SETTLEMENT OF A SMALL ESTATE
UNDER THE PROVISIONS OF THE
FI:DUCIARIES ACT of 1949,SECTION
202 AS AMENDED.
The Petition of WALTER S.WATERS,Executor of the Last Will
and Testament of Bessie B.Holmes,Deceased,repectfully repre-
sents:
1.The Decedent,Bessie B.Holmes died on the 13th.
day of August 1968,at the Charleroi-Monessen Hospital,Charleroi,
Washington County,Pennsylvania.
2.Your Petitioner,whose address is 344 State Street,
Clairton,Allegheny County,Pennsylvania,15025,is the Executor
of the Last Will and Testament of Bessie B.Holmes,Deceased.
3.That the Decedent,died unmarried and her only
legatee and heir at law was Dorothy James,a niece,of 526 Allen
Avenue,Donora,Washington County,Pennsylvania.
4.The Decedent left a Will dated July 16,1963,
which was probated on October 24,1968,and Letters Testamentary
were granted to your Petitioner,Walter S.Waters,by the Register
of Wills of Washington County,Pennsylvania,and attached hereto
and made a part hereof are the Letters of Administration and a
photostat copy of said Will.Said letters and Will are marked
Exhibit "A"and "B"respectively.

5.The property of the Decedent and the values of the
several items thereof is as follows:
(a)Savings Account deposited in the Mellon
National Bank &Trust Company,Donora,
Pa.
(b)Proceeds of insurance policy,
Metropolitan Life Insurance Co.

against the Estate of Bessie B.Holmes,other than those set forth
herein.
8.That the assets of the Decedent are not sufficient
to satisfy all the costs of administration and the funeral bill

9.That a copy of this Petition has been sent to the
unpaid beneficiary,heir or claimant,who has not joined in this
Petition and a copy of the notice and the return receipt card
showing delivery to the said beneficiary are attached hereto and
made a part hereof as Exhibit "0".
WHEREFORE,your Petitioner prays that the Court direct
distribution of the property of the decedent to pay all the costs
of administration and the balance of said Estate to be paid to
Walter S.Waters,Funeral Director,as part payment of the bill
presented by him for services rendered.

KNOW ALL MEN BY THESE PRESENTS:Whereas,at Washington,in the County aforesaid
on the 24th.day of October A.D.19 68 ,before me,
Ru sse 11 Marino ,Register for the Probate of Wills and Granting
Letters of Administration in and for the County of Washington,in the Commonwealth of Pennsylvania,
the last Will and Testament of
Bessie B.Holmes
late of Donora in the County aforesaid,deceased,
(a true copy whereof is to these presents annexed),was duly admitted to probate;and
Wal ter S.Waters
the Executor in said Will and Testament named,having appeared before me and taken and subscribed
the oath of office prescribed by law;
NOW,THEREFORE,I,Russell Marino ,Register as aforesaid,do
grant these LETTERS TESTAMENTARY,unto the said
Walter S.Waters
committing unto Him the administration of all and singula:r the goods and
chattels,rights and credits,which were of said deceased,and requiring Him
to exhibit a true and perfect inventory thereof into the Register's Office,at Washington,within ninety
days from the date hereof,and to render a just and true account of said administration at the expiration
of six months from the date hereof,and to regard and comply with the provisions of the laws of this
Commonwealth relating to inheritance taxes.
IN TESTIMONY WHEREOF,I have hereunto set my hand and the seal
of said Office at Washington,this 24th.

FIRST:r direct that all my just debts and funeral ex-
penses shall be paid as soon after my decease as can conveniently be
done.
SECOND:All the rest,residue and remainder of my es-
tate,whether real,personal or mixed,and wheresoever the same may
be situate at the time of my death,I give,devise and bequeath to my
niece,.Dorothy James.
THIRD:I do hereby constitute and appoint.Walter S.
Waters executor of this'my Last Will and Testament.

consideration of the Petition heretofore filed by Tempest &
Simmons,Attorneys for the Executor of the Last Will and Testa-
ment of Bessie B.Holmes,Deceased,and after due consideration
of the same,it is hereby Ordered and Decreed,as follows:
(a)That all the costs of administration be paid.
(b)That any balance remaining after the payment of
the administration expenses and attorneys fees,shall be paid to
Walter S.Waters,as a partial payment of the funeral bill.
(c)That Walter S.Waters,the Executor shall be dis-
charged after he has made all payments as directed by this Court
Order.
