~ounty and state,personally appeared JAMES C.BANE,Who,first
having been duly sworn according to law,deposes and says:
1.That he is the Attorney for the Estate of Samuel o.
Leyda,a/k/a Samuel Oakley Leyda,a/k/a S.O.Leyda,a/k/a Sam
Leyda,Deceased;
2.That following receipt by him of the Order and
Schedule of Distribution,dated February 20,1969,he forwarded tc
Harry G.Leyda,a check signed by Irma Jean Griffith,Executrix,
in the amount of $1,559.17,together with a Distribution Receipt
on April 3,1969.
3.That the said Harry G.Leyda endorsed the check
sent to him but has failed and still fails and refuses to return
the Distribution Receipt properly signed by htm to your affiant
or to the Executri~of the Estate.
4.That on May 6,1969,your affiant wrote to the said
Harry G.Leyda requesting that the Distribution Receipt be returnEd
but has not received an answer to said letter.
5.That on May 21,1969,1he affiant again wrote to
Harry G.Leyda and enclosed another Distribution Receipt which he
requested the said Harry G.Leyda to execute and return.

6.That when the Executrix received her cancelled
checks from the bank she found that the said Harry G.Leyda had
written on said check "partial payment"which he had no right to
do,as said payment was in full payment of the amount awarded by
this Court.
The purpose of this Affidavit is to show that distribu-
tion has been properly made to the said Harry G.Leyda in accord ce
wi th the Schedule of Distribution handed down by the Orphans'
Court.
