FIRST:I direct rolf Executor,hereinafter named,to p~~

SECOND:I give and bequeath II\Y walnut colored fiat top desk
which was built by II\Y Grandfather to II\Y Brother,HENRY M.TEMPLE,of the
Borough of East Washington.
THIRD:I give,devise,and bequeath the residue of II\Y property,
whether real,personal,or mixed,of whatsoever nature or description,to II\Y
Sister,MARTHA TEMPLE PATRICK,of the City of Hart,Michigan,to II\Y Brother,
WILLIAM J.TEMPLE,of the Borough of Brooklyn,New York City,New York,and to
~Brother,HENRY M.T~MPLE,of the Borough of East Washington,Washington
County,Pennsylvania,each to have an undivided one-third ahare.
FOURTH:In the 'event that the above named Brothers and Sister
should all predecease me,it is rolf will that the residue of II\Y property,
whether real,personal,or mixed,of whatsoever nature or description,should
be divided equally between rqy two nephews,JOHN P.TEMPLE,of Green Ridge,
Pennsylvania,and HENRY E.TEMPLE,of the City of Shreveport,Louisiana.

PETITION FOR CITATION
AND FOR ORDER FINDING BONDS
TO BE PROPERTY OF THE ESTATE
AND NOW,this 11th day of October,1968,comes
HENRY M.TEMPLE,by his attorneys,PATRONO,CEISLER AND EDWARDS,
Esquires,and respectfully represents and sets forth as follows:
1.Your petitioner is the Executor named in the Will
of the above named decedent who was duly appointed as such-by the
Register of Wills of Washington County,Pennsylvania._
2.Your petitioner filed his inventory pursuant to
the duties incumbent upon him as personal representative on
June 5,.1968.
3.The said inventory included,inter alia,
thirty-one United States Savings Bonds having at the time of death
an aggregate value of $652.81 and registered in the names of
EDWARD L.TEMPLE or MRS.HELEN B.TEMPLE.
4.The said HELEN B.TEMPLE had at one time been the
wife of the decedent but had been divorced from him before the
decedent's death.
5.At the time of the said divorce proceedings,the
said EDWARD L.TEMPLE and HELEN B.TEMPLE physically divided
between themselves United States Savings Bonds owned by them and
registered in the names of EDWARD L.TEMPLE or HELEN B.TEMPLE.
Each.party received one-half with the agreement that the half so
received should be the sole and separate property of the party
receiving it.

6.The bonds listed by your petitioner in the
inventory were the one half thereof which were received by the
decedent and which were,in accordance with the said agreement,
agreed to be his sole and separate property.They were physically
in the possession of the decedent at the time of his death.
7.Subsequent to the death of the decedent,your
petitioner attempted'to get HELEN B.TEMPLE to e~ecute.papers
appropriate to liquidating the said Bonds so that the proceeds
thereof could be distribu~ed among the legatees of the deceased.
,However,the said HELEN B.TEMPLE refused to execute the said,.
papers,despite the fact that she had received her share of the
Savings ,Bonds owned by her and decedent at the time of the said
division~
8.'Your Honorable Court has jurisdiction over the
said property because it was in the physical possession of the
deceas~d at the time of his death and is now in possession of your
petitioner as personal representative of the deceased.Your
Honorable Court has jurisdiction to determine the ownership of the
said Bonds.
9.The address of the said HELEN B.TEMPLE is 107
South Main Street,Washington,Pennsylvania,15301.
WHEREFORE,your petitioner prays your Honorable Court that
your Honorable Court cause a Citation .to issue,directed to HELEN
B.TEMPLE,requiring her to show cause why your Honorable Court
should.not make an Order finding that the said Bonds are the
property of the Estate of EDWARD L.TEMPLE and directing any person
having jurisdiction over the transfer thereof to transfer said
Bonds on the order of HENRY M.TEMPLE,Executor of the Estate of
EDWARD L.TEMPLE.

TEMPLE,by his attorneys,PATRONO,CEISLER AND EDWARDS,Esquires,
and respectfully represents and sets forth as follows:
1.Your petitioner is the executor named in the wil
of the above named decedent who was duly appointed as such by the
Register of Wills of Washington County,Pennsylvania.
2.On October 14,1968 your Honorable Court issued
Citation directed to HELEN B.TEMPLE directing her to show cause w
certain united States Savings Bonds now registered in the names of
EDWARD L.TEMPLE or HELEN B.TEMPLE should not be adjudicated and
decreed to be the sole and separate property of EDWARD L.TEMPLE..
at the time of his death.
3.The said Citation set up a heaxinq'on the
subject 9f it on November 12,1968 at 10:00 A.M.
4.Your petitioner was never able to secure service
of the said Citati9u,as the following will reveal:
(a)He attempted to serve HELEN B.TEMPLE at
her former address,107 South Main Street,Washington,Pennsylvania,
but she was not present at that said place when service "was attemp ed.
(b)Your petitioner attempted to secure serv'ce
at 616 1/2 Main Street,Apartment B,Mt.Pleasant,Pennsylvania,

the sheriff of Westmoreland County,Pennsylvania,made a return of
"Not Found".
(c)Your petitioner has now determined that
HELEN B.TEMPLE is in residence at 107 South Main Street,City of
Washington,Washington County,pennsy~vania.
WHEREFORE,your petit:i.onerprays your Honorable Court that
the Citation of October 14,1968 be reinstated and that your
petitioner be authorized again to attempt to mqke service thereof
on the respondent,HELEN B.TE~~LE.

Dear Mr.Hana:
This will outline the fact that the hearing in the
Edward L.Temple Estate which concerned itself with the claim
of Mrs.Helen B.Temple to certain United States Savings Bonds
terminated in a settlement in Judge Marino's chambers.The
settlement resulted in a court order of approval.
Pursuant to the settlement four united States Savings
Bonds were delivered to Mrs.Helen B.Temple for her to retain.
These bonds should,therefore,result in a credit to the account.

We had additional expense in connection with setting
up this hearing,expense not reflected in the audit petition
