PETITION FOR DISTRIBUTION OF ESTATE UNDER SECTION 721 OF FIDUCIARY'S ACT AND NOW, this 27th day of A:p;ri:J.1, 19 70, comes JOHN BOLOGA by his attorneys, PATRONO, CEISLER AND EDWARDS, ESQUIRES, and respectfully represents and sets forth as follows: 1. Mary Bologa died, a resident of the Borough of Canonsburg, Washington County, Pennsylvania, on May S, 1968. 2. The said Mary Bologa left a will in which she bequeathed and devised all of her property to your petitioner. The said will is of record in the office of the Register of Wills of Washington County, Pennsylvania, in Will Book 1C6, at page 342. A copy of the said will is attached hereto, marked Exhibit "A", and made a part hereof. 3. Your petitioner was appointed Executor of the Estate of Mary Bologa by the said Register of Wills on Septem- ber 24, 1968. He was not required to file a bond. 4. The gross assets of the decede3t had a value of $1525.00. An inventory has been filed by your petitioner in the Office of th~ R~gister of Wills of Washington County, Pennsyl- vania, and is recorded in the said office in Inventory Book 81, at p~ge 24. A copy of the said inventory is attached hereto, marked Exhibit "B", and made a part hereof. 5. Your petitioner has paid the ~ebts and ex- penses of the said Mary Bologa.and there are no unpaid creditors of her estate. • .. 6. An account of the expenses paid by your petitioner is attached hereto, marked Exhibit "C", and made a part hereof. 7. The grant of letters testamentary to your petitioner has been advertised in the Washi~gton County Reports and in the Washington Observer-Reporter. The date of the first advertisement was October 3, 1968. Proo~ of publication in support of this all~gation are attached hereto, marked Exhibits "D" and "E", respectively, and made a part hereof. 8. There is no Inheritance Tax due in the estate because the debts of the estate exceeded the value of the property therein. 9. Your petitioner is the sole party in interest 1n the said estate. 10. No notice of intent to file this petition is required because your petitioner is the sole party in interest. 11. Y~ur petitioner has been attempting to sell the real estate left by th.e decedent but has been unable to find any buyer interested in it, due primarily to the fact that it contains no bathroom or hot water. WHEREFORE, your petitioner prays your Honorable Court to make an order pursuant to Section 731 of the Fiduciary's Act of April 18, 1949, P.L. 512, as amended, 20 P.S. 320.731.
