The position of the estate is that the estate is not liable to the son who paid either all or a portion of the funeral bill. Partridge-Remick,Vol.2,p.15,Paragraph 11.04 (b)The surviving husband is,ordinarily,liable for payment of the funeral expenses of his wife,ex- cept where,by her will,she directs payment from her individual estate.He cannot,as Administrator,charge them against her per~onal estate. The SQperior Court in Samuels vs.Hirz,189 Superior 492,at page 494,said, "We have uniformly held that a surviving husband is liable for the funeral V" expenses of his deceased wife where the parties are living together at the time of her death". Hunter,Vol.3,p.185,A Husband is primarily liable for his wife's funeral expenses and expenses incident to her illness,although she has a separate estate.The wife's estate is secondarily liable,but such expenses will be deducted from the husband's distributive share,if any. It is the position of the estate that the husband is primarily liable for the funeral bill of his wife under the Superior Court's holding and in accordance with the Orphans'Court's texts.This leaves the question of expenses incident to the last ill- ness of the deceased.The statement in Hunter is authority for the proposition that' " the husband is also responsible for these expenses)even though the wife has a separate estate)but Hunter goes on to say that the wife's estate is secondarily liable.In this case it would appear that the estate was secondarily liable for the payment of the ex- penses incident to the last illness)namely the ~octor bill)hospital bill and ambu- lance bill.It could be argued that the share of the husband in the estate would be liable for these expenses and that they should be deducted from.the husband's distribu- tive share)if any. He also has $180.72 se.wer charge ~hich is his personal liability.And he's still occupying the premises.He filed a claim for reimbursement for the entire funeral bill.That is here. for the Court's perusal,along with a receipt given by Quinn Banks which shows that James Holley and Robert Holley both jointly paid the funeral bill.James Holley,the'other brother,at first indicated that he would assign his claim and later changed his mind and $laid n~. And I have no formal claim from him,although he advised me by' telephon~that he thought he ought to get his share of the funeral bill . back.I have got for the Court's information a statement from the Citizens Water Company covering the sewer liens on property. We have a value on the Poplar Street property at $3.000.The Court will recall that was the one .that was sold in C6ur ·open sale for $1.025.00.So we may have a problem there. There are two savings accounts.they are called joint but actually.they ar e·Janie V.Barnett in trust.one for Iris M.Holley in which there is $451.08,and one in trust for Robin RaYE Holley in which there is an amount of $67.75.I think these should l:e considered by the Court since we apparently.are coming up shortl!f we include both of the claims for reimbur~ementon the funeral. Our suggested distribution which mayor may not tn:€e:tEtae Court's approval would be after the {)ayment of.cos,ts .to raJ the Washington Hos pital.the Ambulance and Chair'Service and Dr.Nicholls ..And then whatever balance there is be distributed to James IJolley on account of the claim he made verbally for his sharE of the funeral bill.Mr.Robert Holley is represWi1ted by Mr.Celsier. .. ;They were all notified of the time of the audit.I will 8:dmit this isn't very good,but it's the best I have been able to do with it.Your Honor. 3~. But he has no assignment from his brother? • MR.DONALDSON:No.I prepared an assignment and sent-it to the 4 brother for his signature and he advised me by telephone that he wasn't going to sign it. THE COURT:Now it is your position that we can disregardor refuse Robert's claim for reimbursement for part of tne funeral expenses because he caused the estate a loss in refusing to take the property which he had contracted to buy.Is thatyour position? If the Court doesn't think it's appropriate,why,bythe way,these two chi~dren that have the savings accounts in trust,named in the savings accounts were ch :ildren of Robert Holley by a---that's this same Robert Holly,by a former marriage.They would be grand- children of the deceased.And nobody has,as far as the three heirs are concerned,none of them haveobjecfed to the accounts being turn~d over to the grandchildren.But with the claims of the two boys,if th Y \1.5. are admitted,it would appear that the savings accounts are going to have to be used to pay the boys.
