Dear Mr.Chaney:
We have your letter of August 28,1968,wherein you advise
that the appraisement filed on July 26,1968,in the estate of the
above named decedent was erroneous.
In particular,you direct our'attention to the fact that
the real estate reported under Jointly-Held Property was appraised
at its full.value of $17,500.00,instead of one-half,or $8,750.00.
In this connection it is noted that the real estate was transferred by
the decedent on August 31,1950 to the joint names of the decedent and
Raymond L.Schriver and that the decedent died on September 6,1952.
The law in effect at the time of this decedent's death provided
that any property transferred by the decedent within one year from the
date of death was taxable as a transfer in contemplation of death unless,
of course,the presumption could be overcome.In this particular instance,
the transfer occurred more than two years prior to the decedent's death
and hence it is only one-half taxable in his estate.
Accordingly,you are hereby authorized to correct the appraisement
of July 26,1968,by reducing the value of the real estate in question
to one-half or $81.750.00,which you will note decreases the total Jointly-
Held Property to :Pll,750.00.This correction to the appraisement will
likewise reduce the value of both the gross taxable estate and the clear
value or net taxable estate to $13,728.25 and $12,797.43,respectively.
