TO THE HONORABLE P.V.MARINO,PRESIDENT JUDGE OF SAID COURT: The petition of LOUISE JOHNSON respectfully represents: 1.That your petitioner is the mother of Sam Watson,and is,therefore,a party in interest in his estate. 2.That the said Sam Watson,late resident of the City of Washington,Washington County,Pennsylvania,died,intestate,on March 6,1965,at Washington,Pennsylvania,leaving to survive, as his.only heir at law,his mother,Louise Johnson,your peti- tioner,his father,James Watson,having predeceased him,and decedent left no issue,nor issue of deceased children. 3.That the decedent's entire estate at the time of his death consisted of a one-half (1/2)interest in a partnership, known as Bennie Watson and Sam Watson,the total assets of said partnership being: 1960 Ford I-ton dump truck- Mfr's.No.F35COH47124 Title No.RN3-HP126 1956 Ford I-ton dump truck- Mfr's.No.F35V6E56935 Title No.3481 1950 Chevrolet l~-ton dump Mfr's.No.l4RVDI497 Title No.4690 ) ) ) ) ) ) truck-) ) ) valued at $1,000.00 10.00valuedat--,;;;.;;.,~--P.U.C.License No.84944 Total assets of partnership 1,010.00 Decedent's 1/2 into in partnership =505.00 ,'" 4.That no Letters of Administration have been granted on the Estate of Sam Watson,deceased,and it is not intended that any shall be applied for. 5.That no wages have been paid directly to members of . decedent's family under Section 201 of the Act of 1949,and no paYment is anticipated,the decedent 'having been self-employed. 6.That all the creditors 6f the decedent of which your petitioner has notice are as follows: H.D.Burch Funeral Home -Funeral Expenses ....$825.00 7.That the above named creditor has been paid by Bennie Watson,brother of said decedent and son of your petitioner,and the Estate of said decedent is indebted to said Bennie Watson in the amount of $825.00 by reason of the paYment of the aforesaid creditor. 8.That your petitioner is legally entitled to the Family Exemption,said decedent having resided with her at 485 Ewing Street,Washington,Pennsylvania,and being a member of her house- hold at the time of his death.However,your petitioner hereby waives her right to such Family Exemption. 9.That this petition for settlement is made pursuant to the provisions of Section 202 of the Fiduciaries Act of April 18, 1949,P.L.512,as amended (20 P.S.320.202),and Section 211 of the same Act,as amended (20 P.S.320.211). DECREE OF DISTRIBUTION AND NOW,July ~~1968,the foregoing Petition for Settlement of Small Estate having been presented in open Court, upon motion of Alexander McIlvaine,Esq.,Attorney for the peti- tioner,and it appearing to the Court that petitioner has waived the Family Exemption and that Bennie Watson is a creditor of the Estate of Sam Watson,deceased,by reason of having paid the funeral expenses of said decedent in the amount of $825.00,and is the only creditor of said Estate,and that no inheritance tax is due in the estate of said decedent, IT IS ORDERED AND DECREED that the assets of the Estate of Sam Watson,deceased,to-wit,a one-half (1/2)interest in the assets of the partnership,known as Bennie Watson and Sam Watson, which assets are:1960 Ford I-ton dump truck (Mfr's.No. F35COH47124 and Title No.RN3-HP126),1956 Ford I-ton dump truck (Mfr's.No.F35V6E56935 and Title No.3481),1950 Chevrolet l~-ton dump truck (Mfr's.No.l4RVD1497 and Title No.4690),and P.U.C.
