Ada N.Hindman,wife of testator,deid on October 10,1961,prior to testator.
All assets of the estate were liquidated to pay debts and expenses.The balance for
distribution comes from the sales of the real estate (devised in paragraph Fourth<;1f
the Will).All other bequests in the Will are adeemed,either by disposition in
lifetime of testator,or non-existence of assets or funds for the same.The
devisees in paragraph Fourth of the Will,Lloyd S.Hindman (Accountant herein),and
Helen L.Clark,by their execution of,and written joinder in this Audit Petition,
agree that the balance for distribut~on shall be awarded 10%to Lloyd S.Hindman
and 90%to Helen L.Clark.'

the last Will and Testament of Audley O.Hindman
late of the Borough or Burgettstown in the County aforesaid,deceased,
(a true copy whereof is to these presents annexed),was duly admitted to probate;and
Lloyd S.Hindman
the Executor in said Will and Testament named,having appeared before me and taken and subscribed
the oath of office prescribed by law;
NOW,THEREFORE,I,Josephine M.Douglas ,Register as aforesaid,do
grant these LETTERS TESTAMENTARY,unto the said
Lloyd S.Hindman
committing unto him the administration of all and singular the goods and
chattels,rights and credits,which were of said deceased,and requiring him
to exhibit a true and perfect inventory thereof into the Register's Offic'e,at WCl'shington,within ninety

WE,AUDLEY O.HINDMA~and ADA N.HINDMAN,husband and '
wife,of Burgettstown,Washington County,Pennsylvania,both being
of sound mind and memory do make,publish and declare this Will to
be jointly as well as severally our Last Will and Testament hereby
revoking and making void all former Will'or Wills by us at any
time heretofore made.
FIRST:All just debts and funeral expenses shall at
all'times be fully paid.
SECOND:We desire that all our property,real,'personal
and mixed wheresoever the same may be situated of which we may be
possessed at the time of the decease of either of us,shall be
inherited by the survivor hereof for life,with the right to
consume any ~art or the whole of the same.
THIRD:Upon the decease of the survivor hereof,it is
our desire that the property of both of us be treated as one and be
disposed of in the following manner:
(a)We give and bequeath the sum of Seven Thousand
($7,000.00)Dollars to our son~Lloyd S.Hindman.
(b)We give and bequeath the sum of One Thousand
($1,000.00)Dollars to each of our following grandchildren,they
being the children of our deceased son,Audley Hindman:
Thomas Hindman
Nancy Hindman
Mary Jane Hindman
Donald Hindman
James Nicholas Hindman.
(c)We give and bequeath the sum of One Thousand
($1,000.00)Dollars to each of our following grandchildren,they
being the children of our deceased daughter.Hettie Ruth Kraus:

during our'lifetime and in the event the survivor hereof has not
disposed of the same during his or her lifetime,we give and
bequeath all of our stock except the Anaqonda Company stock referred
to hereinabove,to our'daughter,Helen·L.Clark.
(f)We give and bequeath the diamond'dinner ring now
owned by Ada N.Hindman to Maybel Caldwell,sister of Ada N.Hindman
for her USe during her life.Upon the death of the said Maybel
Caldwell we give and bequeath the said diamond dinner ring to our
grandchild,carol1iindman,daughter of our son,Lloyd S.Hindman.
(g)We give and bequeath the wristwatch now owned by
Ada N.Hindman,to Maybel Caldwell,sister of Ada N.Hindman,for
her use during her life.Upon the death of the said Maybel Caldwell
we give and bequeath the said wristwatch to our grandchild,Ada
Kraus,daughter of Hettie Ruth Kraus,our deceased daughter.
(h)We give and bequeath the diamond cluster ring,now
owned by Ada N.Hindman,to our grandchild,Betsy Hindman,daughter
of Lloyd S.Hindman •.
(i)We give and bequeath the diamond solitaire engage-
ment ring now owned by Ada N.Hindm~n,to our,grandchild Mary Jane
Hindman,daughter of Audley Hindman,our deceased'son.
(j)We give and bequeath the diamond stickpin and
diamond ring,now owned by AUdley O.Hindman~to our son,Lloyd S•

FIFTH:We do hereby appoint our son,Lloyd S.Hindman,
as guardian of any property which passes to a minor under the terms
of our Will and with respect to which we are authorized to appoint a
guardian and hav~not otherwise specifically done so,granting to
him in this capacity the power to agree to any distribution of the
said property that he deems adyisable;the power to retain any
property,real or personal received by him in kind and the power and

authority,to sell the same upon such terms and conditions as he
believes advisable,giving good title to any real estate thus sold;
and the power and authority to invest in such stocks,bonds and/or
other investments he deems advisable without being limited to those
investments in which guardians are by law required to invest minors'
funds;and the power and authority to disburse to or for the benefit
of the minor wards,so much of the income and the principal of the
minors'share of said property as he in his sole discretion deems
advisable for the minors'comfort,maintenance,support and
completewucation,including preparatory,college and graduate or
professional training;and to aid the minors in the event of any

FAMILY AGREEMENT
MADE this 31st day of July,1968,by and between LLOYD S.
HINDMAN and HELEN L.CLARK.
WHEREAS,the source of the balance for distribution in.
the estate of the above decedent is the sales of real estate which
were devised to Lloyd S.Hindman and Helen L.Clark in different
measures as set forth in the Will of said decedent,and
WHEREAS the said Lloyd S.Hindman and Helen L.Clark
desire to agree amicably upon the exact proportionate share for
each of them in said distribution,
NOW,THEREFORE,IT IS MUTUALLY AGREED That the said
balance for distribution shall be divided 10%to Lloyd S.Hindman,
and 90%to Helen L.Clark,and the Court is hereby authorized
and respectfully requested to make the awards to them accordingly
in the Adjudication and Decree and Schedule of Distribution at the
Audit of the First and Final Account in the estate of Audley O.
Hindman,deceased,at the above captioned number and term.
