PETITION TO SETTLE SMALL ESTATE
TO THE HONORABLE, P. V. MARINO, PRESIDENT JODGE OF SAID COURT:
The Petition of Eli Borovich respectfully represents:
1. The decedent, Mildred Radich Borovich, who died on
September 10, 1968 a resident of RicheyVille, Washington County,
Pennsylvania.
2. Your Petitioner, who also resides· at the above mention~d
address, is Eli Borovich, the widower of the decedent and on the da~e
of the decedent 1 s death as stated, formed a part of the decedent 1 s
household. See marriage license copy at Exhibit "A".
3. Prior to the marriage of Mildred Radich Borovich,
deceased to Eli Borovich, the Petitioner, said Mildred Radich was
invovled in an automobile accident on November 5, 1964 for which
she filed suit against one Mary Chapman and Paul Miller at No.l79
September Term, 1966 A.D. and at No. 180 September Term, 1966, A. D.
against James Lutes, all in the Court of Common Pleas of Washington
County.

4. · Mildred Radich Borovich left surviving her the followi g
persons entitled to share as heirs in her estate: Eli Borovich.
5. The person entitled to the family exemption is the
Petitioner, Eli Borovich, as surviving spouse of the decedent and
the Petitioner and the deceased were residing together at the time
of her death.
6. The sole asset of the deceased is settlement of the
two negligence actions referred to hereinabove, in a full amount
of $500.00. The debts of the estate to be paid from the proceeds f
the trespass settlement mentioned above are as follows:
Murphy and France, Attorneys Fees,
including the negligence action and
attorneys for the estate

7. There are no unpaid claimants of whom this petitioner
has notice or knowledge.
WHEREFORE, Petitioner prays that the Court direct
distribution of the $500.00 settlement in the amount of $250.00 to
Eli Borovich and $250.00 to Murphy and France, attorneys and that he
Decree of Distribution authorize the said Eli Borovich and Murphy
and France, attorneys to execute the necessary papers to terminate
the action in trespass referred to hereinabove as No. 179 and 180
September Term, 1966 A. D.

AND NOW, this ~day of December, 1968, upon consideratiJn
of the Petition heretofore filed by Eli Borovich and after hearing,
and on motion by Murphy and France, attorneys, distribution of the
personal property of which Mildred Radich Borovich died possessed,
to wfr: $500.00 settlement of a negligence action, is hereby
Ordered and Decreed to be made as follows:
1. Murphy and France, attorneys $250.00
2. Eli Borovich $250.00
Total $500.00.
The Petitioner, Eli Borovich and Murphy and France,
attorneys, are hereby authorized to do any andall things necessary
to satisfy and settle the record at No. 179 and No. 180 September j
Term, 1966, A. D. in the Court of Common Pleas of Washington
County, Pennsylvania.
