hearings that day at 1:30,but there are approximately 25 caseslistedbeforeyourcase.
It will be necessary for you to let me know in advance of

OBJECTI NS TO ACCOUNT AND TO PROPOSED DISTRIBUTION
AND NOW,September 13,1968 comes Grendola Grose,Widow
of the within decedent who makes and files the following Objec-
tions to the account filed by Aubrey D.Higginborham,Executor of
said Estate and to the Proposed distribution and balance of said
Estate for the following reasons:
1.The Accountant has failed to list and explain with
sufficient particularity the item in the account under "Other
Debts and Taxes,"being the amount expended by Executor to
Preserve the Real Estate (Repairs,Hauling,Painting,etc.),
"$910.00.
2.As stated in Paragraph 1,the within Widow cannot
determine and did not have sufficient notice of these alleged
expenses to determine whether or not they were in fact incurred
and made and to determine whether or not they were reasonable
and necessary.
3.The Accountant has failed to list and explain with
sufficient particularity the item in the account under nOther
Debts and Taxes,"being,"Miscellaneous Payments made by Executor
to Administor Real Estate,$231.00."
4.As stated in Paragraph 3,the within Widow cannot
determine and did not have sufficient notice of these alleged
expenses to determine whether or not they were in fact incurred
and made and to determine whether or not they were reasonable
and necessary.
5.That the within Widow believes that there is entitled
to be given due notice of these items,as set forth in previous
paragraphs herein,including the names,addresses,amounts,and
purposes of said alleged items of expenses.
~~6.That the within Widow had/advised and therefore

believes that the funeral bill expense of $715,whicEf'set further
in the account,is not accurate and is not the proper actual
expense of said funeral but that the means of proof of this
averment are in the exclusive possession and control of the
Exector.

7.That the within Widow objections to the within Executo
being awarded any commission as Executor unless and until he
accounts to the Court and to the within Objectant in a satisfactor,
manner as to the items complained of herein.
8.That despite request of the within objectant to accoun.
for,and explain the afore said matters in a sjtisfactory manner
said Executor has failed to do so up to the present time.
9.That the within objectant requests your Honorable Cour~
to surcharge the within Executor with the amount of money found
to be due from him to the Estate,because of the within matters
complained of and any other improper matter determined by the
Court.
10.Also,the Objectant herein requests your Honorable
Court to change the figures and amounts of the balance for dis-
tribution in accord with these objections •

Please be advised that I have made an extensive search
of the records in Washington County,Pennsylvania,and have
found no Department of Public Assistance Lien entered against
Harry W.Grose.The only judgment found agains't Harry W.Grose
pertaining to assistance or similar type payment was by the
Institution District of Washington County,Pennsylvania.This
lien was entered on or about February 27,1963,at No.176 Feb-
ruary Term,1963,D.S.B.I checked with the County Solicitor
and the Commissioners'Office and they assured me that they have
no way of determining the balance due,if any,on such a lien
entered in 1963.
Also be advised that this judgment has never been revived
since the date of entry,and therefore',I do hereby certify that
this judgment as entered at 176 February Term,1963,D.S.B.,is
not a lien against real estate of the named,Harry W.Grose.
Also be advised that the Department of Public Assistance in
Harrisburg has no record of such a DPA Lien being entered against
Harry W.Grose.
For your consideration I have enclosed herewith a copy of
the Reimbursement Agreement entered into by Harry W.Grose with
the Institution District of Washington County,Pennsylvania,and
have also enclosed herewith an Order to Enter Satisfaction of
Judgment prepared by the Department of Public Welfare for the

Administrator,shall renounce and forego all commissions,'cf0r
services rendered the Harry Grose estate.
2.It is stipulated and agreed that Tempest. ..-
and Simmons will forego the'collection of any attorney's fees due
from services rendered to the Harry Grose estate until the lien
taxes due the Tax Claim Bureau of Washington County have been fulliv
paid.
3.Upon the paym ent of the lien taxes,it
is stipulated and agreed that Tempest and Simmons,shall receive
their attorney's fees out of the rentals of the home now in the Harry
Gros e estate.
4.It is stipulated and agreed that Attorney
Jerome Hahn shall receive the rentals from Fetherlin &Carl,'
realtors,of the City of Washington,Washington County,Pennsylvani ,
and he shall deposit said monies in the Trustee Account;he shall
pay the lien taxes and upon the payment of the sarrne,shall remit
!the balance of the rentals to Tempes t and Simmons until such tilY)e
as the costs and attorney's fees in the above-mentioned estate have
been paid in full.
Further,it is hereby stipulated and agreed
that all fire ;.insurance and emergency repairs necessary to keep thE
premises tenable shall be deducted from the rentals as .a pr;iority
(ef{cept for real state tax~s)over the a~ove-mentionedexpenditures.

In reference to your letter of October 8,1979,on the above supject'
estate,please be advised that we have reviewed our'records and found that"
the original statement of tax due dated May 25,1978,was incorrect.
A supplemental statement of Debts and Deductions was filed in the
Register of Wills Office in the amount of $90.50,and in re~a1culating the
tax due we found that the entire estat~is taxable at the rate of 15%,not
one-harf at the rate of 6%and one-half at the rate of 15%as was done on
the original statement.
Therefore,the statement you received on September 18,.1979,was for
the additional tax due.

I received Mr.Svidro·s letter of March IS,1988,with
reference to the above estates.I would agree that we should
endeavor to get these matters settled,as considerable time
has gone by.I am dictating this at my office on a Sunday and
I made a quick search of my fi Ie cabinets for the fi Ie.I
cannot locate it at the moment and I have to leave the officeveryshortly.
However,I do recall that there was an insurance agency,
which I believe it was Hood Insurance that was collecting rental
on the property during the administration of the Estate of Harry
W.Grose.I think that this part of it among other things has
to be determined in the sense of what monies was collected and
what was paid from those monies to see what remaining debts there
are as mentioned by Mr.Svidro.Then in turn we can determine what
assets in addition to the real estate,if any,would be in the
Estate of Grendola Grose.I am sending a copy of this letter to
Victoria Jacobs,with whom I taHked some years ago about the
matter.She is welcome and I invite that she contact me on receipt
of thi~letter.However before talking with you,I would need
additional information in order to see what I would have to do to~ndeavor to wind up the Estate of Grendola Grose.
I might add that as you know,I have my own office in the
Washington Trust Building,but about 2 1/2 years ago started to
work in a part-time office in Pittsburgh at the address in the
upper right hand corner where I do work for an attorney there
ad some of my own.In short I would suggest if you contact me,to
probably try my Washington office as my secretary knows where I am.
My days in Pittsburgh vary,so it would be best to do this in thismanner.

you and bother you on Sunday.I have been revieying the files I had in
reference to the Harry Grose Estate and your aunt's estate.I have gotten
together some letters that I think will be of assistance to you in regard
to your inquiry.The last time I talked to you recently,you wanted to
know if I had in the file a statement given by Aubrey Higginbotham of what
monies he had spent.I found in one of the files on white paper,whi<;.h
appears to be a photocopy of a list.Perhaps this is the list you are
referring.I see at the upper right hand corner in pencil I had written
that Mrs.Jacobs had gotten cc.That apparently was made sometime ago
whenever it was given and by whomever it was given.I am enclosing a
series of letters,which I will just mention briefly because there are a
number of them.On the photocopies made you may see a notation of HG or
GG.This merely is a reference to your uncle or aunt's estate file,
as I got some of the letters from one and some from the other.I am
mentioning the letters chronologically.

In order to get this matter terminated,I think that I should send
a copy of the correspondence referred to herein and the list also to
Clyde Tempest,who is handling the estate of Harry Grose.It maybe that
due to the passage of years that he may not have a complete file or have
particularly the letters from the Agency which show what was collected
and what was paid out.I think it is necessary for his office to know
this so that he then can get his client in and see if this matter cannot
be finally determined and resolved which it should be.Please let me know
if you would consent to my sending a copy of these letters and enclosures
