V. MARINO, PRESIDENT JUDGE OF SAID COURT: The petition of AUGUST W. PASTOR and ROBERT E. ANDERSON respectfully represents: 1. That Gus Pastor, late of Jefferson Township, Washington County, Pennsylvania, _died, testate, on December 12, 1965, and by his Will, of record in the Office of the Register of Wills of Washington County, Pennsylvania, in Will Book 101, page 437, he ' '~ . ' devised and bequeathed all his estate to his wife, Sophia Pastor, upon his daughter, Agnes Ann Pastor, arriving at the age o~ eigh- teen years, and the said Agnes Ann Pastor was more than eighteen years of age at the time of decedent's death . . 2. Anderson,-your.petitioners, upon the filing of a • ' f bond in the amount of _$6,000.00, with-Hartford Accident & Indemnit Company as surety, after Pittsburgh National Bank renounced its right to act as Executor under the Will of said decedent. 3. That your petitioners have filed of record an ·Inventory and Appraisement of the assets ·of the Estate of Gus Pastor, de- ceased, showing assets in the total amount of $12,452.25. A copy of said Inventory and Appraisement is hereto at_tached, and marked Exhibit "A". ,; 4. That among the·assets of'said decedent's estate is an . -' undivided one-half -(1/2) interest in the following real estate: ' ·-ALL that certain tract of land situate in Jefferson Township,'Washington· County, Penn- sylvania, bounded and described as. follows: ' . . ., ' BEGINNING at a stone common to lands now or late of Wesley Gillespie, David Perrine Heirs, and W. A. Cole; thence by lands of said W. -A. Cole, North 8° 38' West 2620.4 feet to a point; thence North 79t0 East 463.87 feet to a stone above the road, corner of lands now or late of Barber Heirs; thence North 56~0 East 1055 feet to a white oak; thence North 71~0 East 693 feet to a white oak stump; thence North 64° East 180 feet to a white oak; thence by land now or late of Henry C. Cooper, South 16° West 1813 feet to a stone; thence South 20° 06' West 1696 feet to a stone; thence South 59° East 404 feet to a stake 4 feet from a white oak; thence by land now or late of Mary Cunningham, South 64t0 West 25 feet to ~ black oak stump; thence by land now or late of Wesley Gillespie, South 59~0 West 367 feet to a stone; thence North 45~0 West 491 feet to a stone, the place of beginning. CONTAINING 100 acres. EXCEPTING AND RESERVING therefrom the Pittsburgh or River Vein or Seam of Coal, together with the mining rights, as reserved in prior deeds. BEING the same premises as conveyed by Frank Pastor and Emilie Pastor, his wife, to Gus Pastor and Frank Pastor by deed dated June ·6, 1930, and of record in the Recorder's Office of Washington County, Pennsylvania, in Deed Book 568, page 561, subject to life estate in said grantors. AND the said Frank Pastor died April 26, 1944, and the said Emilie Pastor died May 13, 1935. 5. That the aforesaid real estate is assessed for tax pur- poses by the County Commissioners in the sum of $4,845.00. A Certificate of said assessment is attached hereto, and marked Exhibit "B". 6. That the only party in interest in the Estate of Gus Pastor, deceased, is his wife, Sophia Pastor, inasmuch as Agnes Ann Pastor, daughter of decedent, had attained the age of eighteen years prior to his death" she having been born July 19, 1945. 7. That your petitioners believe the settlement of the Estate of Gus Pastor, deceased, will be facilitated_if the assets thereof are converted into.cash. 8. That Frank Dale Pastor has agreed to purchase the un- divided one-half interest of said decedent in the property described in.paragraph 4 hereof for the sum of $7,500.00, and pay cash therefor. 9. That attached hereto are;)Affidavits of two responsible persons familiar with the value of real estate in Jefferson.Town- ship, Washington County, Pennsylvania, and with the value of the property proposed to be sold, setting forth that the price of $7,500.00 is a fair and reasonable price for the undivided one- half interest of the decedent therein. Said Affidavits are marked Exhibits "C" and "D". 10. That there are no liens of record of any nature known to your petitioners, and all debts of the decedent or his estate have been paid or provided for. WHEREFORE, your petitioners request your Honorable Court to .
