D. 19 68 , before me, Russell Marino , Register for the Probate of Wills and Granting Letters of Administration in and for the County of \71,1 ashington, in the Commonwealth of Pennsylvania, the last Will and Testament of LOU R. WHITE, aka LOUISA R. WHITE, LOU RAMAGE WHITE, LOUISA RAMAGE, WHITE, and LOUISA B. WHITE and LOUISA BETHEL WHITE, late of Borough of Claysville, in the County aforesaid, deceased, (a true copy whereof is to these presents annexed), was duly admitted to probate; and GEORGE R. WHITE and WILLIAM F. A. WHITE, the Executor Sin said Will and Testament named, having appeared before me and taken and subscribed the oath of office prescribed by law; NOW, THEREFORE, I, Russell Marino , Register as aforesaid, do grant these LETTERS TESTAMENTARY, unto the said GEORGE R. WHITE and WILLIAM F. A. WHITE, committing unto t hem the administration of all and singular the goods and chattels, rights and credits, which were of said deceased, and requiring them to exhibit a true .and perfect inventory thereof into the Register's Office, at Washington, within ninety days from the date hereof, and to render a just and true account of said administration at the expiration of six months from the date hereof, and to regard and comply with the provisions of the laws of this Commonwealth relating to inheritance taxes. White, widow, domiciled at the Borough of Claysville, Washington County, Pennsylvania, being of sound and disposing mind, memory and understandink, hereby make, publish and declare this my last will and testament (hereby revoking any t~stamentary writing or writings by me heretofore made) in manner and for~ following, to-wit: 1. ·I give and bequeath to my grandson$., William White, George White and Samuel White, each the sum of One Thousand Dollars ($1000.00), free:of all tax, to be used primarily for educational purposes; and I appoint my son, George R. White, as testamentary guardian of each of said grandsons during minority, to serve with- out bond and without liability to account in any court. 2 ·• I give and bequeath to the Claysville Methodist Church, or any successor thereof by merger or otherwise, the sum of Five Hundred Dollars ($500.00), free of all tax, to. be used for general purposes. 3. I give and bequeath to each of my brothers· and sisters, to-wit, John M. Ramage, R., Bruce Ramage, William L. Ramage, Margaret B. Mealy and Sarah R. McPherson, if he oi she survives me, the sum of Two Thousand Dollars ($2000.00), free of ail tax. 4. I give, devise and bequeath all the residue of my estate, of whatsoever kind, wheresoever situate to my sons, George R. White • and William F. A. White, in equal shares. 6. I hereby make, constitute and appoint my said sons, George R. White and William F. A. White, as executors of this my will, to serve without bond, in any jurisdiction or jurisdictions • this . Petitioners 'are the duly appointed, qualified, and acting executors of the will of Lou R. White, the above named decedent, late of the ~orough of Claysville, Washington County, Pennsylvania. Letters testamentary upon the estate of said decedent were issued to petitioner-shy the Register of Wills of Washington County, Pennsylvania, on October 11, 1968. 2. Petitioners are residuary legatees and devisees in equfll shares of the estate of said decedent, being sons and the only children of said decedent (her; husband having pre- deceased her in 1952), in and by the provisions of decedent's will probated and of record in the office of said Register of Wills in Will Book 106, p~ge 395. ). The first and final account of petitioners as such executors was filed in your Honorable Court on July 23, 1969, to No. 6)-68-1)18, upon which an audit hearing was held on September 9, 1969, and the same is pending and undetermined. All other legacies provided for in said wtll have been paid in full, as well as all known claims, except for possible tax claims,. hereinafter more fully referred to, and except for tax claimants, petitioners are' the only parties in interest in relation to the matters comprehended in this petition. -1- 4. An United States estate tax return has been filed at the office of the Internal Revenue Service at Pitts- burgh, Penns.ylvania, showing no estate tax to be due from the estate of said decedent to the United States (which return has not been audited), and it is believed and therefore averred that no such tax is in fact due. The sum of $2,500.00 was paid on account of transfer tax to the Commonwealth of Pennsylvania on Decembe~ 23, 1968, thus giving a credit of $2,631.58 on such tax, and it ~s believed and the~efore averred that the balance due on such transfer tax on the estate of said decedent will not exceed $1,000.00. In the petition sur audit, petitioners have prayed that your Honorable Court decree distribution to them of the residue, subje~ to tax claims. 5. At the time of her death on September 26, 1968, said decedent was the record owner of an undivided one-third interest in two parcels of real estate, although having no beneficial interest therein, described as follows, to wit: ONE. All that certain tract of land situate in the Borough of Clays•rille, Washington County, Pennsylvania, boun~ed and described as follows, to wit: Beginning at a point in the northerly line of North Alley 100 feet southwesterly from the northwest intersection of the nor~herly line of North Alley and the westerly line of Highland Avenue (formerly White Oak Alley~ thence south 63 degrees 45 minutes west along the northerly line of North Alley 120 feet to a point; thence by land of Della M. Vance and Richard M. Sprowls along old division fence nort:"l 26 degrees 15 min·.ltes west 235 feet to a point; thence in a northerly direction along the easterly line of an unopened 16-foot alley and land formerly of T. B. Craig, now or late of Lewis Miller and others approximately 300 feet to a point in the 3outherly line of Elm Street extension, sometimes referred to as a 10-foot alley; thence in a northeasterly direction -2- along the southeasterly line of said street or alley ar:proximately 130 fee,t to a point at the northwest corner of lot of Richard M. Sprowls 100 feet distant from the westerly line of Highland Avenue; thence south 26 degrees 15 minutes east along the westerly or rear lines of divers lots fronting on Highland Avenue, formerly one tract of M. A. and T. S. Irwin., a· distance of approximately 632 feet to a point, the place of beginning. Containing about 1~ acres. Being composed of three parcels conveyed to Simon White, decedent's predecessor in title, by deed of D. H. Shiplet, dated June 19, 1899, and recorded in the Recorder's Office of Washingtoq County, Pennsylvania, in Deed Book 213, page 5S6; deed of D. H. Shiplet, dated November 14, 1902, and recorded in said Recorder's Office in Deed Book 836, page SS6; and deed of Joseph T. Bebout, dated , 1910, and. recorded in said Recorder's O~fice in Deed Book 381, page 28. TWO. All that certain lot of ground situate in the First Ward, City of Washington, Washington C·:>unty, ·Pennsylvania, fronting SO feet on the south side of West Maiden Street, bounded and described as follows, to wit: Beginning at a point on the south side of West Maiden Street, in line of land now or late of Owen Murphy; thence westwa~dly along line of said street SO feet to a point; thence southwardly by the Armory property of the Commonwealth of Pennsylvania 240 feet more or less,to an alley; thence eastwardly along the northern line of said alley SO feet to line of property now or late of Owen Murphy; thence by said Murphy's line northlmrdly 240 feet more or less to a point, the place of beginning. -3- 6. Said decedent became owner of such undivided one- third interest in said parcels of real estate, as one of three residuary devisees (the other two devisees and tenants in com- mon each having an undivided one-third interest being petitioners, who were the sons and only children of on'e: Samuel D. White), under the will of her husband, said~Samuel D. White, who died January 4, 1952, and whose will was probated and is of record in the office of said Register of Wills in Will Book 78, page 21; and by distributio~ decree of your Honorable Court dated November 3, 1952, filed to No. 279 of 1952, A. A., and recorded in said Recorder's Office in Deed Book 849, page 381. 7. The said Samuel B. White was at his death sole proprietor of a cemetery monument manufacturing business, which he operated upon the two tracts of real estate above described. He was the son of Simon White, who acquired the tract described above as ''ONE," situate at Claysville, Pennsylvania, and who like- wise operated such a business upon the same. 8. The said Samuel D. White provided in his will for continuation of said business by his wife and sons, and they formed a co-partnership as equal owners, and continued said business upon said premises, which was devoted exclusively to said firm business and carried on its books as a firm asset. 9. In the year 1964, the said Lou R. White, being then upwards of 85 years of age, retired from said co-partnership, and sold all her interest therein to the other two--co-partners, petitioners herein, by written agreement, effective January 1, 1964, for the price of $70,110.44, of which $17,610.44 was paid in cash and the balance of the purchase price was evidenced by a note of the continuing partners in the sum of $52,500.00. Thereafter petitioners, co-partners as aforesaid, continued said business and used and occupied said real estate therein, to the present time. -4- i' 10. The two tracts of land above described were carried as firm assets on the books of said firm at and before such dissolution, and the purchase price aforesaid was calculated thereon and was intended to pay for the conveyance of said decedent's interest in them, as well as for her interest in other assets of the firm, but delivery of a deed of conveyance was deferred pending payment in full of said note, as appears by letter of Main LaFrentz & Co., accountants and auditors for the firm, marked Exhibit "An attached hereto and made part hereof. 11. At the time of the death of said decedent, petitioners owed said decedent the sum of $5,500.00 balance upon the principal of said note, which sum they thereafter paid in full to the estate of said decedent, as appears by inventory and appraisement of the estate of said decedent filed in said Register's Office in Inventory and Appraisement Book 80, page ·~ 232; and which debt of $5,500.00 appears as an asset of the said estate in the several tax returns filed as aforesaid. 12. Petitioners believe and therefore aver that said two tracts of land are not proper assets of the estate of said decedent, and are not subject to distribution therein nor subject to tax thereon; and they have given notice of such position to the Internal Revenue Service in the estate tax return filed as aforesaid, as appears by true copies of pages 7A and 7B of Schedule A of such return showing such claim, marked Exhibit "B'~ attached hereto and made part hereof, and to the Commonwealth of PenLsylvania, as appears by true copy of a portion of Schedule "A" of transfer tax return showing such claim, marked &xhibit "C 11 attached hereto and made part hereof. 13. Petitioners aver they are entitled to have a proper deed of conveyance made so as to show record title in them, legal and beneficial, of. the said decedent's apparent one-third interest in the two tracts of real estate described above. -5- WHEREFORE, showing as above, petitioners respect- fully pray that your Honorable Court, pursuant to section 546 of the Fiduciaries Act of 1947, 20 PS 320.546, direct the Clerk to execute and deliver to petitioners a deed conveying such land to petitioners, at their costs.
