PETITION NO· 1-s-~ 7 of 1968, ~ TO TIE HONORABLE, THE PRESIDENI' JUDJE OF SAID COURT: The Petition of Thomas Iaquinta respectfully represents that: : 1. Decedent is James Casciato, who formerly resided at 250 McKean AvenuE, Borough of Donora, Washington County, Pennsylvania. 2. Decedent died November 6th, 1968, at the Washington County Home, 2198 North :Main Street, City of Washington, Washington County, Pennsylvania. 3. At the time of his death, decedent was the holder of Savings Account Number 65-23230 in Mellon National Bank and Trust Company, Donora Office, in the sum of $1,000.00, and checking Account No. 451-3364 in Mellon National Bank and Trust Company, Donora Office, having a balance of $498.14. No vages were paid to your Petitioner or any other person under the provisions of Section 201 of the Fiduciaries Act of 1949, as amended. The Estate is not subject to a family exemption claim. •I 4. Attached hereto, marked Exhibit A, is Will of decedent dated Octobe 27th, 1967, Wherein decedent names your Petitioner, Thomas Iaquinta, as Executor of his Estate, and wherein decedent devises all his property and estate to Thomas Iaquinta and Julia F. Iaquinta, his wife. Petitioner and his wife both survived decedent, are sui juris, and reside together at 616 Cy ress Way, Donora, Pennsylvania. 5. Attached hereto, marked Exhibit B, is itemized bill for funeral services by Macik Funeral Home in the sum of $1,466.00; this bill is unpaid. There is also due to Arnold W. Hirsch, Attorney for your Petitioner, the sum . . of $?5.00 for legal services in settlement of this Estate, plus the cost of filing this Petition. 6. Attached hereto, marked Exhibit G, is bill of G. Ramaswa.rey, M.D., showing a balance of $100.00 due from decedent, after a payment of $400.00 on a surgical bill in 1966. Your Petitioner has made no inquiry concerning unpaid creditors, it being apparent that the funeral expenses and legal fees and costs of filing this Petition will exhaust the assets of the estate. WHEREFORE, Petitioner prays that the property described in paragraph 3 be awarded to him under the provisions of Section 202 of the Fiduciaries Act of 1949, P.L., 512, as amended, subject to payment of the funeral eA~ense~ and legal fees and costs set forth in paragraph 5 of this Petition. I, JAMES CASCIATO, of the Borough of Donora, Washington County, Pennsylvania, being of sound and disposing mind and memory, do hereby make, publish and declare this to be my Last Will and Testament, hereby revoking any and all former Wills or testamentary writings heretofore made by me. FIRST. I appoint Thomas Iaquinta, my good friend, as Executor of this, my Last Will and Testament. In the event that for any reason the said Thomas Iaquinta shall not assume or continue in his office as Executor, I appoint in his place or stead his wife, Julia F. Iaquinta. I direct that no bond shall be required of either of the appointees named in this paragraph. My said appointee, in addition to the powers conferred by law, shall have the power to sell at public or private sale to exchange or to lease, for any period of time, any real or personal property, and to give options for sales, exchanges or leases, for such prices and upon such terms or conditions as my said appointee shall deem proper. SECOND. I direct that all my just debts and funeral expenses be fully paid and satisfied as soon as conveniently may be after my death. THIRD. I give, devise and bequeath all my property, real, personal and mixed, wheresoever located and whether acquired before or after execution of this, my Last Will and Testament, to Thomas Iaquinta and Julia F. Iaquinta, his wife, or the survivor of them. FOURTH. I make no provision for my son, Richard Casciato, other than that set out in paragraph FIFTH below. I feel my estate will be a small one and Thomas Iaquinta and Julia F. Iaquinta, his wife, are entitled to receive it because of the many kindnesses and the care they have extended towards me. Also, the said Thomas Iaquinta and Julia F. Iaquinta, his wife, have agreed to see that I receive an appropriate burial using funds other than may pass through my estate, if necessary. E'XHt6rT A r I f .. J FIFTH. In the event that neither Thomas Iaquinta nor Julia F. Iaquinta, his wife, shall survive me I direct that my entire estate shall go to my son, Richard Casciato, provided that he shall see that I receive an appropriate funeral.
