BORDEN to. ) ) ) ~ '· ., l ! l I II PETITION FOR SETTLEMENT OF A SMALL ESTATE UNDER § 202 OF THE FIDUCIARIES ACT OF 1949, ~S AMENDED TO THE HONORABLE, P. J. MARINO, PRESIDENT JUDGE: The petition of w. B. F. Borden respectfully represents: -1- The decedent, w. B. F. Borden, was a resident of 370 Houston Street, Washington, Pennsylvania, and died on August 10, 1968. -2- There are several children-living, and your pe.titioner, the decedent's widow. All but one of these children reside outside of the state of Pennsylvania. -3- All persons entitled to share in this Estate are sui juris. -4- The only property of the Estate of ~. B. F. Borden is an interest in the Citronelle-Mabile Gathe~ing System Company, Ltd, the value of which cannot be ascertained; however, there is a royalty divid~nd payment received rronthly in the approximate amount of $1.10. .• -5- The decedent, W. B. F. Borden, owed no money at death, and the only creditor is your petitioner, who assumed and paid the burial expense in the amount of $801.50. WHEREFORE, your petitioner respectfully requests this Honorable Court to enter an Order directing the aforesaid Citronelle-Mabile Gathering System Company, Ltd., to transfer the decedent's interest to your petitioner, and pay the monthly dividend checks to her, all of which will be used to defray the expense of burial. ., - COMMONWEALTH OF PENNSYLVANIA SS: COUNTY OF WASHINGTON Before me, the undersigned authority in and for the said County and Commonwealth, personally appeared ETHEL BORDEN, who, having first been duly sworn according to law, deposes and says that she is the plaintiff in the aforesaic Petition, and that the allegations of fact set forth therein are true and correct to the best of her knowledge, information and belief. BORDEN AND NOW, this ) ) ) D E C R E E oZ day of ~L· 1968, upon consideration of the foregoing petition, and pursuant to the provisions of Section 202 of the Fiduciaries Act of 1949, as amended, the interest in the said Citronelle-Mobile Gathering System Company, Ltd., is to be transferred to Ethel Borden, widow, and the dividend checks are to be paid to her in order to defray the expense of burial.
