The fund now before the Court is subject to the following taxes:Income tax,if applicable.
Set forth any legal problems requiring adjudication by the Court or difficulties that must be met in distribution:
Carl A.,Sargent,substituted trustee under the Will of Mary E.Booth,
deceased,died October 8,1965.Although the account filed at No.343
of 1960,o.C.,charged the accountant with a principal balance of -
$968.,63 and an income balance of $840.85,the'only trust ass-et which
the present acconntant has discovered is the trust bank account in the
Washington office of Mellon National Bank and Trust Company in which
the balance on the date of the account at 343 of 1960,O.C.was $428.15.
The present accountant believes that the appare~t deficiency actually
resulted from expenditures made,by !the said Carl.A.Sargent in the
preservation and improvement o!the trust real estate,the principal
ssset of the trust estate,which real estate was not charged to the
accountant and in which improyements would therefore not appear in said
accounting.Robert A.Booth,the life tenant,requires a full and
complete accounting.The present accountant has;not found sufficient
records prior to 1960 to verify her contention.

or a total liability of $1809.48.Your accountant.had in'her possess~on only
the trust check book indicating a balance in the trustee checking account of
$428.15 at the close of the latest account of the said Carl A.Sargent and there-
fore accounted only for the fund wbich she knew to be in her possession.Since
that time a lock box in the name of the trust estate has been inspected in the
presence of a representative of the bonding company,a representative of the
accountant and bank officials and g'overnment bonds having a cost ap.d redemption
value of $900.00 were found to be t=resentin the box.The Accountant further
finds that $530.19 credits claimed in the Petition Sur Audit filed at 316 of 1952,
O.C.were not then deducted nor later credited to the accountant's liability to
the'trust estate.Accountant further finds that a credit claimed for a payment
on April 2,1947,to Millsboro Lumber Company for repairs in the amOUI:t of
$48.82 is in duplica tion of and included in.a credit of $650.00 allowE'd for the
same date to the samE payee for repairs pursuant to a Petition and Decree of
the Court.Accountant is,therefore now able to state that as of August 25,1960,
she can adopt the principal balance shown by the said Carl A.Sargent"to-wit,
$968,.63 of which $900.00 is invested in government securities in the lock box
of the trust estate and also the balance of the income account,~o wit,$840.85
has decreased by the credit of $530'.19 and increased by the duplication of

MR.McCREIGHT:Carl A.Sargent was the substituted trustee.He
has died and this is an account by the Executrix of;his estate to
permit the Court then to move toward the appointment of another
trustee.

MR.McCREIGHT:If the Court please,we have the Petition Sur Audi

and our appearance.This matter presents a problem.Carl A.
Sargent had been acting as substituted trustee under a trust created
by the will of Mary E.Booth,and had filed several accounts with
ttis Court to show the condition of the trust.The latest of these

accounts was filed at 343 of 1960,O.C.,and that account indicatedt
I
a principal balance of $968.63,and an income balance of $840.85.
M::,.Sargent's health gradually failed after that
date.and for a period of several years prior to his death his condit on
was such tha t he was confined to his home and for a good part of
that time was confined to his bed.At his death,Mrs.Sargent
attempted to reconstruct the operation of the trust from the papers
that she found.The checkbook indicated a proper operation of the
trust from 1960 to the date of his death.and a proper depOsit of the
income.Apparently,the entire trust was operated through a trust
account appropriately designated in the Washington Office of Mellon
National Bank and Trust Company.However,that trust account
carried a balance of $428.15.at the appropriate date in 1960,
which was the endfOf ~the.aeco.u,nting·:p.ed:odlfo.rth~previous account
And Mrs.Sargent has been unable to determine an explanation
for the discrepancy between the last reported principal balance and
the income balance,and the bank account.trustee bank account
as it appeared in 1960.
THE COURT:Who is the cestui que trust?

MR.MeCREIGHT:The life tenant is Robert Booth,a son of the

decedent,and the remaindermen are his children,I beliey;e,living
at the time of his death,if I remember the terminology in the will.
Let's see.
THE COURT:
MR.McCREIGHT:
The life tenant is:s till living.
The life tenant is still living and the life tenant,

yes,it goes to the children surviving Robert Booth.If I might
interrupt myself,according to paragraph four of the will,the life
tenant is living in up'near Detroit,Michigan.He is ,insisting
on an explanation of the discrepancy and the bonding company which
pos ted its bond for Mr.Sargent is represented by Mr.Keller of thi
Bar.They have received notice of this audit and he asked me to
advise the Court that since it would appear that a hearing should
be held to go into the matter and determine what,if any surcharge
should be carried back.That he would not appear this morning anc

that I would give him notice of the hearing.
I might explain to the Court that in this trust
estate there is a very substantial piece of real estate in Centerville
Borough,and as the affairs of the trust worked out,a substantial
income did come from an oil and gas lease that was on this real
estate and the rents constituted an almost incidental income.The
rent was $20.00 per month.Because of the accounting system which
existed at the time of the initiation of this trust,there was no
representation in the accounting for this real estate at all.It was

not charged to the trustee').and consequently,was not represented
by a figure.Yet the oil and gas income decreased very substantially
and is now minimal by reason of a gradual failure of the well and
an action of this Court which per~itted the terms of the lease to be
altered so that the well would not be plugged.
It is the contention of Mrs.Sargent that the monies
which represented the principal and which Mr.Sargent accounted fcl!'
as principal and perhaps a portion 0 f the income went into the
improvement of the real estate and because of the nature of the
accounting,there was no counterbalancing figure shown on the
account.We believe that this is probably the explanation,but the
difficulty is that it must have occurred back in one of the previous
accounting periods and is most difficult to find now.

Washington CoUnty,Pennsylvania,died on October 11,1941
and by her Last Will and Te.stament,dUly flrobated arid of record

National Bank of Washington "in trust to pay the net income
