PETITION TO SELL REAL ESTATE
SPECIALLY DEVISED
TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
The Petition of Mary Radlinsky respectfully represents:
1. That Filomena Pepe, the decedent, died on
December 7, 1968, leaving her Last Will and Testament, recorded in
Will Book 107, Page 22.
2. That your Petitioner was duly appointed Executrix
on the 13th day of December, 1968.
3. That the property described herein is in the estat
of the decedent but was specifically devised to Mary Radlinsky,
your Petitioner, and Emidio Pepe (See Paragraph SECOND of said
Will.)
4. That the said property has been appraised at a
value of $18,500.00, by two competent real estate brokers.
5. That the property is assessed for tax as follows:

The property is presently occupied and rented, but it
is in dire need of repairs. (The deceqent had begun said repairs
shortly before the accident which led to her death).
6. Your petitioner has offered said property for sale
to Emidio Pepe, the other party who is a specific legatee of this
property. Said Emidio Pepe has refused to purchase said property
at the appraised value.
7. In order to get cash with which to settle the
inheritance tax and to pay other administration expenses, one of
the properties left by decedent must be sold.
8. The only other ·major asset is property specificall~
devised to Joseph Pepe and Emidio Pepe; and there is no interest
by Joseph Pepe to have said property sold. Joseph Pepe having
offered to advance his share of the administration expenses to keel
the property and his interest therein together intact.
9. Your Petitioner'· has entered into an agreement of
sale with Charles Radlinsky at the price of $18,500.00 1 a copy of
which Agreement is attached as Exhibit 11 C 11 •
10. Your Petitioner~ as Executrix and as one of the
specific legatees is satisfied that· the price offered for the said
premises is better than can be obtained at a public sale and that
acceptance of it will be for the best interests and advantages of
the estate.
WHEREFORE, your Petitioner prays your Honorable Cour~
under the applicable provisions of the laws of Pennsylvania, for
leave and authority to sell and convey the premises aforesaid to
CHARLES RADLINSKY for the price of $18,500.00, in cash and.to hole
and apply the purchase ·money for the purposes of the estate, and
distribute the balance per Court and per the Will.
