MR.CARROLL:If Your Honor please,ifyou will recall,this was 3 a Petition for Citation against tBeryl Spencer who is an heir in this estate of William B.Spencer and against a Mr.and Mrs.Alfred Sims,who, as I understand,are the residents of the real estate.I might just I ! recite for the Court some of the background involved in this situation. William Spencer died in May of last year and he owned a property at; 1108FultonStreetinWashington,Pa.,situate in North Franklin Township.It appears to be the only valuable asset which he had at the time ofhis death and Beryl Spencer is a son of the decedent. The man died intestate.He has been residing at leas t periodically and I=resently in the home at 108 Fulton Street.The other two heirs are as recited in the petition,both granddaughters,:Marion Maggio who lives in New YQrk State)and Ny~a .Spencer,who lives "'ZHh he \. parents at 117 Baltimore Avenue~and she is.the Adminisfratrix of. this estate. The problem d~veloped that we attempted,or at least I attempted to contact Mr.Spencer by phone at the home a nu ber of times and never received a reply.I then wrote aim various lette s in September and December,and 'although I sent them by certifIed mail and service was accepted,Mr.Spencer never contacted me one way or the other.The letters were directed for two purposes. One was to advise him that Nyma Spencer,the granddaughter,had taken out Letters and that the real estate would have to be apprais·e and sold.I then employed Mr.Henry Bennett,a local real estate broker,to go out .and appraise the property and he was refused admission to the property by Mr.Spencer.And we had no way of I .III 4 '-j i I!i, ! \..,tryin.5 to resolve this particular problem. •the base problem then is that we want to appraise the property,we'd like to sell it and we would like to liquidate that assel and payoff the bills ,which are listed on page two of this Petition. I then prepared the Petition and gave it toyou to sign:. A Citation was issued by the Sheriff on both Mr.Sims and Mr.Spencer. I Mr.Sims is h~re for the r eason that we urn erstand tha t he and his t family are living with Mr.Spencer at this location and to our knC?wlE!ctge are not paying rent;or if they are,they are paying it to Mr,Spencer and it has not been reported to me. Just a,fewemonltents before this hearing,Mr.Zelt hall.And I assume that we have corne to a conclusion that we can and that we can put it on the market for sale and Mr.Spencer will cooperate.In.so far as Mr.Sims is concerned,I still don't know gain access to the property for appraisal purposes and sale purpose, ~r- ei appeared representing Beryl Spencer ;and we discussed this in the QI:IIl-I:oc..III: l-e :J "V .J.; vii.lL(. what his position is in this matter.But that is basically what it is, Your Honor. MR.ZELT:'Sims'has no real interest in th'e property. MR.CAREOLL:No.The only problem is under the law,as I under stand it,Your Honor---.. MR.ZEL1f:Do you understand,if-the Judge says that they've got to sell the property,you've got to let them in.,and get out. MR.CARROLL:My purpose in citing Mr.Sims,Your Honor,as I understand,under the law,an heir of the estate can have possessi ,n ~ of any real estate which is involved but in so farasanybody else is concerned,if there is possession involved,they would have to paya fair rental value or do something to give value to the estate.I don't know ho.Y long Mr.Sims has been in the house or how long he inten s to be there.
