PETITION FOR APPOINTMENT OF GUARDIAN
TO THE HONORABLE PRESIDENT
JUDGE OF SAID COURT:
The Petition of Bart'Bertocci and Dorothy Bertocci,
his wife,parents of Lesii.Marie Bertocci,Rosemary Bertocci,
Bartlett Bertocci,Jill Bertocci and Clifford Bertocci,
respectfully represents:
1.That all of the minors involved were born on
the dates set forth opposite their names:
Les1i Marie Bertocci February 1,1960 Age 8
Rosemary Bertocci February 22,1961 Age 7
Bartlett Bertocci June 6,1962 Age 6
Jill Bertocci November 25,1964 Age 3~
Clifford Bertocci August 11,1966 Age 2
2.That their present residence is in the Township
of Perry,Fayette County,Pennsylvania,where they reside with
their parents,Bart Bertocci and Dorothy Bertocci,his wife.
3.That a guardian of their estates is necessary
because each of the minors is seized of an undivided one-fifth
interest in real estate referred to in Exhibit "A",upon which
there is erected a ,corrugated iron hut,or building.
4.'The undivided interest iIi the real estate was
acquired by the minors as hereinbefore set forth as vacant land
as a gift from their father,Bart Bertocci,who is one of the
Petitioners.Rose Bertocci,Trustee in the deed referred to in
Exhibit "A",is a natural grandmother of said children,residing
in the Borough of Bentleyville,Washington County,Pennsylvania,
and was named Trustee as a convenience party.The actual
consideration for the original acquisition of said property was
$2,600.00.
5.From and since the date of the acquisition of
the property,Rose Bertocci,together with her son and natural
father of the children,caused a hut or building to be erected
thereon,resulting in the increase in the value of the premises
to $19,000.00,representing a fair market value.
6.The residence of Rose Bertocci,the natural
grandmother,is 125 Gibson Road,Bentleyville,Pennsylvania.
i.The other proposed guardian is that of Mellon
National Bank and Trust Company which maintains an office in
the City of Washington,Washington County,Pennsylvania.
8.Neither of"the proposed guardians have an
interest adverse to the minors and the said Rose Bertocci is not

an officer or employee of the corporate Fiduciary of any estate
in which the minors have an interest nor a surety or employee of
the corporate surety of the Fiduciary.
9.That Bart Bertocci arid Dorothy Bertocci,his
wife,have no interest in the proceedings excepting that they
are interested that the best treatment of the assets of the
minors involved be had.
WHEREFORE"ycur Petitioners pray your Honorable
Court to appoint Rose Berteocci and Mellon National Bank and
Trust Company,guardians of the estates of the minors for whom
this petition is filed.

for the sum of $2l,SOO.00 in cash for the whole thereof,clear
of encumbrances.A true and correct copy of the sales agreement
between the parties is attached hereto and marked Exhibit "B".
11.That the next of kin of the minor children are
Bart Bertocci and Dorothy Bertocci,his wife,natural parents of
all of said minor children who join in the prayer of this
petition,believing it to be in the best interests and welfare of
said children that the proposed sale be approved and consummated.
12.That the said real estate is assessed for tax
purposes in the amount of '$7 ,.OOO~OO '.There is attached hereto
and made a part hereof as Exhibit "c"a certificate from the
Tax Assessment office of Allegheny County certifying to the same.
13.Affidavits as to value of said real estate by two
competent persons are attached hereto as Exhibits "D"and "E,"
asserting the value to be no less than the amount for which the
same has been agreed to be sold.

the premises cannot be adequately maintained and repaired in order
to continue to sustain its value;that the Trustee is under a
disability to continue the nature of her trusteeship for the
purpose of preserving the asset and that the profits made by this
proposed sale would be so substantial in view of the investment
that the sale sho~ld be completed.
16.Your Petitioner is unable to sell,conveyor othe -
wise deal in real estate except under the terms and conditions of
the Uniform Revised Price Act and seeks to invoke the jurisdiction
