2.That Rebecca Jo Fields,deceased,died testate on
the 13th day of December,1966,a resident of Washington,Washingt n
County,Pennsylvania.
3.That letters testamentary were granted on March 3,
1967,by the Registe~of Wills of-Washington County,to your
petitioner,Ruth A.Byers,a copy of the will of the decedent
is attached hereto as Exhibit "A".
4.At the date of her death,the decedent owned the

situate in the Seventh Ward of the City of Washington
County of Washington,and State of Pennsylvania,and
designated as Lots Nos.175 and 176 in the plot of
lots laid out by the Highland Land Company,a Pennsyl
vania corporation,a plan of which is recorded in
Plan Book 2,page 111,in the Recorder's office of
said County.Said lots are further described as
follows:
Fronting.thirty (30)feet each on the South
side of Delawar~Avenue and extending back at right
angles to said avenue of even width one hudnred
thirty-six (136)feet to Alley "F".Bounded on the
West by Lot No ..177;and on the East by Lot No.174.
UNDER AND SUBJECT to the same exceptions,
reservations,conditions,etc.as recited or referred
to in prior deeds in the chain of title.

because there is not sufficient money to pay the debts and also
because of the judgment which exists in the amount of $1,608.00,
by Atlas Credit Corporation.
7.No mortgage will be discharged by the proposed sale.
8.The judgment of Atlas Credit Corporation will be
discharged by the pr?posed sale.
9.Notice of the presentation of the sale will be
given to all parties involved.
10.The petitioner requests the court,pursuant to
Section 543 of the Fiduciaries Act of April 18,1949,P.L.512
20 P.S.320.543,for leave to sell the real estate above de-

Dear Sir:
The decedent,Rebecca J.Fields,incurred an overpayment of $283.40 under
Social Security Account No.178-09-7229,prior to her death on December 12,
1966.The overpayment was caused by her acceptance of benefits to which .
she was not entitled due to her husband's employment and earnings for the
taxable year 1964.However,prior to her death,we were able to recoup
$10.00 which reduced the debt,to $273.40.
Our records show the decedent's daughter,Mrs.Ruth Byers,c/o George K.
Hanna,Attorney-at-Law,Washington Trust Building,Washington Pennsylvania
15301 was appointed administratrix of the decedent's estate.The United
States Code provides that if there are insufficient funds in the estate
to satisfy all the decedent's debts,the debt to the United States shall
be first satisfied;and if the administratrix pays other debts and does not
satisfy the debt to the United States,she then becomes personally liable
for such amount remaining unpaid.-\fe have written to Mrs.Byers requesting
her to make restitution of $273.40 from estate funds.
This letter is not intended as a formal claim and should not be considered
as such.It is merely intended to notify the court of the existence of
the overpayment and of our request to the administratrix of the estate for
repayment.
