PETITION FOR THE APPOINTMENT
OF A GUARDIAN FOR AN ALLEGED INCOMPETENT
TO THE HONORABLE,THE JUDGE OF THE SAID COURT:
The Petition of EDWIN T.LATCHEM and FLOYD LATCHEM
respectfully represents:
1.That the Petitioners are the sons and only children
of the said WILLARD E.LATCHEM,the alleged incompetent,and
the said petitioners reside at 1193 State Road and 623 Ninth
Street,in the City of Monessen,westmoreland County,
respectively.The alleged incompetent has his legal domicile
in the Borough of Charleroi,washington County,Pennsylvania
at 803 McKean Avenue where he made his home for many years but
is and has been for some time a patient at Haven Crest Nursing
and Convalescent Home,Country Club Road,Monongahela,
Washington County,Pennsylvania.
2.That the said WILLARD E.LATCHEM,because of mental
infirmity caused by hardening of the arteries being presently
68 years of age is unable to manage his property and is liable
to dissipate it,or become the victim of designing persons.
3.That the Estate of the said WILLARD E.LATCHEM is
as follows:$39,000.00 dollars worth of Field Finance

Realty situate at 803 McKean Avenue,Charleroi,Pennsylvahia
being a dwelling house and lot on which the dwelling house is
erected See Deed Book 902 at Page 165.
A tract of land situate in the Borough of Speers,
washington County,Pennsylvania,being a tract of 2.43 acres
as per Deed Book 904 at page 362.
A tract of land situate in Allenport Borough,Washington
County,pennsylvania also as per Deed Book 904 -362.
A one-half interest in a partnership with one John
LATCHEM,brother of the alleged incompetent which partnership is
known as Latchem's Transfer and Storage and has its business
address at 810 McKean Avenue,Charleroi,Pennsylvania and which
partnership has certain personal property,fixtures,equipment,
rolling stock and interest in realty.
An undivided interest with John Latchem and certain
other real estate taken as a part of the partnership and/or
from their parents.
The alleged incompetent has an income of at least
$500.00 a month from rental properties owned both individuall
therefore and as a partner with the said John Latchem.
4.That the following is a list of all persons residing
within the Commonwealth of Pennsylvania,who are sui juris,
and who will be entitled to share in the estate of the alleged
incompetent if he died intestate at this time~
EDWIN T.LATCHEM,son,one of your Petitioner who resides
atl193 State Road,Monessen,pennsylvania.
FLOYD LATCHEM ,son,one of your Petitioners who resides
at 623 Ninth Street in the City of Monessen,Pennsylvania
5.That the following named persons have an interest
in the alleged incompetent's welfare or his estate:

known as Haven Crest Convalescent and Nursing Home situate in

The said Willard E.Latchem cannot remember except for
very brief period of time his disoriented as to his assets and
estate,and,does not appear to have any knowledge of the nature
and quality of his estate and/or assets.

the within Petition and upon consideration of the Exhibits thereto attached,
the Petitioner,MELLON NATIONAL BANK AND TRUST COMPANY,Guardian of the
Estate of Willard E.Latchem,An Incompetent,is authorized to join in the
documents of title,applications for sale and to take whatever appropriate
steps are necessary to effectuate the sal pursuant to the Agrgement of Sale
which is attached hereto and made a part hereof and specifically the sale

AN INCOMPETENT
TO THE HONORABLE,THE JUDGES OF '1HE SAID COURT:
1.Your Petitioner is the MELLON NATIONAL BANK AND TRUST COMPANY,
the Guardian of the Estate'of Willard E.Latchem,an incompetent.
2.Your Petitioner has heretofore filed in the Office of the
Register of Wills of Washington County,Pennsylvania,an Inventory and
Appraisment of the assets of the said Willard E.Latchem,an incompetent.
A copy of the said Inventory and Appraisment is attached hereto and made a
part hereof.
3.Among the assets listed in the estate of the incompetent was
certain Public Utility Commission Rights held by Latchem's Transfer,which
was a partnership composed of John r..a.tchem and Willard E.Latchem,the
incompetent.No value was fixed on those rights in the Inventory.
4.Your Petitioner and the remaining partner,John Latchem,have
been endeavoring to dispose of the Public Utility Commission Rights aforesaid
and now have entered into an Agreement of Sale with Long Hauling Company,
Inc.,which Agreement is subject to the approval of this Court and a copy of
which Agreement is attached hereto and made a part hereof.
5.Your Petitioner and the remainipg partner have made a
careful search f<Dr the prospective buyers and have made a careful evaluation
\.of the said rights and believe that the purchase price as set out in the
Agreement,to wit:$8,000.00 is a fair and appropriate SUIll to be paid for
the total interest,of which the incompetent would be entitled to one-half.
6.The Pennsylvania Public Utility Commission will require the
approval of your Honorable Court prior to the approval of any transfer.

1.Your Petitioner is the Mellon National Bank and Trust
Company,the Guardian of the Estate of Willard E.Latchem,an incompe-··
ten~duly appointed by the Orphans'COurt of Washington COunty,
Pennsylvania.
'2.Your Petitioner has heretofore filed in the Office of the
Register of Wills of Washington COunty,Pennsylvania,an Inventory
and Appraisement of the assets of the said Willard ~Latchem,an
incompetent,and a c~py of the Inventory and Appraisement is attached
hereto and made a part hereof.
3.Among the assets listed in the estate of the said incompe-
tent was certain real estate,part of which real estate is the subject
of this Petition.The real estate which is the(subject of this Petitior
is the undivided one-half interest of the incompetent in certain parcel~
of real estate in Charleroi,North Charleroi,Fallowfield Township,
Carroll Township,Allenport and Speers Borough,as the same is more
particularly described on the Agreement of Sale which is attached
hereto and made a part hereof.
4.Your Petitioner and ~he co-~wner of the said real estate,
a brother of the incompetent,John Latchem,have entered into an
Agreement of Sale for the said real estate interest.of the incompetent,
which ,agreement was subject to th~approval .of this COurt and a copy
of which agreement is attached h~~eto and made a part hereof.
5.Your Petitioner has made a careful search for prospective
buyers and has hadca careful evaluation made of the market value of
the said real estate and believes that the purchase price as set out
in the agreement,to wit:$62,500.00 is a fair and appropriate sum
to be paid for the one-half interest of the said incompetent.
6.There is attached hereto Affidavits of two competent
realtors setting forth that the price fixed in the Agreement of Sale
is fair and represents the market price for the said realty.

t()ry and Appraisement of the assets of the said Willard E ..Latchem
an.incompetent ......Acopy of the said Inventory and Appraisement is
attached herto and made a part hereof..
3.Among the assets listed in the estate of the incompete t
was certain Interstate Commerce Commission Rights held by Latchem'
Transfer,which was a partnership composed of John Latchem and
Willard E.Latchem,the incompetent..No value was fixed on those
rights in the Inventory ..
4.Your petitioner and the remaining partner,John Latche
have been endeavoring to dispose of the Interstate Commerce Commis inn
Rights aforesaid and now have entered into an Agreement of Sale wi h
Fife Moving &Storage Company,which Agreement is subject to the
approval of this court and a copy of which Agreement is attached
hereto and made a part hereof.

5.Your Petitioner and the remaining partner have made a
careful search for the pro~pective buyers and have made a careful
evaluation of the said rights and believe that the purchase price
as set out in the Agreement,to wit:$1,000.00 is a fair and appr)~

tent would be entitled to one-half.
6.The Interstate Commerce Commission will require the
approval aL'your Honorable Court prior to the approval of any trans'*'"er.
7~A copy of the application which will be submitted is
