be my Last Will and Testament hereby revolting any other wi-llor
wills by me "at any time heretofore made.
1.I direct that my Executor hereinafter named to pay all
my just debts and funeral expenses "as soon as convenient after my
decease.
2.I give,devise and bequeath all of my estate of
whatsoever kind and wheresoever situate to my mother,Dessie
w.Pierson,if she survives me,provided,however,that if my said
mother shall have predeceased me,then and i~such event,I give,
devise and bequeath my said estate to my brothers and sisters,"

1.The amount set forth in the Schedule of Distribution in
the above-captioned estate dated January 6,1970,awarded to Betty Lou Folkens
of $625.00 is in error since the Court by Order of November 24,1969,authorizec
payment to her of the sum of $350.00 per month for her services and the amount
is calculated as follows:
$350.00 for the month of April 20 to May 20,
350.00 for the month of May 20 to June 20,
350.00 for the month of June 20 to July 20,and
234.00 for the 2/3 month from July 20 to August 9,or
$1,284.00 Total
2.There was no indication in the Order,and no credit should
be given for the payment to her of money from Social Security which was not
contemplated by the parties at the time the agreement was entered into.
THEREFORE,the amount to be awarded to Betty Lou Folkens shoulc
be $1,284.00.

MEMORANDUM OPINION
Marino,P.J.November~,1969.
In this matter,a claim is made by a sister of the decedent for
services performed in caring for the decedent for a certain period up to the
time of his death,the period being from April 20,1968,to August 9,1968.
The executor of the estate agrees that the services performed by Betty Folken
were in no way subject to criticism.The services rendered were competent
and in many respects superior to those which would have been rendered the
decedent in a nursing home.In fact there is no unwillingness on the part of
the executor to pay claimant for the services performed at the rate that she
now claims compensation.However,it would appear that other interested
parties,among them certain heirs,object to the payment of the compensation
now requested by Betty Folkens in any amount which would be in excess of the
compensation agreed upon by Mrs.Folkens and the executor prior to acceptinc
the decedent into her home for nursing care.
Hence,the question here is very simple.Mayan executor pay
one for services in excess of the·amount contracted for?The testimony is
clear that Mrs.Folkens agreed to accept the decedent in her home for nursing
care at the rate of $350 a month.In fact she had first suggested that she
receive the sum of only $250 per month but the executor complained that this
was not enough,so the figure was fixed at $350 a month and everyone appeared
to be satisfied.

However,after inqu~ry being made,the price of nursing care at

various'homes was secured and it then was apparent to:the claimant that she
probably was being underpaid.However,she made no complaint whatever to
the executor prior to the death of the decedent,and she continued to care for
the decedent up to the hme o{his death.
Hence,the matter is extremely clear.May this executor pay more
than the agreed compensation simply because it is conceded that the nursing
care rendered by this claimant was undoubtedly worth more than the amount of
the contract under which she agreed to perform?The law is clear that where
there is a specific contract for rendition of services,claim can be made only
under the contract and not on a quantum meruit basis.It is perhaps ironic
that this claimant,who is able to prove a direct contract,cannot succeed in
asking for compensation on the basis of the value of services rendered.Had
there been no contract,or had there been a failure to prove a contract,the
claimant would have been entitled to payment for her services on a quantum
meruit basis.
This court decided in Briggs Estate',46 Wash.223,that upon
failure to prove a contract between the decedent and the claimant,recovery
might still be allowed on the basis of value of services rendered.But where
there is a specific contract,and proof of the contract is clear and precise,
the terms of the contract are the only basis of compensation that may be
allowed:Witten vs.Stout,284 Pa.410;:Schultz Est.22 D.&C.711;
Hemphill Est.27 Erie 57.

OPINION

The claim of Betty Lou Folkens was adjudicated by the Court on
November 24,1969.On January 6,1970,a decree of distribution was
rendered in accordance with the terms of the adjudication.Betty Lou Folker s
has filed exceptions to the adjudication and decree of distribution.
The original claim of this claimant was in the amount of $1998.29.
The exceptions concern various matters in the adjudication,and she now
claims that the estate owes her the sum of $1284.All of the exceptions filed
by her,save one,are dismissed as they have no merit.
In,our,adjudication,we disallowed the claim for labor costs which
she claims to have expended in contracting for the services of Iva King,who
was to receive $1.00 per day.The original agreement,or contract,gave
J?etty Lou Folkens no ~rivilege of hiring extra help.Likewise,the contract
did not provide for other out-of-pocket expenses for various powders,lotiom,
bandages,etc.,in the amount of $194.69.Hence,this item was also
disallowed.There was a claim for extra costs for soap and detergents for a
period of sixteen weeks in the sum of $80.00.This was disallowed.She als p
claimed compensation for the increase in her utility bills during the period
she cared for this decedent,in the sum of $70.00.This was disallowed.

However,in the adjudication,no mention was made of the sum of
$474.40 received from the Social Security Administration as disability
payment for this decedent.Betty Lou Folkens received this amount and
retained it as partial payment for her various services and expenses.As
stated,there was no mention made of this matter in the adjudication because
the testimony concerning the contract between the parties made no mention
of the disability payment.
In view of the fact that Betty Lou Folkens had made the various
other expenditures which could not be allowed because of the contract,we
believe that equity and justice demand that the disability payment received
by her should not be subtracted from the balance that is due her on the
contract.In the adjudication,we allowed on her claim the sum of $1400.00
minus $300.00 which was paid on account.Since the Social Security payment
was not contemplated in the contract,the amount of same should not be
deducted from the net balance owing her.Hence,she is entitled to the claim
as allowed in the sum of $1400.00 minus the $300.00 paid on account,which
leaves a net sum due her of $1100.00.
An amended schedule of distribution is ordered to reflect this
change.

claims in the estate of Dessie Pierson and the estate of Paul W.
Pierson.I think Mr.McCreight,representing the estate and I have
at least orally reached an agreement which Iwill state to the Court
as follows,and if Mr.McCreight has any corrections he can cer-
tainly make them'.
My understanding in talking to Mr.McCreight is
that there is no obj ection here that will be raised by the estate and
I am s peaking of the estate of .Paul W.Pierson,in regards to the fac"
that services were rendered.The issue,as ~understand,it,solely
will be the issue of the value of thos es ervices.And thatques tion
would be applicable to-the estate of Paul W.Pierson only.We would
at this time,stipulate that we would withdraw the claim which we
filed in the estate of Dessie Pierson,and that any testimony and
evidence we give would be applic?-ble to the estate of Paul~Pierson
only.I think that is correct.

brother William was going around to the convalesc'ent homes and he
couldn't seem to firid one that would accept Paul.And he told me if
I would take Pau~into my hom e and take care of,him he would give
me the price of the convalescent home.

Yes.In the morning she would come in and help me strip his bed
and get him bathed.But as far as ---I had to shave him,I had to,
cut his hair,I had to bathe him.Just everything like you would do
a small infapt baby,except he was a much heavier.man.

Well,when he first'took sick he'weighed 240 pounds.But then he los
