PETITION TO SALE REAL ESTATE
AT PRIVATE SALE UNDER SECTION
543 OF THE FIDUCIARY ACT OF 1949
TO THE HONORABLE, P. V. MARINO, PRESIDENT J1JDGE OF SAID COURT:
The Petition of Stanley Woss, Administrator of the
Estate of Blanche Woss, deceased, respectfully represents:
1. That he was appointed Administrator of the Estate of
Blanche Woss by the Register of Wills of Washington County on
April 1, 1960, as evidenced by a copy of said Letters of
Administration, attached hereto.
2. That the only persons interested in the decedent's
estate are the following:
Stanley Woss, husband, Administrator
Charles Woss, son
Adolph Woss, son
Rudolph Woss, son
Mary Ann Woss, daughter
Frances Woss, daughter.
The aforesaid Charles Woss, died intestate on October
1965, leaving to survive him his wife, Eleanor, and ~wo children,

'Charles Woss and Ilona M. Woss, who are minors, under the care of
their mother, Since the decedent died intestate, the respective
shares of the husband and children are set forth according to law.
3. That among the assets of said decedent, is certain rea
estate being designated as Lot No. 953 situate at 706 Washington
Avenue, Charleroi, Washington County, Pennsylvania and described as
follows:
ALL that certain piece or parcel of land lying in the
Borough of Charleroi, Washington County, Pennsylvania, bounded and
described as follows:
BEING Lot No. 953 in the Plan of said Borough of Charleroi
fronting on the East side of Washington Avenue, 22 feet, lying
between Seventh and Eighth Streets and extending back of uniform
width, 100 feet to a 15 feet wide alley. Improved with a two story
frame house.
BEING the same premises devised to the decedent by the
Last Will and Testament of her mother, Katherine Urbanowicz, as
recorded in Will Book Vol. 91, page 55.
4. That all of the parties interested in said real estate
have agreed to sale said real estate and have agreed as appears fron
-:heir written consents hereto annexed, that·your Pe-titioner should
make said sale because this estate has remained unsettled for a
period of eight years and there have been insufficien~ sums in the
estate to pay the debts of the decedent and to provide any distribu ti.on
The sale of this property will now effect the payment of all debts
of the decedent and her estate and provide distribution among the
lawful heirs.
5. That an inventory in said estate was filed on or about
June 28, 1960 wherein the total value of decedent's property was
hown to be $9,116.54 which included, at the value of $7,000.00, the
forementioned premises for which leave to sell is sought herein.
6. That your Petitioner has entered into an Agreement of
Sale with DonaHE. Ulens and Cora Elaine Ulens, his wife, of the
Borough of Charleroi, Washington County, Pennsylvania for the
private sale of the aforesaid premises for the total sum of $7,000. 0
in cash, subject to the approval of your Honorable Court, a copy of
which Agreement is attached hereto.
7 .. That your Petitioner believes that the sum of $7,000.0
is a full and fair price for said premises and a better price than
can be obtained at public sale. Affidavits of value by
persons, acquainted with real property in the vicinity of the
premises in ·question are attached hereto.
8. That under the law, the Administrator is given no
authority to sell said real estate, therefore, it is necessary
to obtain leave of your Honorable Court to make the said sale,
pursuant to Section 543 of the Fiduciary Act.
WHEREFORE, your Petitioner prays your Honora~ Court,
under the aforesaid Section 543 of the Fiduciary Act of 1949 for
authority to make private sale of the aforesaid premises as herein
before set forth.

and local real estate'transfer taxes and a pro rata share of the 1968

Parties of the second part. shall pay ~or the cost of recording
deed, any and all charges for financing, attorneys closing, examination
and certificate of title, one-half the cost of preparation of this Agreement,
and a pro rata share of th~ 1968 real est~te tax levies.

THE COURT: Number 1240 of 1968, the estate of Blanche Woss,
deceased. The Administrator is Stanley Woss anc the attorneys

MR. MURPHY: Your Honor. this is the time set for the Estate of
Blanche Woss. We finally sold the real estate in this old estate am

I have an Audit Petition. I have served a copy on L1e only other per .. on
at interest, a daughter-in-law. The other parties have all been

notified rby,;_~egular mail and they are. the children and_ they are to
return to me an Acceptance of Service of the notice. I, however,
learned over the weekend that Mr. Stanley Woss went to Florida
to visit with his son Rudolph and is down there now: I sent to him
the Audit Petition for his signature. We went over this·<before he len
and the old gentleman got on the RHmeThursday or Friday and left.
And I didn't get his signature. I have a copy of the Audit Petition wh ch
I would like to .leave with.tJ:e Court, and then submit next week to::.the . ' .
Clerk of Court the sworn and signed Audit Pet~tion as well as the
.f..cceptaqce of Service. Everything is outlined in this copy that I
am submitti~g to the Court. There are no complications. It's all -·
reduced to cash.
THE COURT: Are there any outstanding claims at all?
MR. MURPHY: There are no outstanding claims.
THE COURT: Are the distributees sui juris'?
MR. MURPHY: All but two, Your Honor. That is two grandchild en
and I have indicated that in my Petition. I would prefer the sums
be awarded to the mother as a natural guardian. Their share will
not be great. . We did not file a s~parate petition for appointment of
guardian.
THE COURT: Do you lR ve any idea· approximately how much each
child would be entitled to?
MR. MURPHY: The total estate is $5, 000 and they are a very sm< ll
-interest.

THE COURT: We can determine that when we go over the file.
We will not award the fund to the mother as the 13latural guardian if
it is what the Court believes to be substantial enough to place in a
restricted account in their names.
MR. MURPHY: Both would be less than $1, 000.
THE COURT: That is still considerable. We will determine whe
we go over the file whether or not we can give it to the mother as
the natural gw rdian or whether the funds be placed in a restricted
account in the children's names.
MR. MURPHf: Whiehever the Court feels proper.
THE COURT: Is there anyone else in Court interested in this
decedent's estate?

THE COURT: The audit of this account is ordered closed by
