TO THE HONORABLE P.V.MARINO,PRESIDENT JUDGE OF SAID COURT:
The petition of GROVER C.FULTON and LIDA F.PHILLIPS
respectfully represents:
1.That Grover C.Fulton is a resident of Hanover Town-
ship,Washington County,Pennsylvania,P.O.Address R.D.#4,
Burgettstown,Pennsylvania,15021,and Lida F.Phillips is a resi-
dent of the City of Pittsburgh,Allegheny County,Pennsylvania,
P.O.Address 1116"Reddour Street,Pittsburgh,Pennsylvania,15212.
2.John S.Fultoq died May 7,1967,and letters of admin-
istration on his estate were granted to your petitioners,Grover
C.Fulton and Lida F.Phillips,by the Register of Washington County,
Pennsylvania,on May 17,1967;
3.The only persons interested in the estate of the
decedent as heirs at law are the following persons:
Lillie G.Fulton,sister,Mayview,Pennsylvania;your
petitioner,Lida F.Phillips,a sister;your petitioner,Grover
C.Fulton,a brother,and William A.Fulton,a nephew,of County
Road 46,Toronto,Ohio,43964.
4.The real estate proposed to be sold is described as
follows:
ALL that certain tract of land situate in Buffalo
Township,Washington County,Pennsylvania,bounded and
described as follows:
BEGINNING at a point in the Taylorstown-Prosperity
Road in line of land now or formerly of Frank Ashmore;
thence by line of land now or formerly of Frank Ashmore,
North 45°55'East 746.6 feet to an iron pin;thence by
land now or formerly of Irwin and Cox,South 47°20'East
503.94 feet to an iron pin;thence South 45°55'West
922.2 feet to a point in the aforesaid Taylorstown-Prosperity

EXCEPTING and RESERVING all the coal in and under-
lying the above described tract of land,together with
the mining rights,waivers,privileges,etc.,as set
forth in deeds of James D.Irwin,et ux.,to Stewart E.
Frye and Nina Frye,his wife,of record in the Recorder's
Office for Washington County,in Deed Book 645,page 220,
Deed Book 638,page 343,and Deed Book 624,page 635,and sub-
ject to all provisions contained in said deeds relative to
oil and gas lease and such rights as/may have heretofore
been conveyed to a certain Electric Power Company.
5.This is the only real estate owned by the decedent
and has erected thereon a frame dwelling,frame garage and chicken
house.
6.The personal estate of the decedent consists of house-
hold furnishings,Cub tractor,Series Hand E savings bonds,sac-
ings certificate,savings accounts and checking account,all list-
ed in the inventory at a total value of $40,713.49.
7.Your petitioners have filed bond with corporate surety
in the amount of $10,000.00.
8.Your petitioners propose to sell the real estate
to Frank R.Beatty and Mearl C.Beatty,his wife,of 945 Addison
Avenue,Washington,Pennsylvania,for the price or sum of $22,000.00,
with all state and local transfer taxes to be paid by the seller
and with real estate taxes for the year 1968 to be prorated as of
the date of delivery of possession.
9.The real estate has'not been rented except for the
garage,which rented for $5.00 per month for three months.
10.An official certificate of the assessed value is
attached hereto,marked Exhibit "A".Affidavits as to value are
attached hereto marked Exhibit "B".
11.A copy of theagreement to purchase signed by the
Administrators and by Frank R.Beatty and Mearl C.Beatty,his
wife,which agreement is made subject to the approval of the
Orphans'Court of Washington County,Pennsylvania,is attached
hereto.
WHEREFORE,your petitioners pray your Honorable Court to
fix the amount of bond to be filed prior to the execution and delivery
of the deed for the real estate proposed to be sold.

One of the petitioners,Lida F.Phillips,has handled all her affairs
since that time,and she and her brother,Grover Fulton,between
them,have paid her expenses for the last five or six years.

MR.DONALDSON:
I understand then that she is not an adjudicated
She ,is no.t adjudicated.But she would know what
the notice was if we gave it to her.We have many additional credite
and certain additional debits.The credits mos tly arise by reason
of the sale of the real estate.The personal representatives made
a very advantageous sale of the real estate.And of course,that
required additional bond premium,payment of all the incidental
expenses.The Court will note that in the account and in the additio al.
credits asked at this time,there are certain sums for lawn care
and utilities.The personal representatives kept the propert>:WJi'n
top-flight shape and it added to the selling price,which was far
above any appraisal we had.We would like to be permitted to reta n
in the hands of the administrators,$2500 to cover either the incomE
tax or the Federal Estate ,Tax,whiehever way it turns out by reasor
of this sale.

Dear Hr.Donaldson:
After returning home today,I thought some of the following inforwBtion liught
be of interest to you,some of which was not covered in our conversation today:
\':ith reference to our Sister,Lilli~G.Fulton,a patient at the Hayviell State
Hosnita1,}mTJiew,Pa.she was admitted th~re in ~,and the cost of her main-
tenance in that year 'iaS approximately ~p80.00 month.In 1954,increased to
about $90.00 month~in 1955 to about $100.00 month,in 1957 to about $110.00
month and in 1958 to about ~~130.00 month.These figures are approximate.
At the tirr~of ~~ther's death,she left a certain amount of money,in her will,
designated to be used for Lillie's maintenance.While I was not apnointed
as her Guardian,this money ",as turned over to me and it "laS deposited in a
bank in Pittsburgh,and every penny of it,which we can show by our records,
was used in paying the bills we received from this Hospital for her maintenance.
At tte end of July 1958,this sum of money wa3 all used up,so I made a trip
over to the office at ¥lB.yview,Pa.to discuss financial matters with them,
exnl&ining that the three Brothers end myself were practically retired,and
while we did not want our Sister to be a charity patient,we could not continue
to pay the full maintenance.I was informed than none of us were responsible
for Lil~,Ie's ma.intenance.The lady in charge of the office wanted to know how
much we could pay and I informed her $50.00 month.
After Mother's money was used up,John,Graham and Grover gave me some financial
helD in paying the ~~50.00 month.3tartint;August 1958 up to August 1968,over
a period of ten years,I have paid the Hospital a total of $6050.00.
vfuile not officially appointed as her Guardian,inaGffiuch as I have h~ndled all
.this money,and have the records to account for every penny,I believe I am
capable and experienced in acting as her Guardian for any money she may inherit
from the Estate of John S.Fulton.
If you wish any further information,I shall be glad to furnish same.
As advised,I will be oat of the City starting September 21st until October 2nd •
