SELL REAL ESTATE UNDER THE PROVISIONS
OF THE FIDUCIARIES ACT OF 1949,SECTION
541,AS AMENDED.
TO THE HONORABLE P.V.MARINO,PRESIDENT JUDGE OF SAID COURT:
The PetitIon of HO~R R.GREEN,Administrator of the Estate
of RUTHAL GREEN,Deceased,does hereby petition the Orphan's
Court of Washington County,Pennsylvania,to authorize the sale
of real estate of the above referred to Estate,and in support
thereof states the following:
1.That your Petitioner,is the Administrator of the
Estate of Ruthal Green,and was duly appointed as said Administ-
rator on .::!Uf,...'-f Ito,Iqb~,by Russell Marino,Register of
Wills of Washington County,Pennsylvania.
2.That an Inventory was filed in the Register of Wills
Office of Washington County,Pennsylvania,on the ~~WOday of
July,1968,showing that the Decedent was the owner of the real
estate which is the subject matter of this Petition and that the
appraised value of all Decedent's real estate was One Thousand
One Hundred ($1,100.00)Dollars.
3.That your Petitioner,has entered into an Agree-
ment to sell all that certain undivided one-half interest in and
to a lot of ground situate in Snowden Township,Allegheny County,

MONONGAHELA,PA.
Pennsylvania,which is more specifically described as Parcel No.
1 in the above referred to Inventory,to Theodore Ross,for the
total consideration of Two Thousand Two Hundred ($2,200.00)and
No/100 Dollars,and a copy of said agreement is attached hereto
and made -'.a part hereof ·as Exhibit "A".
4.That attached hereto and made a part hereof as
Exhibit "B"and "C'.',r,espective1y,are Certificate of Liens
issued by the Recorder of Deeds and the Prothonotary of Allegheny
County,Penn~y1vania.
5.That the only other outstanding claim against
the Estate of Rutha1 Green,Deceased,is the claim of the
Pennsylvania State Inheritance Division for ~nheritance Taxes.
The funeral bill and other claims have all been paid by your
Petitioner.
6.That the names and relationship of all the parties
in interest,who are the heirs of Rutha1 Green,Deceased,are
as follows:
(a)William Caldwell,of 337 W.46th.Street,
Indianapolis,Indiana,being a son of the
Decedent.
(b)Esther Ferguson,of 1238 Quincy N.W.,
Washington,D.C.20011,being a daughter of
the Decedent.
(c)Homer R.Green,of 3606 Washington Avenue,
Finleyville,Pennsylvania,being a son of
the Decedent.
7.That attached hereto as Exhibit liD"is an appraisal
by a competent real estate appraiser stating that the agreed

consideration for the real estate which is the subject matter of
this petition in the amount of Two Thousand Two Hundred ($2,200.0 )
Dollars is a fair and just value for the said premises and a
better price than could be obtained at a public sale.
8..That the assessced value of the subj ect teal estate
is $800.00 according to the assessment records of the County of
Allegheny~Pennsylvania.
9.That'there are no adverse claims against the
Es~~te,and there are no objections to the sale of the subject
premises.
WHEREFORE,your Petitioner prays you Honorable Court,under
Section 541 of the Fiduciaries Act of 1949,as amended,to author
ize the Petitioner to execute a Deed in accordance with the Agree
ments attached hereto and made a part hereof,and to affix such
additional security to be entered by the personal representative
of the above Estate as the Court may direct.

7a.It is agreed by the parties hereto that if this Agreement and
Sale is not approved by the Orphan's Court of Washington County,Pennsyl-
vania,that this Agreement shall be null and void and deposit returned
to the Buyers.
8.If Buyer defaults in payment or performance for 30 days,Seller may,at Seller's election
use one or more of the following remedies in addition to or instead of any other remedies provided by law:
(a)rescind this agreement and retain all sums paid on account hereof as liquidated damages,in
which case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall surrender this Agreement for cancellation;.
(b)eject Buyer from said real estate,for which purpose Buyer hereby authorizes any attorney
of any Court of Record to appear for Buyer and confess judgment against Buyer in an amicable action of ejectment,
with immediate writ for possession of the real estate and for damages,to include attorney's commission of 5 %
or $100.00 and costs,hereby waiving stay of execution,exemption and inquisition,with release of all errors;
(c)affirm this agreement by delivery of deed to Buyer,declare all sums due hereunder to be
forthwith due and payable,and cause judgment to be entered therefor,for which purpose Buyer hereby authorizes
and empowers any attorney of any Court of Record to appear for Buyer and confess judgment against Buyer for
the whole balance due,together with interest,attorney's commission of 5 %or $200.00 ,and costs,
and hereby agrees to immediate execution thereon,waiviing stay of execution,exemption and inquisition,with re-
lease of all errors.
9.The Buyer agrees not to record this Agreement and recording by the Buyer shall constitute a breach
thereof..
10.This Agreement shall extend to and benefit and bind the heirs,executors,administrators,successors and
assigns of the parties.'Whenever used herein,the singular number shall include the plural,the plural the singular
and the use of any gender shall include all genders.
NOTICE -THIS DOCUMENT MAY NOT SELL,CONVEY,TRANSFER,INCLUDE OR INSURE THE TITLE TO THE COAL
AND RIGHT OF SUPPORT UNDERNEATH THE SURFACE LAND DESCRIBED OR REFERRED TO HEREIN,AND THE

The Petition of HOMER R.GREEN,Administrator of the
Estate of RUTHAL GREEN,Deceased,does hereby petition the Orphans'
Court of Washington County,Pennsylvania,to authorize the sale
of real estate of the·above referred to Estate,and in support
thereof states the following:
1.That your Petitioner,is the Administrator of the
Estate of Rutha1 Green,and was duly appointed as Administrator
on July 16,1968,by Russell Marino,Register of Wills of
Washington County,Pennsylvania.
2.That an Inventory was filed in the Register of Wills
Office of Washington County,Pennsylvania,on the '2v~d~y of
July,1971,showing that the Decedent was the owner of the real
estate which is the subject matter of this Petition and that the
appraised value of all Decedent's real estate was Two Thousand Two
Hundred ($2,200.00)Dollars.
3.That your Petitioner has entered into an Agreement
to sell all that certain lot of ground.situate in Snowden Township,
Allegheny County,Pennsylvania,which is more specifically des-
cribed as Parcel No.2 in the above referred to Inventory,In
addition to the undivided one-half interest previously sold at,

the above number and term by Court Order dated August 20,1968,
to Theodore Ross,for the total consideration of Two Thousand

4.That there are no liens against the subject premise
entered in Allegheny County concerning the subject premises.
s.That the only other outstanding claim against the
Estate of Ruthal Green,Deceased,is the claim of the Pennsylvani
State Inheritance Division for Inheritance Taxes.The funeral
bill and other claims have all been paid by your Petitioner.
6.That the names and relationship of all the parties
in interest,who are the heirs of Ruthal Green,Deceased,are as
follows:

(b)Esther Ferguson,of 1238 Quincy N.W.,

premises and a better price than could be obtained at a public
