.PETITION FOR SETTLEMENT OF
SMALL ESTATE
TO THE HONORAB.LE, P. V. MARINO, PRESIDENT JUDGE OF SAID COURT:
The Petition of Fred P. Nourigat respectfully
represents:
1. He is the son of John L. Nourigat, the above-
captioned decedent, who died May 2, 1967, intestate, survived
by his wife, Minnie Ariel Nourigat, and two children, of which
your Petitioner is the eldest.
2. Decedent left no estate in his own right, his
holdings being with his wife, as tenants by the entireties.
3. Minnie Ar~el Nourigat, surviving spouse of
decedent, paid the funeral for the burial of her husband, to E.
G. Wilson, Funeral Director, in June, 1967, in the amount of
$1,350.00.
4. After considerable negotiation with the United
Mine Workers of America, members of decedent's family have
received a compensation check in the nature of an award for silico~is
in the amount of $1,129.84, from the Commonwealth of Pennsylvania,
dated September 17, 1968, made payable to the Estate.of John L •
. Nourigat; said check constitutes the only asset in the Estate of •
John L. Nourigat, and it is not contemplated.that there will be
further advancements or other items coming into the said John L.
Nourigate Estate.

5. Because of the excess of the funeral debt over the
amount of the check and because the said funeral debt has been
paid by Minnie Ariel Nourigat, the decedent's wife, there should
be no Inheritance Tax due to the Commonwealth of Pennsylvania.
6. The person entitled to receive the decedent's net
estate is his wife, Ninnie Ariel Nourigat, because of her
payment of the funeral debt.
7. The Petitioner requests the Court, pursuant.to
Section 202 of the Fiduciary's Act of April 18, 1949, P.L. 512,
as amended (20 P.S. Par.320.202) to award distribution of the
estate of the decedent to the widow, Minnie Ariel Nourigat.

AND NOW, TO-WIT, this

1968, the within Petition, filed in open Court, and upon motion
of Joseph .C. Ralston, Esq., Attorney for Petitioner, the same
is hereby ordered filed and the check received from the
Connnonwealth of Pennsylvania, dated September 1_7, 1968, in the
sum of $1 ;129. ·84, is hereby ordered to Minnie ,Ariel Nourigat,
on account·of her payment of the funeral expenses of her husband,
John L. Nourigat, Deceased, and the Pittsburgh National Bank,
McDonald Office, is hereby ordered to receive said deposit to
the Estate of John L~ Nourigat, the amount of said check to be
deposited in the deposit account of Minnie Ariel Nourigat.
