To assets in the control of Charles G.Suhrie,Jr.,
Administrator D.B.N.C.T.A,balance of real
estate in California Borough (formerly East Pike
Run Township)washington County,_Pennsylvania.
(Originally appraised at $4,500.00 in 1926;
specific performance of a porticn of the tract
to Goldie L.Conaway,,during course of original
administration,and apparently this portion not
included in appraised value of real estate,
as proceeds of specific performance sale were
accounted for as personalty;sale of 2.794 acres
to Dominic F.Turturice,et UX.,deed dated
July 7,1950,recorded in Deed Book 769,at page
529,for $500.00.)
NOTE:All other cash assets were
consumed by life tenants during their lifetimes.

PETITION TO DETERMINE AND APPROVE TITLE TO REAL
ESTATE;AND TO APPROVE SALE OF REAL ESTATE TO
CHARLES G.SUHRIE,JR.
TO THE HONORABLE,THE JUDGE OF ~HE SAID COURT:
The Petition of Charles G.SUhrie,Jr.,respectfully
repre se nt s :
1.That Ellen D.Suhrie,a/k/a Ella D.Suhrie,died
testate on February 21,1~26,seized in fee of a tract of real
estate in California Borough (formerly East Pike Run Township),
'washington County,Pennsylvania,a description of said real estate
being attached hereto and made a part hereof.
2.By appropriate proceedings in the Orphans Court of
washington County,Pennsylvania,at No.91 August Term,1926,a
portion of the said described tract was conveyed to Goldie L.
Conaway,the Conaway tract bein5 comprised of approximately Ii
acres,more or less,and being more particularly described in the
Order of Court,dated September 20,1926,at the aforesaid number
and term,and being further described in the deed from George H.
Suhrie,Executor of the Estate of Ellen D.Suhrie to the said
Goldie L.Conaway,dated October 4,1926,and recorded in the
Recorderts Office of Washington County,Pennsylvania,in Deed
Book 541,at page 539.

3.In accordance with proceedings at No.38 May Term,
1950,in the Orphans Court of Washington County,Pennsylvania,
a 2.794 acre tract was conveyed to Dominic F.Turturice and
Martha Turturice,his wife,the description of said premises
being fully set forth in said proceedings,and also being set
forth in the deed from Charles 3uhrie,et al.,to Dominic F.
Turturice and Martha Turturice,his wife,dated July 7,1950,and
recorded in Deed Book 769,at page 529.
4.That under the will of the said decedent,Ellen D.
Suhrie,a/k/a Ella D.SUhrie,deceased,dated March,,1917,and
probated in the Register of Wills Office of washington County,
Pennsylvania,in Will Book 40,at page 261,all of the real
estate of which Ellen D.Suhrie,a/k/a Ella D.Suhrie,died
seized in fee simple,was devised to Charles Suhrie (son of the
said decedent)and to George H.Suhrie (husband of said decedent)
for their joint lives,and on their decease to the children of
Mabel Devere Ritter (daughter of said decedent)and the heirs of
Charles Suhrie (son of said decedent)in equal proportions.A
copy of said will is attached hereto marked Exhibit VAl',and
made a part hereof.
5.That the said George H.SUhrie,one of the life
tenants aforesaid,died on June 4,1935.
6.That the said Charles Suhrie,one of the life

7.That your petiticner,Charles G.Suhrie,Jr.,was
appointed Administrator D.B.N.C.T.A.of the estate of
Ellen D.SUhrie,a/k/a Ella D.Suhrie,deceased,on November 1,
1968.

8.That the said Mabel Devere Ritter died intestate
on July 22,1957,and the only children born to her were Mignon S.
Ritter,George Ritter and Catherine D.Ritter,now inter-married
with Mark W.Huffman9 The said Mignon S.Ritter died in 1931,
unmarried,intestate,and witho~t issue,leaving to survive her

Will and Testament was probated in the County Judgets Court in
and for Brevard County,Florida,A certified copy of said is
attached hereto and made a part hereof as Exhibit lIB1~.By the
provisions of Paragraph (FIFTH)of his Last Will and Testament,
any interest that Clifton W.Ritter would have had in the Ellen D.
Suhrie property,by virtue of him being the surviving parent of
Mignon S.Ritter,deceased,was devised to George Ritter and
Catherine D.Ritter Huffman.

in interest,and the names of their spouses,all of whom are

Ritter and Catherine Ritter Huffman.
12.That it is the opinion of your petitioner that
the title to said real estate is now vested in himself,Catherine
D.Ritter Huffman,and George Ritter,but that,due to the
ambigious wording of the will of the said Ellen D.Suhrie,a/k/a
Ella D.Suhrie,deceased,the precise shares of the said Charles
G.SUhrie,Jr.,Catherine Ritter Huffman,and George Ritter,
are not readily determineable,except upon a finding by your
Honorable Court,or in the alte~native,upon an amicable agreement
among the said Charles G.SUhrie,Jr.,Catherine Ritter Huffman,
and George Ritter.
13.That the said Charles G.Suhrie,Jr.,Catherine
Ritter Huffman,and George Ritter,have mutually and amicably
agreed that,subject to the approval of your Honorable Court,
each shall have an undivided 1/3 interest in the said real estate.
That the said Charles G.SUhrie,Jr.,Catherine Ritter Huffman
and George Ritter have further agreed that the said Catherine
Ritter Huffman and George Ritter will convey all their right,

Huffman,would be indefeasible by any person ascertained or
unascertained,or any class of persons having a present or
expectant interest in said real estate,and unprejudiced by any
error in the proceedings of the Court.
15.That there are no other assets in the estate

all personal property having been exhausted by the life tenants
during their lifetime.
