RENUNCIATION
WHEREAS,ETTA REED MOWRY late of the City of Washington,
Washington County,Pennsylvania,died October 25,1967,leaving
ber Last Will and Testament dated November 17,1958,in which sho
appointed Peoples First National Bank &Trust Company to be
Executor thereof;and
WHEREAS,in view of the probable extent of tbe assets in
said estate,Pittsburgh National Bank,suocessor by merger and
consolidation to Peoples First National Bank &Trust Company,
has decided not to aot;
NOW THEREFORE,Pittsburgh National Bank,successor by
merger and consolidation to Peoples First National Bank &Trust
Company hereby declines its appointment as Executor of the Last
Will and Testament of Etta Reed Mowry,deceased,and renounces
in favor of any fit person to be appointed by the Register of
Wills of Washington County,Pennsylvania,in accordance with law.

We have your letter of August 7,1968,wherein you request
our advice on the taxability of premises 5 Highland Avenue,Washington,
Pennsylvania,in which property the above named decedent obtained a
life estate only under the terms of her father's will.
Please be advised that we have reviewed the various documents
attached to your letter and find that the gift to Etta Reed Mowr,y,
as set forth in the will of John Reed,is a life estate only to which
.she was entitled to the income during her lifetime with a power to consume
principal if necessar,y.At her death,the property passes from the
estate of John Reed to his grandchildren then living.
According~,it is our position that Etta Reed Mowry was not
the owner of premises 5.Highland Avenue,Washington,Pennsylvania,
at the time of her death and hence it is not a taxable asset in her estate.

which was owned by the decedent obtained from a Life Estate in her
father's Will.Mrs.Mowry lived in this property and collected
rents from same.
