MARINO, PRESIDENT JUDGE: ~· , 1968, comes the Petitioner, MILDRED PATRINA, through her Attorney and alleges as foll~ws: 1. The P~titioner is Mildred Patrina, daughter-in-law of the alleged incompetent, Anna Patrina. 2. Petitioner resides at 214 Cleveland Avenue, Pittsburgh, Pennsyl7ania, 15202. 3. The ~lleged incompetent is Anna Patrina whose domicile is Burgettstown, Washington County, Pennsylvania. 4. The said Anna Patrina is 70 years of age, a widow who was admitted tc-Torrance State Hospital at Torrance, Pennsylvania on June 12, 1959 in accordance with the Mental Health Act of 1951 and continued to be a patient at Torrance State Hospital until May of 1966, when she was placed in a home of her son and daughter-in-law, Donald Patrina and Mildred Patrina, at 214 .;. Cleveland Avenue, 'Pittsburgh, Pennsylvania, 15202. 5.. Since May of 1966 the said Anna Patrina has con- tinued to reside with Petitioner Mildred Patrina and with her . . son Donald Patrina until his death on September 12, 1967. 6. The :name and address of the next of kin of Anna Patrina is Charles Patrina, a son, 5621 Grove Port Road, Grove Port, Ohio, 43125. 7. The gross assets of the alleged incompetent's estate are as follows: Cash -Estate of Niko Patrina . • $ 9,111.42 Proceeds of insurance policy - Metropolitan Life Insurance Co11pany . • • . • . . • . . • • 1,300.00 Total Gross Assets .. . • • • $ 10,411.42 8. The alleged incompetent is also receiving Social Security benefits in the sum of $65.00 per month . 9. The alleged incompetent was never a member of the Armed Services of the United States and has never received any benefits from the United States Veterans Administration or its su·ccessor. 10. It is alleged that the aforesaid Anna Patrina is an incompetent as defined by Section 102 (3) of the Incompetent's Estates Act of 1951, 50 P. S. § 1632 {3), in that because of her mental infirmities she is unable to ·manage her affairs and who is' liable to become a victim of designing persons. 11. The Petitioner proposes that she, the said Mildred Patrina, daughter-:..n-law of alleged incompetent, be appointed · Guardian of the Estate of Anna Patrina. 12. The proposed Guardian has no interest adverse to the alleged incompetent. -2- 13. No other Court has ever assumed any jurisdiction in any proceeding to determine competency of the said Anna Patrina and there h~s not been a Guardian appointed for her as of this date. By its decree dated November 29, 1968 this Honor- able Court adjudged Anna Patrina an incompetent and appointed your petitioner, Pittsburgh National Bank, Guardian of her estate. 2. By f.ts order dated May 26, 1969 this Honorable Court authorized :your petitioner to pay Mildred Patrina, daughter- in-law of the said incompetent the sum of $135.00 per month for the maintenance of Anna Patrina for a period of one year so long as said incompetent resided with Mildred Patrina. 3. The said Anna Patrina, incompetent, has continued to reside with Mildred Patrina, her daughter-in-law. 4. The said court order dated May 26, 1969 terminates June 1, 1970. 5. The monthly costs of the maintenance of the said incompetent, Anna Fatrina, including medicines and normal medical attention, is apprcximately $200.00 per month. WHEREFORE, your petitioner respectively requests leave to continue to pay Mildred Patrina the sum of $135.00 per month for the care and mc.intenance of the incompetent, Anna Patrina, so long as her resijence with Mildred Patrina continues until June of 1971 pending further order of court. The estate of said incompetent Anna Patrina has a net value of $8,'004.71 which consists of proceeds of an insurance policy of which the incompetent was beneficiary, in the sum of $1,300.00, and the balance for distribution from the estate of Niko Patrina of whom the incompetent Anna Patrina was the sole heir," in the sum of $6,704.71. The incompetent is also receiving monthly Social Security in the sum of $65.00 per month. 3. The incompetent is unmarried and has no known dependent. 4. The said incompetent is being cared for and resides with her daughter-in-law, Mildred Patrina, at 214 Cleveland Avenue, Pittsburgh, Allegheny County, Pennsylvania. ! 5. The monthly costs of the maintenance of the said incompetent Anna Patrina, including medicine and normal medical attention is approximately Two Hundred Dollars, which includes Sixty- five Dollars per month received from Social Security which your petitioner alleges is a fair amount. During the time she was in Torrance, did you and your husband vis it her? Yes, we did, and also the children. You have two sons? Yes. How old are they? David, 15; Paul, approaching 14. During the time that she was in Torrance, did you ever have her in your home on weekends? Yes. And what was her condition at that time? Well, of course, she's totally incompetent. I mean no communicat on u ii: and she, you know, was as you see her now. II. 0 Q Mentally sick ? A Yes, mentally ill. Q Does she know who you are ? A No, she just identifies me with somebody she sees everyday; more like a nurse, you would say. Q But she doesn't realize that you are her daughter-in-law? 3 4 A No. Q Why did you take her from Torrance? A Well, of course, it was my husband's request. And at this time, the hospital had called me on the telephone informing me that they I • were going to transfer her to a southern geriatric center, which ~ would be about 200 miles from Pittsburgh. And of cour,se, at z ~ > .J )o en this time, my husband ,pieaded with me to take her. z z 1&1 Q II. In other words, it would be very inconvenient to go to see her. i 0 .... A 0 ~ Yes, because we had no way of traveling, you know, that is we had :t en ~ := no car. And we had discussed this at great length and of course, I ...: u a: decided that I would bring her in the home. .... e en I 0 Q .J ~ u From 1966 to the present time, she's been with you . 0 A :J Yes. .., :t 1-"' Q N Will you describe when you say that she is not able to take care of ui II: 1&1 .... herself, what do you mean by that? II: 0 II. 1&1 A II: Well, by that I mean that she won't do anything unless I tell her .... II: :J 0 u to do it. That is if I call her down to breakfast she will not---she .J o( u ii: sees the food there, and she will not sit down unless I ask her to. II. 0 • This is constantly at every meal, everyday. Ill Q 0: In other words, your mother-in-law doesn't speak English. 1-a: ::> A 0 u No. .J < u Q ii: What language does she speak? "" 0 • A Ukranian . Q Do you speak Ukranian? A Yes, I do. As a matter of fact, if I didn't, why then ther..e would be no purpose in having her because there would be absolutely no communication. And of course, the children, she doesn't communi< ate with the children either. But I tried to teach them Ukranian to try 6 to communicate withher. Q Your Honor, do you have any questions? EXAMINATION BY THE COURT: Q Mrs. Patrina, what is your age ? A 42. Q And what are the ages of your children? A The oldest boy David is 15, and the younger boy will be 14 in February. Q Where do you res ide ? A 214 Cleveland Avenue in Avalon. That's in Pittsburgh. Q Your husband was Donald Patrina? A Yes. Q When did he pass away? A September 12, 1967. Q And what is your present occupation? A At the present I'm not employed, Your Honor. Q What income do you have? A Social Security for each of us and the children, I also get the Veter ns Pension. Q Was your husband a Veteran? A Yes, he was. Q What has been the extent of your formal educati m? 7 A High school, sir. A graduate of high school. Q Were you employed at any time? A Well, the $65.00 a month that she receives from Social Security is all that I get . Q That's all that you have been getting? II. 0 Q How often does she go back to Torrance State Hospital for a check- up? A Well,, I~ll tell you, we did not have a car, at the time we took her i May of 1966, we had gone back, I believe, once. And because at each time that we did go back prior to '66, that is we had her at om home on different occasions prior to when we took her permanently 10 11 And each time we did have to rent a car. So that when we did take! ' her permanently that was the last time we did rent a car and we. did not take her back since until this last August when I had merrb et s of the family take us back for a check:::..up. And this is when we saw the superintendent also. Q And were you inform Erl at that time that she could continue to stay with you? A Oh, definitely, yes. Q And did it appear to the authorities there that she was progressing satisfactorily? A Yes. I feel that this is what they agreed to, you know. MISS GEDDIS: You have taken her to your family doctor for medical check-ups, haven't you? A Yes. I will continue to do that rather than take her back because of the inconvenience. MISS GEDDIS: Who is your family doctor? A Dr. James Lauder. Q V\.'hat was the reason that she was originally committed to Torrance State Hospital? A Well, we w.ill just term it as a mental condition, because the doctor did, he takes from five to ten minutes to give me all these reasons why she was admitted and he does this each time we go there. Q At whose instance was she originally admitted to the hospital? • • A My husband's. Because you see. at that time---do you mind if I go into detail? Q You should to some extent. A Because at this time Niko. the one who was admitted to the Veteran Hospital. he was admitted to the hospital and therefore there was ~ no one there to take care of Mrs. Patrina. Q The Court received a letter I believe from you dated September 18, 1968. Is this the letter thatyou wrote to the Court? A Yes, Your Honor. Q It would appear from the Court's reading of this letter tha~ you do not quite understand or do not fully understand the purpose of the proceeding that we have here. You were speaking in this letter about being appointed as administrator. of your brother's estate, Niko Patrina. This proceeding that we have here has nothing to do with your brother's estate, Niko Patrina. It appeared in the recorc incidentally thatyour mother is going to receive or has received certain assets from the estate of Niko Patrina, your brother. But this proceeding that we have here now has no relevancy whatsoever to the estate of Niko Pat rina. Do you understand that ? A Yes, Your Honor.
