Estate ef Joseph Girdish,Deceased,and petitions your Hcnorable
Court fer leave to sell a certain tract of real property and
sets forth the following facts and circumstances in suppert
thereof:
1.The decedent,Joseph Girdish,died on Decerrber
18,1958,in Washipgton County,Pennsylvania.

at the time of his death;and he was survived by the following

Torrance!Pennsylvania ,--incompetent,
under the guardianship of the Commonwealth
of Pennsylvania;
(c)Daniel Girdish,R.D.#1,Marianna,
Pennsylvania;
(d)Gloria Carroll,1110 E.Grand Boulevard,
Detroit,Michigan--single,changed her
own name:
bordering in part on a township road No.806 and being that tract
7.The rental value of the aforesaid 40~acre'tract

petitioner to sell the tract of land in question.
6.The real ,estate owned by.the decedent at the time
of his death consisted of a tract of unimproved acreage lecated
in West Bethlehem Township,Washington County,Pennsylvania,

TC SELL REAL ESTATE
AND NOW,comes George D.Girdish,Administrator of
the Estate of Joseph Girdish,Deceased,and petitions your
Honorable Court to authorize him to sell certain real estate
and provide for such additional security as the Court deems
satisfactory.
The reasons for this Petition are:
1.The above captioned estate consists primarily
of a tract of land owned by the decedent,containing 48 acres,
more or less,and located in West Bethlehem Township,
Washington County,Pennsylvania.
2.Your petitio~er has obtained an offer from the
Jones ~Laughlin Steel Cor?oration to purchase 20.012 acres of
the aforesaid tract of 483.cres,for the sum of Ten Thousand
($10,000.00)Dollars.
3.Your petitioJer believes and therefore avers
that the heirs of this estate are in agreement with the decision
of you~petitioner to sell the aforesaid parcel for the aforesaid
consideration except possibly for one heir,who was rep=esented
by counsel but who has never made a written,articulate,or
definite indication of his dissatisfacti6n or given reason~therefbr.
4.Your petitioner is satisfied that the consideration
offered is fair and reasonable and as good or better than he could
obtain if the property were to remain for sale on the open market.
5.Your petitioner believes that it is in the best
interests of the estate to sell the aforesaid tract at tne
!:present time.
6.The present bond of your petitioner as Administrator
of this estate is approximately Two Thousand ($2,000.00)Dollars"
WHEREFORE,your petitioner prays that your Honorable
Court will make an Order in accordance with the prayer of his
petiti~n under the Act of April 18,1949,P.L.512,Article V,
§541 a~d §543,and all amendments thereto,as well as other
pertinent acts of legislature.

debts and funeral expenses appear to have been paid and the property is
self-sustaining.No letters of c.dministration were applied for or issued until
1968,wr.:en it was contemplated that part of decedent's real property might
b'e advan~ageously sold.
All the ieirs,other than the administrator,oppose tte sale and

debts are paid.Second,the agreement of sale entered into by the administrator

befJre he died and now in his estate.My father and I had represen~ed
the Administrator,George Girdish,who is sitting here at the counsel
table.And we had prepared a Petition w,ith what'we thought was in

accordance with the rules of'the Orphans I Court for a private sale
of real estate and presented it,and this time was set where people
codd come and object,overbid or whatever they wanted to do.
We sent certified copies 0:notices to all of the heirs,being Dore
or less ten children of the decedent.
Jones &Laughlin is represented by Attorney
Allison who is here.And we"!J.~drhade an agreeme.nt with "them 'to
sell half of the acreage,i.e._a tract of·about 20 acres to J &L
for the sum of $10,000.Eince that ttme,namely about the end of
last week,the Administra:or came into my office with his brother,
and the Administrator advised me that he no longer wished to continue
as Administrator.He act'jally,apparently has been harassed by
his brothers and sisters ever since the decision to sell was made.
And he also no longer wishes to submit the property for sale.Thus.
I have prepared a Petition.I would ask the Court to allow Mr.
Girdish to withdraw as Administrator..,

has been in the family name for some time.If the settlemen::of
the estate can be effected properly without resort to the sale of
real estate,that's one story.But if it cannot,it's another.So

this juncture what the financial status of the estate is and whethEr 0
not it would be required teo sell real estate in order to liquidate fhe
estate.That's what wei;lsikould know at this time.

They are represented by Peacock,Keldier &Yohe,who is not here

incumbered on the property.And we have decided among ourselves

And we didn't have no intentions of selling this place or liquidating
it ":Jecause we went through the worse when we could use the money.
And now we're past that worse.And we've come to the conclusion
that we would just leave it sit there and if we have to appoint a trustee,
we did appoint our younger brother as trustee.And he thought---
we have a litigation.with Jones &Laughlin.They took over the place,
roughshod all over _the place and never reimbursed my mother and
fath.er for nothing.They damaged property;they damaged ani:nals.
And they've never reimbur_sed a penny;they've never got a release
for trespassing.They have a right to mine their coal,but I know what
the contract is on mining rights.They have never fulfilled any of
.tha:mining right contract on the surface and we felt they owed us
sooething.
So my brother .thought that he would take them
to Court to litigation.And somebody told hi m that he'd have to hav
authority to do that.That's true.So I in turn took it on myself and
had copies of a PC?wer of Attorney and each one.I sent each one a
cOJ=y of that Power of Attorney so signed.I sent it by certified
mail to my brother George to represent us in this particular ::natte
But he went right on ahead,appointed hims elf administrator accor ng
to the law,which is perfectly legal.He got two people that were
residents in the state to sign for him.
