one-third (1/3) thereof in equal shares to the children of my .de-
ceased son, James C. Jackson, living at the time of my decease,
their heirs and assigns.
SIXTH: I nominate, constitute and appoint Ilene Jack-
son, Guardian of the Estate of any of her children entitled to share
in my estate during their minority.
LASTLY, I nominate, constitute and appoint my grandson,
James W. Jackson, Executor of this, my Last Will and Testament, and
in the event he is unable to act as such Executor for any reason,
then I hereby nominate, constjtute and appoint Ilene Jackson, i-

WAIVER OF FORMAL ACCOUNTING

Administratrix d.b.n.c.t.a. of the above captioned estate
(hereinafter referred to as "Administratrix"):
AND
JESSIE IRENE MARTIN, a widow: DOROTHY REEVES, a widow;
CHERLYN R. THOMAS, a widow; PATRICIA JACKSON-GRAY, Administratrix
of the Estate of James w. Jackson, deceased, TRUDY BERRY,
married; GARY L. JACKSON, unmarried, (hereinafter collectively
referred to as "Heirs").
AND
BETTY J. ROCHE, married.
WHEREAS, Earl D. Jackson died on April 30, 1968,
leaving a Last Will and Testament dated August 28, 1963, a true
and correct copy of which is attached hereto and marked as

Exhibit "A"~ and
WHEREAS, on April 29, 1969, Letters Testamentary were
issued to James w. Jackson, who subsequently died on June 16,
1970~ and
WHEREAS, Letters of Administration, d.b.n.c.t.a. were
issued on January 6, 1977 to Ilene Jackson, who died on October
9, 1979 ~ and
WHEREAS, on April 23, 1980, Letters of Administration,
d.b.n.c.t.a. were issued to Dorothy Reeves~ and
WHEREAS, each of the aforementioned appointments of
personal representatives have been duly advertised in the
Washington County Reports and The Observer-Reporter, with the
proofs of publication relative to the appointment of Ilene
Jackson and Dorothy Reeves being attached hereto, and marked as
Exhibit "B" and Exhibit "C", respectively~ and
WHEREAS, the long passage of time during the
administration of this estate makes it virtually impossible to
file a formal accounting in the estate, but all the parties
hereto have reviewed the records of the estate and wish to
proceed in accordance with the terms of this Agreement, hereby
waiving any formal accounting in the estate; and
WHEREAS, the parties hereto agree that to the best of
their knowledge on the.date of his death, Earl D. Jackson did not
own any farm machinery, equipment, etc., as referred to in
Paragraph Second of his Will and did not own any interest in the

parcel of land situate in Austin, Potter County, Pennsylvania, as
referred to in Paragraph Third of his Will; and
WHEREAS, the parties hereto acknowledge that the
personal representatives have heretofore liquidated the savings
bonds and Columbia Gas shares of common stock set forth in the
inventory in the estate; and
WHEREAS, the parties hereto acknowledge that the
personal representative has heretofore in September 1977 sold the
timber from the real estate held by the estate for the net sales
proceed of $1,957.08, which has been applied to the expenses of
the estate; and
WHEREAS, at the time of this Agreement, there remains
as the only assets of the estate the 187.4 acres farm situate in
Amwell Township, Washington County, Pennsylvania being more
particularly described in Exhibit "D" hereof and the sum of
$2,934.04 in the estate checking account; and
WHEREAS, Betty J. Roche is a daughter of the decedent
who is not named in the decedent's Will, but all the heirs want
her to share in the Estate based upon the terms and conditions
hereinafter set forth; and
WHEREAS, the parties hereto wish to proceed with the
settlement of the estate on the terms and conditions hereinafter
set forth.
NOW, THEREFORE, intending to be legally bound hereby
and in consideration of the mutual covenants herein contained,

the parties hereto covenant and agree as follows:
1. The recital or "Whereas" paragraphs of this
Agreement are hereby incorporated by this reference and are made
terms and conditions of this Agreement.
2. In consideration of the payment of $25,000.00 by
Betty J. Roche to Jessie Irene Martin, receipt of which is hereby
acknowledged by Jessie Irene Martin, the said Jessie Irene Martin
does hereby grant and convey to Betty J. Roche all her right,
title and interest in and to the real estate described in Exhibit
"D" hereof.
3. The parties elect to take in kind the following
proportionate interest in the real estate described in Exhibit

5. The Heirs hereby authorize and empower Dorothy
Reeves, as administratrix d.b.n.c.t.a., as follows:
A. This Agreement shall be filed in the form of a
First and Final Account requesting an audit of the estate and
award of the assets of the estate in accordance with the
terms herewith, after the passage of four months from the
date of the first complete advertisement of the Letters of
Administration d.b.n.c.t.a. to Dorothy Reeves.
B. Payment from the estate account the necessary
filing fee for the First and Final Account in this estate in
the amount of $65.00.
C. Payment of the cost of the recording of the
certification of real estate in this estate in the amount of
$13.50.
D. Payment of attorney's fees for this estate to
Greenlee, Derrico, Posa, Harrington & Rodgers in the amount of $950.00.
E. In the Adjudication and Decree and Schedule of
Distribution of the estate, the balance of cash on hand,
being the sum of $1,905.54, be divided as follows in
accordance with the terms of Paragraph Fifth of the Decedent's Will:

6. Relative to the ownership of the real estate to be
awarded by the certification of real estate, the parties hereto
covenant and agree as follows:
A. Betty Roche, during her lifetime, shall have the
privilege of residing in the two and one-half story frame
house, rent-free, with the understanding that she will pay
the real estate taxes on the entire farm and maintain the house in which she resides.
B. Dorothy Reeves, during her lifetime, shall have the
privilege of residing in the small, one-story insulbrick
frame house, with the understanding that she shall maintain
said house, but occupy it rent-free.
c. Within the year 1988, the Heirs agree to convey,
without any consideration, to Edwin H. Reeves, all of the
frontage on Horne Run Road and an area extending back from
Horne Run Road toward u.s. Route 19 of sufficient depth to
establish 10.5 acres. Provided, however, that Edwin H.
Reeves shall be solely responsible for acquiring the
necessary survey and obtaining all necessary sub-division
approvals and recording the sub-division plan, and paying the
cost of deed preparation and all realty transfer stamp taxes.
7. The parties hereto acknowledge and agree that for

the past approximately four (4) year the Administratrix has been
paying to Jessie Irene Martin all rent received from the tenant
house located on the real estate owned by the estate. The total
rent thus paid to Jessie Irene Martin has totalled $6,000.00.
The Heirs hereby remise, release and quitclaim the said Dorothy
Reeves, Administratrix, and Jessie Irene Martin of and from any
claim on account of the same.
8. The terms and conditions of this Agreement shall be
binding upon and inure to the benefit of the parties hereto and
their respective heirs, administrators, personal representatives,
executors, and assigns.
9. The said John Gray, as the spouse of Patricia
Jackson-Gray and the said Steven R. Berry, as the spouse of Trudy
Berry, join in this Agreement solely for the purposes of
consenting to the terms hereof and binding themselves to the
terms hereof as the spouses of Patricia Jackson-Gray and Trudy
Berry, respectively.

I, EARL D, JACKSON, of Amwell Township, washington
County, Pennsylvania, being of sound and disposing mind, memory and
understanding, do hereby make, publish and declare this as and for
my Last Will and Testament, hereby revoking and making void all
other wills, codicils or testamentary writings by me at any time
heretofore made.
FIRST: I direct that all my just debts and funeral ex-
penses be paid and discharged as soon as conveniently may be done
after my decease.
SECOND: I give and bequeath all the farm.machinery,
equipment, etc., which I own or in which I have any interest what-
soever, to my grandson, James w. Jackson.
THIRD: I give, devise and bequeath my inter~st in a
parcel of land situate in Austin, Potter County, Pennsylvania, used
as a hunting camp to my grandson, Gary Jackson.
FOURTH: I give, devise and bequeath an undivided one-
third (l/3) interest in and to my farm situate in Amwell Township,
Washington County, Pennsylvanid,. to my daughter, Jessie Irene Mar-
tin, an undivided one-third (l/3) interest to my daughter, Dorothy
Jackson Reeves, and the remaining one-third (l/3) interest in equal
shares to the children of my deceased son, James C. Jackson, living
at the time of my decease; provided, however, that my grandson,
James w. Jackson, shall have the right and privilege to operate and
manage the said farm for and during the term of his natural life
or so long as he elects to operate the same, which said right shall
include any and all profits and/or inco~e derived th~refrom, pro-
vided further I. that he maintains the same as a farm and keeps the
buildings in reasonable repair and pays any and all annual taxes
levied thereon.

their heirs and assigns.
SIXTH: I nominate, constitute and appoint Ilene Jack-
son, Guardian of the Estate of any of her children entitled to share
in my estate during their minority.
LASTLY, I nominate, constitute and appoint my grandson,
James W. Jackson, Executor of this, my Last Will and Testament, and
in the event he is unable to act as such Executor for any reason,
then I hereby nominate, const~tute and appoint Ilene ~ackson,
Executrix of this, my Last Will and Testament and hereby direct that
my Executor shall serve without bond.

automobiles, boats, and any and all other personal chattels of whatsoever. kind or nature, left by decedent,
together with the fairly; estimated market value thereof; all bonds and mortgages held by decedent and of all
claims due and owing decedent at the time of death, and all promissory notes or other instruments in writing
for the payment of money of which decedent died possessed, of whatsoever nature, with interest thereon, if
any, giving the face value and estimated fair market value thereof, and if such estimated fair·market value be
less than the face value, it sets forth briefly the reasons for such depreciation as to each item; all moneys
payable to the estate from life insurance policies carried by decedent; all annuity and endowment contracts
the proceeds of which were payable upon the death of the decedent; all and the corporate stocks and dividends
due thereon and unpaid as of the date of death, bonds and accrued interest thereon to the date of decedent's
death and other investment securities owned by the decedent at the time of death, with the·market value there-
of at such time.

In the case of securities of close or family corporations, the values reported are as far as
possible substantiated by financial statements of the corporations, showing the assets and liabilities
thereof as of the date of death. The schedule also sets forth the interest of decedent at the time of
death in any co-partnership_or business, and in support of the value of such interest there is annexed to
said schedule, financial statements showing the assets and liabilities of said co-partnership or t.usiness.
A copy of the co-partnership agreement, (if oral, a statement setting forth the nature of the agreement)
together with a statement setting forth the character of the business, its location, and such other facts
pertaining to the business as may be pertinent to a fair and just appraisal of the decedent's interest
therein must be submitted. It should also set forth in itemized form, together with the fair market value
thereof, any other property owned or bequeathed by the decedent at the time of death.
The Schedule C attached hereto and made part hereof sets forth a true answer to each inquiry
contained therein and in the case of transfers of property, real or personal, within two years of decedent's
death, in contemplation of decedent's death,._or intended to take effect in possession or enjoyment at or
after death, said schedule sets forth the nature and value of such property, to whom transferred, the
relationship of the transferees to the decedent, the proportionate share received by each transferee and
all other facts of a pertinent nature regarding said transfers. In the case of transfers intended to
take effect in possession or enjoyment at or after death, there is also attached to the schedule a co~y
of the deed, trust agreement or other instrument creating the trust. Ther•~ is also set forth in said
schedule a list of all property, real and personal, with its value, which passes at decedent's death by
virtue of the exercise by decedent, either individually, or jointly with anoth~r, or any power of appoint-
ment vested in decedent, either individually or jointly, by the will, deed, or other instrument of another,
with a copy of the instrument creating such power attached to the schedule.
That Schedule D attached hereto and made part hereof sets forth the names and addresses of all
persons beneficially interested in this estate at the time of decedent's death, the nature of their res-
pective interests, their relationship, if any, to the decedent, together with the ages at the time of
decedent's death of all minors, annuitants and beneficiaries for life under decedent's Will. It also
contains a statement showing which of the beneficiaries named in the decedent's will, if any, died prior
to decedent, the dates of their death, their issue, andthe relationship of such issue to the beneficiary.
That Schedule E attached hereto .and made a part hereof sets forth all property, real and per-
sonal, owned by the decedent jointly with another or others, including intangible, standing in the name
of the decedent and others, plus the date and place of record of instruments effecting the ·11esti ture of
real estate and the date of acquisition of personalty, plus the name, address and relationship, if any,
of co-owners to the decedent.
That Schedule F attached hereto and made a part hereof sets forth fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate, including funeral expenses paid;
