TO THE HONORABLE P.V.MARINO,PRESIDENT'JUDGE OF SAID COURT:
The Petition of WRAY G.ZELT,JR.respectfully represent
1.That Letters of Administration on the Estate of John
D.Cuper were issued to your Petitioner on July 12,1967,by the
Register of Wills of Washington County.
2.That John D.Cuper,age 63,who resided at 316
Shiboleth Street,California,Washington County,Pennsylvania,die
intestate on September 7,1955,leaving to survive him his wife,
Marie Cuper,and no other heirs entitled to share in his Estate
under the Intestate Laws of Pennsylvania.
3.That Marie Cuper is a citizen of Czechoslovakia and
resides at Cernina 102,District Bardejov,Czechoslovakia.
4.That John D.Cuper,at the time of his death,owned
an undivided one-half interest in certain real estate located in
or near the Borough of california,Washington County,Pennsylvania.
5.That the Redevelopment Authority of the County of
Washington condemned the aforesaid property,as a result of which
it paid to your Petitioner,as Administrator of the Estate of
John D.Cuper,Deceased,the sum of $1250.00.

6.That your Petitioner caused Estate Notices to be
published in the Washington County Reports and the Observer-
Reporter of Washington,Pennsylvania,as will appear from the
Proofs of Publication which are annexed hereto,marked Exhibit "A"
and made a part hereof.
7.That your ·Petitioner has ~ot been notified of any
claims against this Estate ~
8.That attached hereto,marked Exhibit "B"and made a
part hereof is a Marriage Certificate and a translation thereof,
establishing the marriag~of Marie Paulusova to John Durkot Cuper
as of February 12,1911.
9.That annexed hereto,marked Exhibit "c"and made a
part hereof is an Affidavit by Marie Cuper a/k/a Marie Cuperova
stating the date of Marriage ahd that neither of the parties had
remarried.
10.That attached hereto,marked Exhibit "D"and made a
part hereof is a Power of Attorney executed by Marie Cuperova
(Cuper)in favor of (Attorney)Dr.Walter Krader,Genealoge,
Zurichstrasse 3,Kusnacht-Zurich,Switzerland,which said Power
of Attorney was authenticated by the Ministry of Justice of
Czechoslovakia.
11.That your Petitioner alleges that the surviving
spouse in Czechoslovakia will receive any moneys forwarded by
your Petitioner to her and/or her Attorney-in-Fact,and none of
said moneys will be withheld by the Government of Czechoslovakia.
12.Your Petitioner alleges that the Act of 1953 P.L.
674,known as the "Iron Curtain RUle",is unconstitutional by
virtue of the decision of the Supreme Court of the United States
in the case of Oswalt Zschernig,et al.,Appellants vs.William J.
Miller,Administrator,et a1.,38)u.s.If?{,wherein it declare
that a comparable Statute in the State of Oregon was unconstitutio 1.
13.Your Petitioner has been advised,believes,and
therefore alleges that Circular 655 of the Department of the
Treasury of the United States of America has removed the restricti 'ns
pertaining to moneys paid to persons within Czechoslovakia.
14.That your Petitioner,as Administrator of the
Estate of John D.Cuper,has expended the following amounts,to-wi

copy enclosed,with current amendments,Czechoslovakia has been
removed from the list of countries to which checks drawn against
funds of the United states may not be sent.However,the Circular
is not intended to apply to the transmission of private estate funds
or funds under the control of a state court.You may find it helpful
to consult the state cases interpreting the 1940 statute in the annota-
tions to 31 U.S.C.A.123 and the recent Supreme Court decision,Zschering v.
Miller,at 389 U.s.429.
