TO THE HONORABLE,THE PRESIDENT JUDGE OF SAID COURT:
1.The petitioner,ANDREW LAWRENCE GAZVODA,is
an individual who resides at 722 Mill Street,Bridgeville,Pennsylvania.
15017,which is located in Allegheny County.Pennsylvania.
2.The Certification of Birth of the petitioner.being
No.735650,issued by the Department of Health.Bureau of Vital
Statistics.is attached hereto.made a part hereof and marked Exhibit
"A".The Certification of Birth incorrectly lists the name of the
petitioner as Andy Gazwella and incorrectly lists his date of birth as
July 16.1915.
3.The correct name of the petitioner,the name by
which he has been known since his birth and which is his correct name,
is Andrew Lawrence Gazvoda or Andrew L.Gazvoda.and he was actually

4.The petitioner is a male and he was the legitimate
child of Joseph Gazvoda,his father.and Mary Drop.the maiden name of
his mother.
5.The name of the father of the petitioner was Joseph
Gazvoda and he is deceased.
6.The petitioner belongs to the white race.
7.Joseph Gazvoda#the father of the petitioner#was
born as a citizen in the Austria-Hungary Empire#having been born in
1873#and the said Joseph Gazvoda#father of the petitioner#was age
41 when the petitioner was born.
8.The occupation of the father#Joseph Gazvoda#was
bricklayer for a mining company.
9.The mother of the petitioner#Mary Gazvoda#who
was born Mary Drop.is also deceased.She was born a native of the
Austria-Hungary Empire and she was 41 years of age when the
petitioner was born.
10.The mother and the father of the petitioner were both
of the white race.
n.The petitioner is presently employed by Cyclops
Corporation as a first heater helper.
12.The occupation of the mother of the petitioner was
housewife.Mary Gazvoda#mother of the petitioner#had ten children by
her husband#and six are now living including the petitioner.
13.The midwife who attended to the birth of the
petitioner is unknown.
14.The petitioner has been unable to locate his baptismal
record#and it is uncertain regarding the name of the church or the name
of the pastor by whom the baptism was conducted.

15.From the time of his birthl through grade schooll
and through his employmentl the petitionerl Andrew Lawrence Gazvodal
was known by this name and he has never been known by the name on
the Certification of Birthl Andy Gazwella.
WHEREFORE,the petitionerl ANDREW LAWRENCE
GAZVODA,respectfully requests your Honorable Court to correct the
Certification of Birth No.7356501 issued by the Department of Health,
Bureau of Vital Statistics1 Commonwealth of Pennsylvanial so that the
correct date of birth will read July 161 1914 and so that his name will be
correctly certified in a corrected birth certificate as ANDREW

DECREE

AND NOW,January 8,1969,pursuant to a hearing duly held on
Friday,December 6,1968,after proper notice given,and at which all
interested parties were present and represented by counsel,this Court finds
as follows:
1.That according to documentary and other substantial and sufficier t
evidence presented to the Court,a male child heretofore known as Andy
Gazwella was born July 16,1914,in the Village of Southview,Mt.Pleasant
Township,Washington County,Pennsylvania.
2.That the natural mother of said child,Mary Gazvoda (nee Mary
Drop)inadvertently supplied the authorities at the time of the birth of said
child with the information leading to the use of the name Andy Gazwella for
said child;this action was not a willful misrepresentation by the natural
mother of the said child but occurred by reason of the fact that the natural
mother was untutored in the English language and she and her husband had
emigrated from Austria-Hungary in Europe.The language barrier was the
cause of the incorrect listing of the name of her child.
3.There has been presented to the Court reliable documentary
evidence showing the proper birthdate of said child to be July 16,1914,and
the correct name of said child to be Andrew Lawrence Gazvoda.Said evidence
is as fo llows:
(a)PetitionerIS Exhibit No.1,hereto attached,being a photocopy
of a certificate issued by the Commonwealth of Pennsylvania,Department of
Mines,shoWing the competency and qualification of Andrew Gazvoda of
Southview,Pennsylvania,born July 16,1914,said certificate being dated
May 24,1938,and is therefore more than 30 years old.
(b)PetitionerIS Exhibit No.2,being a photocopy of the family
record,shoWing the full name Andrew Lawrence Gazvoda and date of birth
JUly 16,1914,at Southview,Pennsylvania.
(c)PetitionerIS Exhibit No.3,which is a photocopy of the marriag
record of the petitioner, listed as Andrew Gazvoda and being married in
Allegheny County,Pennsylvania.
(d)PetitionerIS Exhibit No.4,being photocopy of the certificate of
marriage issued by the Clerk of the Orphans I Court of Washington County,
Pennsylvania,numbered 7754,Series B,showing the marriage of Andrew L.
Gazvoda and Mary LaSavage,on July 2,1938,at Cecil,Pennsylvania.This
certificate wbuld now be more than 30 years old.
(e)Petitioner IS Exhibit No.5,being a photocopy of the local Draft
Board card for Andrew Gazvoda's son,Joseph Gazvoda;indicating that the
family name has always been Gazvoda.
(f)Petitioner's Exhibit No.6,which is a duplicate of a prior exhibi .
(g)Petitioner's Exhibit No.7,which is a photocopy of the short
certificate issued by S.A.Barnum,Register of Wills,on the death of Mrs.
Mary Gazvoda,mother of Andrew Gazvoda,who died November 23,1939,
testate,and Letters Testamentary were issued to her son,Andy Gazvoda.
Said certificate is dated December 16,1939,and is therefore almost 30 year
old.

(h)Petitioner's Exhibit No.8,which is a photocopy of a certificate
of award showing that Andrew Gazvoda,a pupil in the 8th grade of the Mt.
Pleasant Township public schools was awarded the certificate for faithful
attendance during the school term ending May 7,1931;this certificate shows
the proper name of the petitioner to be Andrew Gazvoda which name was bein
used in the public schools more than 35 years ago.
(i)Petitioner IS Exhibit No.9,which is a photocopy of pupil's readin
circle certificate issued to Andrew Gazvoda in the 7th grade of the Mt.
Pleasant Township public schools.The said certificate was dated at Hickory,
Pennsylvania,May 8,1930,and is therefore more than 38 years old.
(j)Petitioner's Exhibit No.10,which is a photocopy of a portion of
a life insurance policy issued by the Prudential Insurance Company of Americ
on October 22,1945,to a daughter of the petitioner;the petitioner who is the
beneficiary in said policy is Andrew Gazvoda,father of the insured,and the
mother,Mary B.Gazvoda,who is the secondary beneficiary;this paper is
now more than 23 years old.
4.That the said child was of legitimate birth and that the surname 0
said minor child should be changed to reflect the proper surname of the paren s,
which was Gazvoda.
NOW,THEREFORE,under authority of Section 301 (15)of the Orpha
Court Act of August 10,1951,P.L.1163,as amended by the Act of August 4
1955,P.L.302,and Acts of 1957 and 1959,it is
ORDERED AND DECREED
that the Chief,Division of Vital Statistics and State Registrar of the Departm t
of Health of the Commonwealth of Pennsylvania,shall correct and amend the
birth record for said child,being No.735650,File No.110576-15,filed in

said office July 20,1915,for the said Andy Gazwella,so that the name of the
said minor child shall be changed to Andrew Lawrence Gazvoda;that the
birthdate of said child shall be made to appear as July 16,1914;that the
mai.den name of the mother of said child shall remain as heretofore reported;
that the name of the natural father of said child shall be changed so that it wil
appear as Joe Gazvoda;that all other matters therein contained shall remain
as originally reported and entered.
