3.The decedent,William Rudge,died intestate on

4.Your petitioner proposes to sell the above described
lot of ground,including a two story frame dwelling erected thereon,
for the payment of debts and expenses at private sale to Thomas E.
McDonald and Shirley B.McDonald,his wife,of 123 West Pike Street,
Canonsburg,Washington County,Pennsylvania,for the total sum of
$4,250.00,upon the following terms:$200.00 down.payment of which
has been made,and the balance of $4,050.00 in forty-five (45)days.
An agreement of sale was executed by the petitioner and the proposed
buyers on July 30,1971,subject to the approval of the Court.A copy
of said agreement of sale is attached hereto and marked Exhibit "A".
5.Petitioner desires to sell at private sale upon the
terms specified because that price is more than could be realized by
public sale and is the highest and best offer received.
6.Your petitioner and the attorney for the estate have
during the past two years made repeated attempts.through real estate
brokers and other wise.to sell this property.but all attempts except
the proposed sale to Thomas E.McDonald and Shirley B.McDonald,
his wife.have been unsuccessful.
