Number 1454 of 1968,the estate of Harry R.Currc n,
If Your Honor please,I have 'all of the necessary
papers here.There are not specifically com plications in this
estate,but I would ask for a reaward of a certain portion of the
estate.We have made a payment on the Pennsylvania Transfer
Inheritance Tax and the balance that would be due there wo uld have
to be calculated and paid.There is also to be filed a Federal Estate
Tax Return and that has not yet been done.One of the reasons'"I

reasons for the non-filing of that has been that the decedent had
an interest in his mother's estate and his father's estate.Those
estates were never officially opened,nor was any proceedings taken
on them until we dis covered his int erest in both personalty and
real estate.Those are in process but have not been completed.
In addition,I am asking for the reaward of cashl personalty.and
stock for the purpose of paying approximate Federal Estate Tax
in the amount of $9.000.00 which we calculate as well as the balance
due for any attorney's commission or Executor's fee.I am asking
f or a reaward of these items as well as some shares of stocks
in General.Motors .

The petition of John M.Porter,Jr.respectfully
represents:
1.That Harry R.Curran died,testate,on November
2,1958,a resident of the City of Washington,Washington County
Pennsylvania,a copy of said decedent's Will being attached
hereto and marked Exhibit "A".
2.That your petitioner,John M.Porter,Jr.was
named as Executor of said Will,qualified,and Letters Testamen-
tary were duly issued on November 8,1968.
3.That an Inventory and Appraisement in said deceden 's
estat,e was filed on May 29,1969,showing total assets of
$135,851.2776,the real estate which is the subject of this
petition valued at date of death at $500.00,and was assessed
by the County Assessor at a total value of $1,115.00,Certifi-
cates of Assessment being attached hereto and marked Exhibits
"B"a,nd "C".(The Assessment has not yet been changed to
reflect the fact that dwellings assessed on the unnumbered lot
hereinafter described have burned down.)

4.Included in the inventory,inter alia,is the
following described real estate:
TRACT NO.1:All that certain lot of ground situate in
Canton Township,Washington County,Pennsylvania,bounded and
described as follows:
BEGINNING at a post on Caldwell Avenue on the West
line of property now or formerly of J.R.Eagon;
thence North 86 degrees West,along Caldwell Avenue,
40 feet to a stake;thence North 4 degrees East,
182 feet 8 inches to property now or formerly of
Gordon Land Company;thence South 78 degrees East to
a post on line of property now or formerly of J.R.
Eagon;thence on line of aforesaid property of J.R.
Eagon,South 16 degrees West,175 feet to place of
beginning.
BEING same premises conveyed by George L.Hayes
and Anna M.Hayes,his wife,to Harry Curran,by deed dated
March 5,1923,and recorded in the Recorder's Office in and for
Washington County,Pennsylvania,in Deed Book 506,page 272.
Upon the above lot there is erected the remains of
two burned-out dwellings and a garage.
TRACT No.2:ALL those four certain lots numbered 3,23,46,
and 63 in the Scottdale Plan of Lots,said plan being of record
in the Recorder's Office in and for Washington County,Pennsyl-
vania,in Plan Book 1,page 172,and situate in Canton Township,
Washington County,Pennsylvania.
UNDER and SUBJECT to the same exceptions,reservations,
and conditions set forth or mentioned in deeds in the chain of
title.
Lot No.3 being the same lot conveyed by Washington
County Tax Claim Bureau to Harry R.Curran,by deed dated
January 25,1966~and recorded in Deed Book 1230,page 224.
Lot No.23 being the same lot conveyed by Washington
County Tax Claim Bureau to Harry Reid Curran,by deed dated
April 21,1967,and recorded in Deed Book 1256,page 488.
Lot No.46 being the same lot conveyed by Washington
COULty Tax Claim Bureau to Harry Reid Curran,by deed dated May
19,1967,and recorded in Deed Book 1258,page 119.
Lot No.63 being the same lot conveyed by Washington
County Tax Claim Bureau to Harry Reid Curran,by deed dated

The petition of Frank Florian,Jr.by his counsel,Fergus.
Martin and Fergus,respectfully represents as follows:
1.Frank Florian,Jr.,your petitioner.is a devisee under the

will of Harry R.Curran and resides at 66 Lenape Park,Westfield,Newt
Jersey 07090.
2.Harry R.Curran died November 2nd,1968 and Letters
Testamentary were granted.o,:November 8th.1968 to John M.Porter,Jr.
3.An Inventory ,and First and Partial Account was filed and
proceeded to audit on September 12th,1969.
4.On October 24th,1969 your Honorable Court.P.V.
Marino.President Judge presiding,filed an Adjudication and Decree in
which $79,980.03 of assets were reawarded to John M.Porter.J,r.for
further accounting.
5.Your petitioner avers that no final accounting of the adminis-
tration of said estate has been provided to your petitioner.
WHEREFORE,showing as above,your petitioner prays your
Honorable Court to issue a citation to the said John M.Porter,Jr.

for future accounting was $39,552.61,consisting of stock,cash,real estate
and interest in two other estates which have not yet been closed.
5.Admitted,but the petitioner never requested any final accounting
and no final accounting had been made by virtue of the fact that no disposition
had been made of the claim of Elizabeth C.Florian,which claim was filed at
the time of the original audit in 1969,and by virtue of the fact that Citations
had been issued against Elizabeth C.Florian as Administratrix of the Estate of
Hugh Curran,and no accounting or hearing has been held in this matter.
6.Attached to this Answer is a copy of an accounting of the reaward~
ing of the assets in the year 1969 with the expenses which have been incurred
and paid,which shows that the Executor of the Estate has available $101.20 in
cash,a 3/20 interest in real estate in Canton Township valued at $100.00,a
1/5 interest in personalty of the Hugh Curran Estate and a 1/8 interest in the
personalty of the Mary Curran Estate,and this accounting has been supplied to
all of the heirs by regular mail at their last known adresses.
WHEREFORE,showing as above,the Executor requests that the Citation

The said Mary Curran died March 26,1951,testate,wherein by her Last Will
and Testament she devised all the rest,residue and remainder of her estate unto
the children living at her death,those being Harry Reid Curran,James William
Curran,Joseph Hugh Curran,John Francis Curran,Thomas Edwin Curran,Elizabeth
C.Florian,Sara Anne Wagner and Mary Helen Porter.The said James William
Curran died June 17,1964,intestate,leaving to survive him a daughter,
Harriet Bondi,and all of his interest in the above properties vested in his
daughter.The said Thomas Edwin Curran died July 11,1966,intestate,leaving
no children surviving but leaving a wife,Ada Curran.The said Joseph Hugh
Curran died April 6,1968,intestate,survived by the following five named
brothers and sisters:Harry Reid Curran,John Francis Curran,Elizabeth C.
Florian,Sara Anne Wagner and Mary Helen Porter.Upon the death of Harry Curran,
he received from the above estates a 1/8 of a 2/3 interest from Hugh Curran;a
1/8 of a 1/3 interest from Mary Curran;a 1/5 of a 1/8 interest from Joseph

On June 16,1976,the following persons met with Judge Simmons in
Chambers:
1.John M.Porter,Jr.as Executor of the Estate of Harry R.Curran;
2.Frank C.Carroll as Attorney for the Estate of Harry R.Curran;
3.John M.Porter,Jr.as Executor of the Estate of Helen C.Porter;
4.Elizabeth I.Florian as Executrix of the Estate of Mary Curran;
5.Elizabeth C.Florian as Administratrix of the Estate of Hugh Currln;
6.Harold V.Fergus and James C.Bane as Attorneys for Elizabeth I.
Florian,a/k/a Elizabeth C.Florian;and
7.Frank Florian,Jr.
The purpose of the conference was to delineate the facts and issues
relating to a claim filed by Mrs.Florian against the Estate of Harry R.Curran
for an accounting of rental monies from property in the Estate of Hugh Curran;
to deal with the,claim filed by Frank Florian,Jr.claiming that there was not
a complete accounting;objecting to a loss in the value of stock in the amount
of $6,636.37;and a claim contending the attorneys'fees and Executor's
commission were not proper.
At the same time John M~Porter,Jr.had filed against the Estate of
Hugh Curran and the Estate of Mary Curran a .C~tationl requesting the filing
of an account relating to monies had and received by E~izabeth Florian over
the years in her capacity as fiduciary.
The Court,after much discussion and review,requested the parties
to consider the settling of all calims against the respective estates and to
execute Releases for that purpose.It.developed that there were three (3)
parcels of property in the Hugh Curran and Mary Curran Estates being sold to
a Georgia Wormsley.The property known as 100 Caldwell Avenue was being sold
for $3,000.00;the property at McGovern Avenue,consisting of Lot No.1 in the
Scotdale Plan and Lot No.2 in the Scotdale Plan,was being sold for the price
of $2,500.00;the property at 116 ·and 118 Caldwell Avenue was being sold for

$3,800.00.The total consideration was'thEm $9,300.00'.Of the monies above
referred to,it became apparent that Sherman Siegel,Attorney for.Georgia
Wormsle~had in his possession $1,500.00 applicable to the McGovern Avenue
property and that George Lenk (now deceased)had funds i~the amount of $1,000.00.
Mrs.Wornsley had in her possession $3,800.00 to pay for the property at 116-
118 Caldwell Avenue.George Lenk (now deceased)had in his possession $3,000.00
for the property at 100 Caldwell Avenue;
It was agreed in the pre-trial conference that each fiduciary would
not seek an accounting against ·the other and that Frank Florian,Jr.would
withdraw his claims and that there would be executed a mutual release except
as to the properties being sold and the monies to be realized therefrom in the
sum of $9,300.00.
Thereupon all of the parties went to the office of Harold Fergus to
reduce the agreement to writing.The agreement was reduced to writing including
a release by all of the fiduciaries to each other and a release of the claim
of Frank Florian,Jr.against the Estate of Harry Curran.At that time,and
just prior thereto,an issue was raised as to'whether or not the funds,
$9,300.00,were all available.Mrs.Florian and Frank Florian,Jr.did not want
to sign any agreement without knowing where these funds were located.It was
agreed that both Harold Fergus and Frank C.Carroll would attempt to contact t~e
various parties,and lawyers,to determine the status of the funds.The partils
then left the office at approximately 5:00 to 5:15 p.m.Prior to leaving it
was agreed that the parties would meet again for signature purposes at 2:00
p.m.the following day.
On the morning of June 17,it was discovered as follows:

applicable to the property at 48 McGovern Avenue;
Mrs.Wormsley has $3,800.00 for the purchase of 116-118 Caldwell rve;
Sam Goldfarb,Esq.has in,his possession,rep~esenting the Estate
of George Lenk,$3,000.00,applicable to the property at
100 Caldwell Avenue.. .

HaroLd Fergus to execute the releases at approximately 1:30 p.m.on June 17.
